Discussion: On April 19, 2007 the City Clerk advertised and called for bids for Landscape Maintenance Area No. 2. Contract was awarded to Greenscape Landscape, Inc. in the amount of $91,140.00. At the direction of the City Manager, the Landscape Services Division will be assuming responsibility for the landscape maintenance of Palm Desert Fire Station No. 71, located at Portola Avenue and Country Club Drive, and Fire Station No. 33, located at Fred Waring Drive and Town Center Way, and adding them to the Landscape Maintenance Area 2 contract. Staff contacted the landscape maintenance vendor for this area and requested a price quote for the additional work. Staff reviewed their estimate of $355 a month for both stations and it is consistent with the cost of services for similar areas in the current contract. Amend Contract C26400 Landscape Maintenance Area No. 2 Page 2 of 2 August 9, 2007 Funds are available in account 110-4614-453-3320. Therefore, staff recommends that, by minute motion, City Council amend Contract No. C26400 for Landscape Maintenance Area No. 2 for an additional $4,260.00 a year, bringing the contract to a grand total of $95,400 a year, and authorize the Mayor to execute the amendment. Contract C26400 Contract Amendment No. 1 Continued from front This Contract Amendment covers changes to the subject contract as described herein. The Contractor shall construct, furnish equipment and materials, and perform all work as necessary or required to complete the Contract Amendment items for a lump sum price agreed upon between the Contractor and the City of Palm Desert, otherwise referred to as Owner. Contract Time Extension -0- Days Revised Contract Total $95,400.00 The undersigned Contractor approves the foregoing Contract Amendment # 1 as to the changes, if any, in the contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said Contract Amendment # 1. The Contractor agrees to furnish all labor and materials and perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Contract Amendment items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood that the Contract Amendment shall be effective when approved by the Owner. Execution of this Contract Amendment by the Contractor constitutes a binding accord and satisfaction that fully satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity, arising out of or related to the subject of the Contract Amendment, whether known or unknown, including but not limited to direct and indirect costs and/or damages for delay, disruption, acceleration, loss of productivity, and stacking of trades, as well as any and all consequential damages. This document will become a supplement to the Contract and all provisions will apply hereto, all items included above must have required signatures as per the purchase resolution.
