Approve a landscape-only approach to screening the recently-exposed north face of the Palm Desert Mobile Estates RV storage area; 2. Authorize staff to negotiate a three way cost sharing agreement between the City of Palm Desert, the Coachella Valley Water District (CVWD), and Palm Desert Mobile Estates, and authorize Mayor to execute same; 3. Appropriate necessary funds for the project in an amount not to exceed $15,000 to Account No. 400-4614-433-4001; 4. Suspend enforcement action and continue hearing of appeal of Notice to Abate for sixty days pending successful resolution of the issue; and, 5. Authorize the City Manager to dismiss the Notice to Abate upon execution by all parties of cost sharing agreement. Staff Report Palm Desert Mobile Estates Landscaping/Screening Agreement December 13, 2007 Page 2 of 6 Executive Summary: Approval of the staff recommendation would result in the planting of a natural landscape screen on the north side of the Palm Desert Mobile Estates, along the south side of the Palm Valley Storm Channel, and the dismissal of code enforcement action against the mobile home park. The landscape material should provide solid screen within four years. The cost of the landscape installation would be shared between the City, CVWD, and Palm Desert Mobile Estates. I. BACKGROUND: On October 25, 2007, the City Council directed staff to attempt to negotiate an agreement between CVWD, Palm Desert Mobile Estates, and residents of the Chaparral Country Club that would result in installation of a fence and landscaping to screen the Chaparral residents from a view of the mobile home park that was exposed by CVWD's removal of mature tamarisk trees on the south side of the Palm Valley Storm Channel. The exposed view of a portion of the park, that portion that stores recreational vehicles (RVs), is also the subject of a code enforcement action against Palm Desert Mobile Estates, since the municipal code requires that RV storage areas be screened from public view. II. POSSIBLE SOLUTIONS: Three possible solutions to the screening issue have been identified by the various involved parties. No solution is perfect; each solution has strengths and weaknesses. They can be summarized as follows: Solution Pros Cons Install a chain link fence Complete visual screening Most expensive solution with a fabric wind screen almost immediately. Solution is ($100K; City's share $40- and landscape plant favored by the Chaparral 50K). Fabric screen is likely material residents to become tattered and unsightly over time. Screened chain link fence will be unattractive, especially in such a large expanse. Public Hearing is required if ARC will not approve use of chain link fence. STAFF RECOMMENDATION: Staff recommends the third option described above: installation of irrigation, shrubs, and small trees that will create a natural landscape buffer in several years. Discussion with the various parties involved indicates that CVWD and the Palm Desert Mobile Estates will likely share equally in the costs with the City. Neither the Chaparral HOA nor the residents are willing to participate in the cost of the work. However, the residents there can easily and economically block their view of the mobile home park and RV storage area by installation of several trees on their own (north) side of the channel. (See photos beginning on Page 5 of this report.) With the concurrence of the City Council, staff proposes to finalize an agreement between the parties under which: • The City will solicit bids and award a contract to install irrigation plus 200 five-gallon shrubs and small trees on CVWD's property on the south side of the channel. • CVWD will install an irrigation meter to provide water for the landscaping. • Palm Desert Mobile Estates will pay the ongoing water bills for irrigation of the landscaping. Staff Report Palm Desert Mobile Estates Landscaping/Screening Agreement December 13, 2007 Page 4 of 6 • Tamarisk trees growing from the roots and seeds of the trees that were removed will be allowed to grow along with the new landscape material. The plant material will not be pruned, and will be left to fill in as a natural- looking, living screen. Palm Desert Mobile Estates will be responsible to maintaining the landscape at this level. • Each of the three parties will contribute to the cost of the work. Palm Desert Mobile Estates has committed to contribute a minimum of $5,000 if this solution is acceptable to the City Council, and if the code enforcement action is halted. Additional financial participation, so as to match the amount contributed by the City and CVWD, will be requested by the property manager but must be approved by the owner of the mobile home park. Staff estimates that with equal sharing, each of the three parties would pay approximately $10,000. In no case should the City's portion exceed $15,000. Backqround: Palm Desert Mobile Estates, situated on the SW corner of Portola Avenue and the Whitewater Storm Channel, has been renting spaces in a storage area on the north perimeter of their property to recreational vehicle owners who do not reside in the mobile home park. The storage area was previously screened