REQUEST: APPROVAL FOR THE POSSESSION AND CONSUMPTION OF ALCOHOLIC
BEVERAGES, STREET CLOSURES, WAIVER OF SOUND ORDINANCE,
SALE OF MERCHANDISE, AND CLOSURE OF A PORTION OF THE CIVIC
CENTER PARK IN CONNECTION WITH THE 2007 ART OF FOOD AND WINE
FESTIVAL.

CONTENTS: Schedule of Events for the 2007 Art of Food and Wine Festival
RECOMMENDATION:
By Minute Motion: 1) Permit the possession and consumption of alcoholic beverages on City-
owned property; 2) permit the closure of EI Paseo for 24 hours; 3)waive the 9 p.m. curfew for
amplfied sound;4)permit the sale of logoed merchandise on City-owned property; 5)authorize
fencing of the amphitheater area of the Civic Center Park, all in connection with the 2007 Art of
Food and Wine Festival.
EXECUTIVE SUMMARY:
Approval of this request will allow organizers of the 2007 Art of Food and Wine Festival to move
forvvard with the implementation of specific activities associated with the production of this
signature event.
BACKGROUND:
The City of Palm Desert will be presenting the 2"° Annual Art of Food and Wine Festival,
November&11, 2007. Several activities associated with this event will be held on City-ovmed
property and require waivers of applicable Municipal Codes by the City Council.
1. Palm Desert Recreati�nat Facilities Corp�ration will be tttie applicant to allow
alcoholic beverages to be served on Friday, November 9,2007,from 3-6 p.m,at
various locations along EI Paseo Drive located in the public right-of-way. In
addition,approval to possess and consume a�oholic beverages will be required
for the Civic Center Park Amphitheatre in canjunction with the proposed concert.
The possession and consumption of alcoholic beverages will be limited to a
fenced area, which will be specifrcally designated as such, and be attended to
ensure compliance.
2. On Friday,November 9,from 3-6 p.m.,on EI Paseo belween Sage and Larkspur,
temporary tents will be erected to present entertainment, subject-specific
seminars, book signings, in-store events and exhibits, and wine samplings. In
order to ensure the public safety and facilitate the activities,the event organizers
are requesting that EI Paseo be cbsed from Ocotitlo to San Pabb Avenue from
midnight November 9'"to midnight November 10�'for staging and teMing set-up
and tear down.

Subject: Street Closing of EI Paseo for Art of Food & Wine
At the regular board meeting for the EI Paseo Business Improvement District on May
17, 2007 the board approved the budget for and participation in the Art of Food & Wine
event. This approval was with the knowledge that the street would be closed for one
day in November during the promotion.
Subsequent updates to the board by Kemper and City staff have included information
on the street closure for Friday, November 9, 2007.
At this time over 55 merchants will be participating in the promotion with in-store events
throughout the day. This is approximately 10 more stores than last year and as the time
draws closer, we can expect additional participation.
