In discussions that staff has conducted with other agencies involved with trail building in the Coachella Valley (Bureau of Land Management, Staff Report Trails Award of Contract Page 2 January 11, 2007 U.S. Fish and Wildlife Agency and the California Department of Fish and Game) no other qualified trail builders were identified. Mr. Schuler has been involved in trail building in the Coachella Valley for the over 20 years and is intimately familiar with the topography, routes and requirements associated with the construction of the subject trails. The Painters Path to lower Bump n Grind trail is being constructed to help alleviate some of the parking problems the City of Rancho Mirage has at the existing trailhead. Hikers will be allowed to park on Painters Path behind Target and still access the Bump n Grind. The City of Rancho Mirage has agreed to reimburse the City for the expense of that line item ($43,500). The current proposal is within the originally approved cost estimate. The trails fund has a balance of $367,959 remaining from the originally allocated amount (less previously constructed trails). Should any litigation or azbitration be commenced between the parties concerning the works of improvements as referenced herein, the prevailing party in any such litigation, being the AGENCY or the Contractor, should be entitled to a reasonable sum for attorney's fees incurred in any such litigation relating to this Contract. 5. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors, and assigns. 6. Contractor shall be paid in the manner set forth in the Contract Documents the amount of its Proposal as accepted by AGENCY, subject to such additions and deductions as may be made pursuant to the Contact Documents and applicable law. 8. Contractor shall maintain compliance with all provisions of CAL OSHA standards and regulations. Contractor acknowledges and agrees to be defined as the controlling employer at the job site. As the controlling employer, the contractor shall take reasonable steps to ensure that all subcontractors maintain compliance with CAL OSHA Standards and regulations. 9. Execution of the Agreement by the parties constitutes their agreement to abide by all applicable provisions of the California Labor Code; constitutes CONTRACTOR's certification that he is aware of the provisions of said Code and L-2 will comply with them; and further constitutes CONTRACTOR's certi�cation as follows: "I am aware of the provisions of Section 3700 of the California Labor Code which requires every employer to be insured against liability for worker's compensation or to undertake self insurance in accordance with the provisions of that Code, and I will comply with such provisions before commencing the performance of the work of this contract." No extension to the Contract Time will be made for changes in the work unless the changes impact work on critical path activities, according to the construction schedule currently in place at the time that the changes aze made. CONSTRUCTION REQUIREMENTS 25913 .02 Equipment Limitations All trail constcuction equipment shall be licaited tcs a maximum ovecall wheel or track width of �� inches . 25913.03 Trailbed TRAZLBED width shall be the width specified on the Straight Line Diaqram DRAWING. In general , a tolerance of 3 inches from the specified width will be allowed. The TRAFFIC PATTERN shall Eit the trail centerline and shall not be interrupted by abrupt chanqes in horizontal alignment due to rock oc other obstruc- tions pzojecting into the trail . A rock or stump that disrupts the horizontal alignment shall be removed . At these locations the TRAILBED width may exceed the specified dimensions . When large trees or othec obstructions are designated to be left in . place, the horizontal alignment shall be improved each direction from the obstruction for a distance adequate to obtain a con- structed trail with an uninterrupted TRAFFIC PATTERN. On SIDESLOPES of 10 percent or less, duff and Iitter shall be scalped from the TRAILBED area to expose , but not remove , MINERAL SOIL. No gradinq will be required except that which is necessary to create a smooth TRAIL TREAD. Duff and litter scalped frcm the TRAIL TREAD area shall be scattered outside the clearinq limits not more than 4 inches in depth . Duff and littec shall be scattered so as not to leave a BERM along .the trail . � 25913-1 (1/82) TRAILWAY EXCAVATION Ori SIDESLOPES between 10 and 30 percent, the TRAILBED shall be constructed with a dimensionally balanced section. On SIDE- SLOPES over 30 percent, the width of the embankment makinq up the TRAILBED shall begin to decrease . At 40 percent SIDESLOPES, • 3/4 of the TRAZLBED shall be on FULL BENCH. On SIDESLOPES over 10 percent , the trail shall be outsloped 6-10 pe rcent, . -__ When a rock safety BERM along the outside edge of the trail is speciFied on the Straiqht Line Diagram DRAWING, the TRAILSED shall be widened an additional 18 inches to accommodate the safety BERM. All backslopes shall be sloped to reascnably close conformity in accordance with the drawings . The backslopes shall be smooth and free from random variations. The backslope shall be rounded for • 6 inches above and below the catch point . 25913.04 Trail Tread TRAIL TREAD construction shall require all duff and Forest litter to be removed from the TRAILWAY. Holes and depressians resulting from the removal of rocks, roots and stumps shall be backfilled to an elevation equal to the adjacent tread surface. Backfill material shall consist of MINERAL SOIL and sa�all agqre- qate 2 inches or less in greatest dimension . The combined soil and aggregate shall be placed and COMPACTED by hand methods in successive layecs not to exceed 6 inches of loose depth before COMPACTING. Holes and depressions less than 3 inches deep shall 25913-2 (1/82) TRAILWAY EXCAVATION be backfilled as above, but will not require COMPACTION other than that received by construction traffic . The finished TRAIL TREAD shall be firm and smooth. Al1 loose surface rock over 2 inches in greatest diameter shall be cemoved . All exposed rocks or pertions thereof that are within 3 inches of the TRAIL TREAD surface , shall be removed . Rock below the TRAIL TREAO surface caay be leFt, provided that the rock does not protrude above the TFtAIL TAEAD surface or form a bump in the trail . Ledqe rock and large flat rock secureiy embedded in the TRAIL TREAD area may be used to form a pact of oc all of the TRAIL TREAD where the SIDESLOPE of the exposed surfaces do not exceed 10 percent and are of a relatively unifocm gradient with the adjacent TRAIL TREAD sections. Polished smooth rock surfaces in the TRAIL TREAD area shall be rouqhened by chippinq away 75 percent or more of the polished surface of the ledge crossing . The 75 percent shall apply uniformly along the ledge rock surface of the TRAIL TREAD area . �5913.05 Borraw Aress BORROW areas designated alonq the trail shall be left with � backslopes consistent with those used on the trail in the vicinity and show no visible mounds or depcessions.