by tamarisk trees which Staff Report Palm Desert Mobile Estates Page 2 of 4 October 9, 2007 were located on land owned by the Coachella Valley Water District. The storage yard was considered an existing non-conforming use due to the screening provided by the tamarisk trees. Chapter 25.22 of the Palm Desert Municipal Code allows recreational vehicle storage areas within mobile home parks with an approved Conditional Use Permit. The purpose of such a Conditional Use Permit is to stabilize and protect the residential character of the area and promote a better living environment. The Coachella Valley Water District removed the trees from their property after receiving numerous complaints from Palm Desert Mobile Estates that the trees were a hazard. The removal of the trees exposed the recreational vehicle storage yard maintained by Palm Desert Mobile Estates to public view from surrounding properties. Residents of a neighboring development, and some members of the public at large, have objected to the now-exposed storage area. Recreational vehicles not regulated as to parking or storing on private property interfere with the appearance, health, safety, and general welfare of the community. Citizens have a right to enjoyment of property and protection of property values. The City has made multiple attempts to gain the cooperation of the property manager, Mr. Bessire, and to bring the property into compliance with the municipal code or to negotiate a resolution that mitigates the public nuisance. Those attempts have not been successful. The only commitment Mr. Bessire has agreed to is to provide one-gallon plants and a drip irrigation system for the cost of $3,000 including continued maintenance of the plants. Mr. Bessire stated he intended to then pass this capital improvement cost onto his residents through the rent control review process. Chronoloqv: Below is a chronological list of the events leading to issuance of the Notice to Abate to Palm Desert Mobile Estates for failure to comply with Chapter 25.22 of the Palm Desert Municipal Code. January 30, 2007: The City began to receive numerous complaints regarding the exposed recreational vehicle storage area. February 9, 2007: Staff contacted Palm Desert Mobile Estates and met with Mr. Bessire to discuss the required screening for the storage yard. Staff explained to Mr. Bessire that he could either remove all the recreational vehicles from the storage yard or provide screening pursuant to Chapter 25.22 as it outlines the requirement for a Conditional Use Permit. Mr. Bessire received additional information regarding the screening requirements. He agreed to submit a landscape plan to the City for review. March 29, 2007: No action on behalf of Mr. Bessire. A letter was mailed requesting he submit a landscape plan to the City for review and approval to screen the storage yard. April 23, 2007: Mr. Bessire submitted a landscape plan proposing to install a drip irrigation system and install one gallon plants every five feet along the entire 1,359 lineal feet of fence line on the north perimeter and maintain on a regular basis. The City rejected the landscape plan and Mr. Bessire was informed and he needed to revise the plans. May 3, 2007: An "Order to Abate" was mailed to Mr. Bessire due to his failure to submit a revised landscape plan to the City. May 17, 2007: The "Order to Abate" dated May 3, 2007 was rescinded due to negotiations between the City, Coachella Valley Water District, and Mr. Bessire. Mr. Bessire reported that he would not commit to any of the negotiations unless he was allowed to pass on the cost of the capital improvement to his residents through the rent control review process. July 30, 2007: Mr. Bessiire, ACM Homer Croy, City Manager Carlos Ortega, and Pedro Rodriguez met in the City Manager's office to discuss a proposal of sharing the cost of screening the storage area with the City and Coachella Valley Water District. August 9, 2007: A letter was mailed to Mr. Bessire as a follow up to the meeting held on July 30, 2007, outlining the proposal to screen the storage yard and share the cost. August 13, 2007: Mr. Bessire responded to the letter dated August 9, 2007. He did not commit to the proposal, and reiterated that he would only negotiate and possibly commit to an agreement if he were allowed to pass this cost on to his residents. September 17, 2007: An "Order to Abate" was mailed to Mr. Bessire requesting the removal of all recreational vehicles from the storage area along with the canopy tents, or apply for a Conditional Use Permit and obtain a city business license. September 19, 2007: Mr. Bessire filed an appeal to the "Order to Abate" with the City Clerk's office. As I stated at the meeting, even though it is the City's position that this is a matter between Portola Mobile Estates and the Water District as a result of prior agreements, I would be willing to recommend to the City Council that the City participate financially in putting in trees to screen the recreational storage from both the Portola Bridge and Chaparral Country Club. To reiterate my proposal made at the meeting: The Water District, Portola Mobile Estates, and