Amendment No. 3 to Contract No. C22870 with Moffatt & Nichol in the amount of $32,915.00 for the design of a soundwall on northbound Portola Avenue between Magnesia Falls Drive and the Portola Bridge (adjacent to Wedgwood Glen Community), and 2. The appropriation of $32,915.00 for this amendment from unobligated funds in Account 400. Background: On October 4, 2004, City Council approved Contract No. C22870 with Moffatt & Nichol for design and construction support services in the amount of $563,467.00, plus a 10% contingency for the Portola Bridge over the Whitewater Channel Project. On July 14, 2005, City Council approved Amendment 1 to Contract No. C22870 in the amount of $50,751.00 for additional services to address unforeseen design requirements. City Council on August 24, 2006, also approved Amendment 2 to Contract No. C22870 in the amount of $48,500.00 for additional construction design support services to address unforeseen requests for information, previous change orders, and the girder failure that occurred. On July 31, 2006, the east half was completed and traffic was moved to that portion of the bridge. Construction of the entire bridge is scheduled to be complete in June 2007. Discussion: The original environmental document included noise readings in this area that exceeded the City's noise standards for single-family residences. The environmental document concluded that the elimination of the steep grade would cause Tess gearing and revving noise and that the overlay of rubberized asphalt paving on the roadway would minimize traffic noise. Therefore, a soundwall was not included in the project. Amendment 3 to C22870 with Moffatt & Nichol-Portola Bridge over Whitewater Page 2of2 February 22, 2007 After construction began, staff received traffic noise complaints from the residents of the Wedgwood Glen Association on the east side of Portola Avenue between Magnesia Falls Drive and the Portola Bridge. The residents complained that the trees which were removed for construction had provided them with a sound buffer and that the raised roadway created a visual impact upon their properties. Staff subsequently obtained a more thorough noise study that did recommend a soundwall be provided at this location. The recommended 10-foot-high soundwall would be constructed on Wedgwood Glen property along the approximate same alignment as the existing property wall, and will mitigate both the traffic noise and the visual impact. It is necessary to expedite the design so that a change order can be issued to Granite Construction to build the soundwall and do the replacement planting as part of the bridge project. The estimated soundwall construction cost is approximately $400,000.00. The construction change order will be presented to City Council for approval after design is completed and the cost is negotiated with Granite. If we are unable to negotiate this change with Granite, the soundwall and landscaping would need to be done as a separate project. A right-of-way agreement with Wedgwood Glen Association will also be required that would include reimbursement for the landscaping within their property removed for soundwall construction. Staff has determined that the negotiated costs for the additional design services are equitable. Therefore, staff recommends that City Council approve Amendment 3 to Contract C22870 with Moffatt & Nichol in the amount of $32,915.00 and authorize the Mayor to execute the amendment. Amendment 3 also includes revising the landscaping plans at the soundwall location and changes in planting of the areas adjacent to the Chaparral Country Club and the CVWD property. The revised total contract amount of $695,633.00 is approximately 6.9% of the construction cost, which is well within the acceptable range. This unforeseen expenditure was not budgeted. Therefore, staff also requests approval of the appropriation of $32,915.00 from unobligated funds in Account 4'0 for this expenditure. Joho/A. Garcia" P.E.
