Box 14247 Palm Desert, CA 92255 DATE: November 8, 2007 CONTENTS: Contract Amendment No. 1 Estimate Map Recommendation: By minute motion, amend Contract No. C26410 for Landscape Maintenance Area No. 4 to add the maintenance of the Monterey Avenue medians, north of Gerald Ford Drive, in front of Lowe's. Discussion: On April 19, 2007 the City Clerk advertised and called for bids for Landscape Maintenance Area No. 4. Contract was awarded to Sierra Landscape, Inc. in the amount of $47,028.00. The landscape improvements on the Monterey Avenue medians have been completed by Lowe's and accepted by Landscape Services staff. These medians need to be added to LMA 4 for regular maintenance. Staff contacted the landscape maintenance vendor for this area and requested a price quote for the additional work. Staff reviewed their estimate of $425 a month and it is consistent with the cost of services for similar areas in the current contract. Funds are available in account 110-4614-453-3370. Amend Contract C26410 Landscape Maintenance Area No. 4 Page 2 of 2 November 8, 2007 Therefore, staff recommends that, by minute motion, City Council amend Contract No. C26410 for Landscape Maintenance Area No. 4 for the remainder of the contract term (7 months) by adding $2,975, bringing the contract to a grand total $50,003.00. Contract C26410 Contract Amendment No. 1 Continued from front This Contract Amendment covers changes to the subject contract as described herein. The Contractor shall construct, furnish equipment and materials, and perform all work as necessary or required to complete the Change Amendment items for a lump sum price agreed upon between the Contractor and the City of Palm Desert, otherwise referred to as Owner. Contract Time Extension -0- Days Revised Contract Total $50,003.00 The undersigned Contractor approves the foregoing Contract Amendment # 1 as to the changes, if any, in the contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said Contract Amendment # 1 . The Contractor agrees to furnish all labor and materials and perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Change Amendment items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood that the Change Amendment shall be effective when approved by the Owner. Execution of this Contract Amendment by the Contractor constitutes a binding accord and satisfaction that fully satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity, arising out of or related to the subject of the Contract Amendment, whether known or unknown, including but not limited to direct and indirect costs and/or damages for delay, disruption, acceleration, loss of productivity, and stacking of trades, as well as any and all consequential damages. Note: There are presently 16 missing plants plus 9 missing Barrel Cactus. There is also damaged irrigation from a car driving onto the median.
