Amendment No. 4 to Contract No. C22870 with Moffatt & Nichol in the amount of $59,500.00 to design the widening of southbound Portola Avenue between the Portola Bridge and Magnesia Falls Drive (adjacent to Palm Desert Mobile Estates), and 2. The appropriation of $59,500.00 for this amendment from unobligated funds in Account 400. Background: On October 4, 2004, City Council approved Contract No. C22870 with Moffatt & Nichol for design and construction support services in the amount of $563,467.00, plus a 10% contingency for the Portola Bridge over the Whitewater Channel Project. On July 14, 2005, City Council approved Amendment 1 to Contract No. C22870 in the amount of $50,751.00 for additional services to address unforeseen design requirements. City Council on August 24, 2006, also approved Amendment 2 to Contract No. C22870 in the amount of $48,500.00 for additional construction design support services to address unforeseen requests for information, previous change orders, and the girder failure that occurred. On July 31, 2006, the east half was completed and traffic was moved to that portion of the bridge. Construction of the entire bridge is scheduled to be complete in June 2007. Discussion: In order to expedite the bidding and completion of the Portola Bridge, no sidewalk was provided along the west side of Portola Avenue between the new bridge and Magnesia Falls Drive (adjacent to Palm Desert Mobile Estates). To widen the street and provide the sidewalk would require the acquisition of approximately 12 feet of right-of-way, which would have delayed the project. Amendment 4 to C22870 with Moffatt & Nichol-Portola Bridge over Whitewater Page 2 of 2 February 22, 2007 The gap in the sidewalk is undesirable and will require southbound pedestrians on Portola Avenue to cross at Quicksilver Drive. Staff recommends the design of the street widening proceed at this time, in order to provide the sidewalk and accommodate the future widening of southbound Portola Avenue as a separate project. Staff also recommends that Moffatt & Nichol design these improvements because they have much of the engineering data for this area and would thus be able to expedite the widening at a lower design cost. The design services include the following: • Soundwall acoustic study • Field survey • Utility coordination • Preparation of right-of-way legal descriptions and plots • Geotechnical review • Preparation of plans, specifications, and estimates for street widening and design of retaining/soundwail The estimated construction cost of the street widening is approximately $600,000.00. The widening will require the acquisition of the 12-foot right of way and one mobile home and some parking lot modifications. The total acquisition of right of way is estimated to cost approximately $700,000.00. The construction and right of way acquisition costs will need to be budgeted next fiscal year. Staff has determined that the negotiated costs for the additional design services are equitable and recommends that City Council approve Amendment 4 to Contract C22870 with Moffatt & Nichol in the amount of $59,500.00 and authorize the Mayor to execute the amendment. The revised total contract amount of $755,133.00 is approximately 7.5°l0 of the construction cost, which is well within the acceptable range. This unforeseen expenditure was not budgeted. The Consultant shall perform all work as necessary or required to complete the Professional Service Amendment items for a not-to- exceed price agreed upon between the Consultant and the City of Palm Desert, otherwise referred to as Owner. We understand that this project will be advertised as a "stand- alone" project. After widening, the westerly ctub of Portola Avenue wi11 be 44 ft. from the existing centerline and an 8 ft wide sidewalk will be provided behi_nd the curb. As you are aware, this will i-equire the acc�uisition of about 8 ft. of right-of-way from the adjacent mobile home park(perhaps slightly more to accommodate retainulg wall).
