As indicated from my previous letter to you, my clients are still continue to experience golf balls coming onto their properties. We believe this constitutes an on-going risk to individuals on the property and it is only a matter of time before somebody gets injured. The changes we requested were originally proposed by Desert Willow but have not been fully implemented. As indicated in our previous letter, these include the following (a{{ related to the 11`n hole): Add one or more mature trees to the front right side at the tee box; Eliminate existing sand bunker on left side and replace with generous fairway so that this becomes a target from the tee box; Enlarge �ight side sand bunker and replace trees destroyed by wind to create hazard and to direct play away from the residences. You state in your letter that you will pass on our prior letter to Mr. Rodney Young of Desert Willow. My clients have agreed to wait a few weeks to see if Desert Willow can resolve this problem. We will diary this matter for December 8, 2006. We believe that this matter can be resolved easily and expeditiously, and my clients are at a loss as to Best, Best& Krieger Attention: Mr. David J. Although, the City of Palm Desert has made some effort to rectify the problem, my clients have continued to sustain property damage and have been unable to safely use their backyard and pool areas because of the constant ongoing threat of golf balls. My clients are afraid that it is only a matter of time before somebody gets injured. They are particularly concerned that grandchildren visiting their homes will get injured. My clients believe that simple steps can be taken to rectify the above-mentioned problem. It should be noted that the problems only concern the 11`" hole and are consistent with the steps that you outlined in your letter of September 27, 2005.
