RECOMMENDATION:
By Minute Motion, concur with the action taken by the Legislative Review Committee at its
meeting of June 26, 2007, and direct staff to prepare a letter of opposition for the Mayor's
signature with regard to SB 303 (Ducheny) relative to Land Use Planning.
EXECUTIVE SUMMARY:
Passage of SB 303 would make significant changes to and place restrictions on the
manner in which local agencies adopt and administer General Plans.
BACKGROUND:
Current law requires that cities adopt a comprehensive Tong -term General Plan for the
fiscal development of that entity and addresses a number of elements, including Housing
and Open Space Element, and provides that General Plans be adopted as a single
document or as a group of documents relating to subjects or geographic segments of a
planning area.
While significantly amended since its original introduction, the parameters of SB 303 make
several amendments and impose restrictions on the manner in which the Housing and
Open Space Elements of General Plans are to be adopted, implemented, and
administered. The City, as a matter of policy, opposes any legislation that would affect the
manner in which it conducts its day-to-day business. In addition, the language in this bill
would require cities such as Palm Desert, which are built -out, to build-up.

RE: CONSIDERATION OF LEGISLATIVE REVIEW COMMITTEE ACTION ON
SB 303 (DUCHENY) AT ITS MEETING OF JUNE 26, 2007
Therefore, the Legislative Review Committee recommends that the City Council oppose
SB 303 and direct staff to prepare a letter stating that position to appropriate Legislators for
the Mayor's signature.
