REQUEST: Approve Amendment No. 2 to Contract No. C22870C with Berg &
Associates for Additional Construction Management Services on the
Portola Avenue Bridge (Project No. 647-04)

Recommendation:
That City Council, by minute motion, approve Amendment No. 2 to Contract
No. C22870C with Berg & Associates in the amount of $82,212.00 for
additional construction management services for the Whitewater Bridge at
Portola Avenue Project required due to the delay of side slope and invert
paving construction caused by the flooding of the channel and to construct
the soundwall on northbound Portola Avenue.
Background:
On July 14, 2005, City Council approved Contract No. C22870C with Berg & Associates for
construction management services in the amount of $761,171.00, plus a 10% contingency
for the Portola Bridge over the Whitewater Channel Project. Construction began on August
22, 2005. The project is approximately 90% complete and the west side of the bridge is
scheduled to be open to traffic in mid -August.
On April 12, 2007, City Council approved Amendment 1 in the amount of $133,050.00 to
Contract No. C22870C with Berg and Associates for additional construction management
services due to the project duration being extended from 18 to 24 months.
Discussion:
The construction management contract with Berg & Associates includes the required
inspection services, materials testing, and other direct costs. The Portola Bridge Project
was scheduled to be completed by the end of July. The completion of the project has been
delayed several months due to the construction of the soundwall on northbound Portola
Avenue adjacent to the Wedgwood Association and the significant amount of water from an
unidentified source that flooded the project site and delayed the construction of the channel
side slopes and invert paving. Construction management services provided by Berg &
Associates are required for the extended construction duration of 55 additional working
days.

Therefore, staff negotiated Amendment No. 2 to Contract No. C22870C with Berg &
Associates in the amount of $82,212.00 to provide the construction management services
required to complete the project. Staff has determined that the negotiated costs for the
additional design services are equitable and therefore recommends that City Council
approve Amendment No. 2 to Contract C22870C with Berg & Associates in the amount of
$82,212.00 and authorize the Mayor to execute the amendment. The revised total contract
amount of $976,433.00 is approximately 8.6% of the estimated construction cost, which is
well within the acceptable range for this project's size and complexity. Staff has requested
additional CVAG funding participation for the increased costs of this project.
