Recommendation:
By Minute Motion:
Ratify the City Manager's approval of payment for the
construction of a retaining wall at the Civic Center Park well site in
the amount of $14,850.00.
Discussion:
Upon completion of the new Civic Center Park well site, the Risk Manager for the City of
Palm Desert indicated that the exterior air conditioning area of the new building
represents a confined space and should be secured. The Risk Manager recommended
a retaining wall with a limited access gate.
Cal -OSHA standards define the area as a "confined space'; which
requires limited access and labeling the entrance with a confined
space warning.
Staff solicited bids from local construction companies capable of building a retaining
wall with a locking top entrance as requested by the Risk Manager. The following are
the results of the bid solicitations:
Contreras Construction Company, Indio, California
Sundown Construction Company, Indio, California
A.C.R. Concrete, Indio, California
$ 8,190.00
$ 9,950.00
$14,850.00

Contreras Construction Company indicated to Staff that they could not complete the
project in the identified time frame, therefore, the bid is considered non -responsive.
Sundown Construction Company also indicated that they could not complete the project
at the requested time; this bid was also considered non -responsive. Therefore, the
retaining wall construction project was awarded and accepted by A.C.R. Concrete.
Staff recommends that the City Council ratify the City Manager's approval of payment
for the construction of the retaining wall at the Civic Center Park well site in the amount
of $14,850.00. Funds for this expenditure are available in Account No. 110-4610-453-
3320.

The Risk Manager for the City of Palm Desert informed me that the exterior air
conditioning area of the new well site at Civic Center Park represents a confined space
and should be secured with only authorized access.
Staff completed the required bidding process, which included securing three responsible
bids, and posting a notice inviting bids on the public bulletin board at the City of Palm
Desert. Staff accepted the lowest responsible bid to construct the retaining wall.
The retaining wall with a locking access door that limits the entrance to authorized
personnel was constructed per the City of Palm Desert Building and Safety Standards
at the request of the Risk Manager.

Staff requests that the City Manager approve the payment to A.R.C. Concrete in the
amount of $14,850.00 and that it be ratified at the January 11, 2007, Ciry Council
Meeting.
