REQUEST: APPROVAL OF WESTFIELD BUS SHELTER DESIGNS

RECOMMENDATION:
By Minute Motion, approve the following:
(1) Award of the bus shelter design and fabrication contract to All Purpose
Manufacturing,
(2) Approve Westfield bus shelter designs as proposed,
(3) Authorize staff to extend Contract No. C26030A with Contreras Construction in
the amount not to exceed $15,000,
(4) Authorize staff to work with CVWD to install water line and water meter to site in
an amount not to exceed $10,000,
(5) Authorize staff to appropriate funds from Account No. 400-4357-433-4001 in an
amount not to exceed $25,000.
DISCUSSION:
City Council approved the award of contracts and the appropriation of funds at iYs
meeting of March 22, 2007, to complete the three phases of this project to the following:
(1) Contreras Construction, (2) Hort Tech, Inc., and (3) LNI. However, staff had
inadvertently listed the name of LNI instead of All Purpose Manufacturing, which was
the proposed company from the beginning. As a result, staff is formally requesting that
the contract be awarded to All Purpose Manufacturing for clarity.
The project has been completed except for the fabrication and installation of the bus
shelters and the addition of the new amenities (i.e., water fountain, misters, vending
machines, and electronic signage system). Staff was to bring back to City Council for
approval the design of the shelters; however, with the addition of the above amenities
additional work is required as well. Staff has been working with All Purpose
Manufacturing to design the shelters with the intent to incorporate design aspects of the
proposed Westfield remodel. In keeping with this, contact was made with the architects
of the mall project who provided information and details of proposed materials, colors,
and design, etc. related to the remodel.

APPROVAL OF WESTFIELD BUS SHELTER DESIGNS
The estimated additional cost to the project is $25,000. The additional work will be paid
out the funds that were set aside for this project. There remains a balance of $77,602
from the original project budget, which will be used to pay the additional costs.
Staff has discussed the project and shown the proposed designs to SunLine, and the
above additional amenities were a result of that meeting. Attached are the renderings,
design layouts, and pictures of the project to date.
Staff requests approval of the award of contract to All Purpose Manufacturing, additional
costs to project as identified above, bus shelter designs as proposed, and appropriation
of additional funds.

REGULAR PALM DESERT CITY COUNCIL MEETING MARCH 22, 2007
Councilman Spiegel moved to, by Minute Motion: 1)Approve a Housing Agreement
in accordance with the conditions of approval of the Emerald Brook, LLC, project by and
between the City of Pafm Desert and WNRA Palm Desert 103, LLC, substantially as to
form; 2) authorize the City Manager or his designee to execute all necessary documents
to facilitate the agreement. Motion was seconded by Finerty and carried by a 5-0 vote.
XV. CONTINUED BUSINESS
A. REQUEST FOR APPROVAL OF AGREEMENT FOR THE PROVISION OF
LEGAL SERVICES TO THE CITY OF PALM DESERT (CONTRACT
NO. C00-008A) (Continued from the meetings of January 25, February 8,
and February 22, 2007).
Councilman Ferguson moved to continue the matter to the meeting of April 12,
2007. Motion was seconded by Spiegel and carried by a 5-0 vote.
B. REQUEST FOR AWARD OF CONTRACTS FOR THE WESTFIELD BUS
BAY PROJECT (Continued from the meetings of February 8 and
� February 22, 2007).
Mr. O►tega noted that Council continued this item pending a committee
meeting with SunLine. He said SunLine approved the design concept,
thereby authorizing staff to proceed with the project. In addition, as a side
matter, they requested the bus stop on the other side of the street be moved
farther down so that both were directly across from each other. However,
Council would only be taking action on the Westfield Bus Bay project at this
time.
Councilman Spiegel said he and Mayor Pro Tem Benson met with SunLine
and City staff, and all agreed it was the proper thing to do at the proper
location.
Councilman Spiegel moved to, by Minute Motion: 1) Award Contract No. C26030A
to Contreras Construction Company, Indio, California, in the amount of$283,000 for the
street and sidewalk improvements; 2) award Contract No. C26030B to All Purpose
Manufacturing, Oceanside, California, in the amount of$125,000 for bus shelter structure;
3) award Contract No. C26030C to Hort Tech, Inc., Bermuda Dunes, California, in an
amount not to exceed $50,000 for landscaping; 4) approve contingency for the project in
the amount of$77,602. Motion was seconded by Ferguson and carried by a 5-0 vote.