the City would share equally in the installation of a drip irrigation system and trees of sufficient size to assure that in a very short time the trees would screen the recreational area. Your previous letter dated July 23 to the City indicated that you would commit to paying for the irrigation system and for 1-gallon plants. As you related in the meeting, this was not acceptable to the Planning Department. My proposal stated that the City, the Water District, and Portola Mobile Estates would split the cost of the construction for the drip irrigation system and trees based on a one-third share of the cost. Recent conversations with Water District management leads me to believe that they would probably also provide the water for irrigation. If this proposal is acceptable, my recommendation would be that the City would not pursue the abatement of the recreational storage. In response to your letter of 8/9/07, where you propose the City of Palm Desert, the Water District, and Palm Desert Mobile Estates split the cost of the construction for the drip irrigation system and trees based on a one-third share of the cost, estimated cost approximately $75,000, we have the following comments. 1. As yau are aware we did agree to install a new irrigation system and plant 1 gallon plants every 5 feet along the 1,400 feet of our north perimeter fence line at an estimated cost of $3,000. We are still willing to incur that expense with no pass through to the residents of Palm Desert Mobile Estates. 2. However, if you want Palm Desert Mobile Estates to participate on a ��3 - ��3 - ��3 baSIS, we must request that we be allowed to pass through these costs to our residents in the form of a "Capital fmprovement" pass through under your local ordinances. If we are forced to close our RV storage facility, it would affect the NOI of the property and cause us to file for an increase in base rent to our existing residents / homeowners. 4. Response to Backqround: Over the years Palm Desert Mobile Estates had to put Chaparral Country Club on notice then CVWD, upon their acquiring of the property, as to the hazard these Tamarisk trees were causing. They would then send out a crew to trim just enough to eliminate the problems. In December of 2006 Palm Desert Mobile Estates once again contacted the CVWD to let them know it was time to take care of there trees, and with NO PRIOR NOTICE TO ANYONE the 1,400 feet of 40 foot Tamarisk trees were removed within two days. Mr. Rodriguez states that; the only commitment Mr. Bessire has agreed to is to provide one-gallon plants and a drip irrigation system for the cost of$3,000 including continued maintenance of the plaints. Then Mr. Rodriguez continues with; Mr. Bessire stated he intended to then pass this capital improvement cost onto his residents through the rent control review process. We disagree, in that I contacted Pete Vasquez code enforcement officer from the Department of Housing and Community Development and had him meet with myself and Mr. Rodriguez at PDME on March 8, 2007 to discuss the jurisdiction issues and what roll they play in regards to the storage area. May 14, 2007: PDME Appeal of Order to Abate was sent to Rachelle Klassen from the City Clerk's Office. Attached you will find a copy of the appeal letter dated May 14, 2007. (see attachment) May 17, 2007: PDME received a letter from Hart H. Ponder, Jr. Code Compliance Manager for the City of Palm Desert that rescinded the Order to Abate that was dated May 3, 2007, (see attached) Mr. Ponder also stated that; no further action will be required from PDME in relation to the rescinded notice to abate. In addition Mr. Rodriguez states that; the Order to Abate dated May 3, 2007 was rescinded due to negotiations befinreen the City, CVWD, and myself. This is incorrect, I was not aware that I was involved in any negotiations during this time. From May 3, 2007 to July 26, 2007 I was not involved in any negotiations or discussions in regards to the storage area. July 26, 2007: PDME was contacted by phone by Mr. Rodriguez and he informed us that Carlos Ortega the City Manager would like to have a meeting on July 30, 2007 to discuss the PDME storage area, which we agreed to. August 13, 2007: We did go on record dated August 13, 2007, (see attached letter) that was sent to Carlos Ortega, City Manager that we were even willing to install the required wall but also went on record we would be requesting the Rent Review Commission for a Capital Improvement pass through for this governmental required improvement. It should also be noted if you restrict us from having monthly storage rentals, it will effect Palm Desert Mobile Estates bottom line NOI which then would be cause for a second Rent Review Commission hearing resulting in higher rents for the lower income residents of Palm Desert Mobile Estates. Conclusion: Palm Desert Mobile Estates has always operated with a permitted storage area since its conception, we feel that the demands that are now being placed on us to remove the storage area or put up screening along the 1,400 feet of fence line at a cost of$25,000 to $100,000 plus continual maintenance is unreasonable at this time.
