C26480) IN THE AMOUNT OF $11,987.96 FOR THE INSTALLATION OF CARPET AT THE DESERT WILLOW CLUBHOUSE SUBMITTED BY: MISSY WIGHTMAN, PROJECT COORDINATOR CONTRACTOR: SMITH FLOORS & INSTALLATIONS 14417 MERIDIAN PARKWAY, BUILDING 6 RIVERSIDE, CA 92518 DATE: AUGUST 9, 2007 CONTENTS: CHANGE ORDER NO. 1 (C.O.R. NO. 1) Recommendation: By Minute Motion, that the City Council: (1) Approve Change Order No. 1 to Contract No. C26480 for the Change Order Request No. 1 in an amount of $11,987.96 for the installation of carpet at the Desert Willow Clubhouse; and (2) Authorize the Finance Director to move $11,987.96 from contingency to base. Executive Summary: Approval of this recommendation will allow the Contractor to move ahead as scheduled to complete the specified area simultaneously as the original scope of work. Discussion: On July 12, 2007, the City Council authorized staff to negotiate with the top -ranked contractor, Smith Flooring, in an amount not -to -exceed $120,000 and authorized the Mayor to execute all necessary documents to facilitate the negotiated contract. Staff has finished negotiations with the Contractor for a price of $113,470, and documents have been executed by the Contractor and are in process for execution by the Mayor. Staff Report Approve Construction Change Order No. 1 to Smith Floors & Installations (Contract No. C26480) Installation of Carpet at the Desert Willow Clubhouse Page 2 of 2 August 9, 2007 Since then, staff has been informed that the portion of the Desert Willow Clubhouse that was once dedicated to Intrawest for their own use has now been tumed back over to the City, and will be used as the Desert Willow Conference Center. At the time, the project was out to bid and negotiations were under way with Smith Floors; this area was not part of the scope. Staff has now been requested to include this area in the scope of work, so the new carpet design will flow throughout the Desert Willow Clubhouse in its entirety. Staff recommends approval of Change Order No. 1 for the replacement of carpet in the conference center at the Desert Willow Clubhouse as required to complete this project. Contract C26480 Change Order No. 1 Continued from front This Change Order covers changes to the subject contract as described herein. The Contractor shall construct, furnish equipment and materials, and perform all work as necessary or required to complete the Change Order items for a lump sum price agreed upon between the Contractor and the City of Palm Desert, otherwise referred to as Owner. Contract Time Extension Days. Revised Contract Total $125,457.96 The undersigned Contractor approves the foregoing Change Order # 1 as to the changes, if any, in the contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said Change Order # 1 . The Contractor agrees to furnish all labor and materials and perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Change Order items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood that the Change Order shall be effective when approved by the Owner. Execution of this Change Order by the Contractor constitutes a binding accord and satisfaction that fully satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity, arising out of or related to the subject of the Change Order, whether known or unknown, including but not limited to direct and indirect costs and/or damages for delay, disruption, acceleration, loss of productivity, and stacking of trades, as well as any and all consequential damages.
