A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, VACATING A STORM DRAIN EASEMENT,
DESIGNATED AS "EASEMENT D," IN THE REMAINDER PARCEL OF
TRACT NO. 27882-1 UNDER PROVISIONS OF DIVISION 9, PART 3,
CHAPTER 4 OF THE STREETS 8� HIGHWAYS CODE OF THE STATE OF
CALIFORNIA, AND ACCEPTING A REPLACEMENT EASEMENT AND
AGREEMENT.
WHEREAS, the subject vacation is made pursuant to the requirements of the California
Streets and Highways Code, Division 9, Part 3, Chapter 4; and
WHEREAS, the City Council of the City of Palm Desert considered such matter and finds
from the evidence submitted that the easement described and depicted in Exhibit "A," attached
hereto and made a part of, is unnecessary for present or prospective public purposes;
NOW, THEREFORE, the City Council of the City of Palm Desert, California, DOES
HEREBY RESOLVE AS FOLLOWS:
I.
That drainage easement "D" located in the remainder parcel of Tract No. 27882-1 as per
map filed in Book 253, Pages 8 through 12, of maps in the Office of the Country Recorder of
Riverside County, California, be vacated as described and as set forth in Exhibit "A" attached
hereto; and
II.
That the Grant of Easement and Agreement for a replacement storm drain easement
described and depicted in Exhibit "D," attached hereto, be accepted; and
III.
That the City Clerk of the City of Palm Desert, California, shall cause a certified copy of this
resolution and order to be recorded in the Office of the County Recorder of Riverside County,
California and order the replacement easement and agreement to be recorded in said Office of the
County Recorder before or concurrently with this resolution; and
IV.
That f�om and afte�the date this resolution is recorded, drainage "easeme�t D" wilf no
longer constitute a public service easement.
PASSED, APPROVED, and ADOPTED at the regular meeting of the Palm Desert City
Council held on this 11"' day of October 2007, by the following vote, to wit:

THIS GRANT OF EASEMENT (this "Grant of Easement") is executed as of

A. I�layer is the owner of� certain real property situatcd in the City, County of
Riverside ("CourtlY"), State of California, as more particularly ciescribed on Exhibit "C" attached
hereto and incorporated herein by this reference (the "ProLe�").
B. Ccrtain unJcrgrounei sturm drain improv�ments (the "Storm Drain
Improvei��ents") currently exist on the Property at the location described by Exhibit "A" and
depictecl by Exhibit "B" attached hereto and incorporatcd herein by this reference.
C. City currcntly owns and holds an eascment for drainage purposes over a portion
of�thc Property, in a different location than where the Storm I�rain Improvcmcnts are situated, as
shown and dedicated on Tract Map No. 273g2-1 on file in Book 253 Pa�es 8 throu�h 12,
inclusive, of'�'Ia�s, records of Riversicle County, Califoi�lia(the "Existin� Easement"}.
ll. ?�layer now desires to grant <<n easement to the City ovcr thc portion of thc
Property upon and within which the Storm Drain Improvements are locatcd in order to facilitate
the City's maintenance of the Storni Drain Unprovcments, with thc undcrsta�idin� that ti�e City
will subseque��tly vacate and aUanc�on the Existing Eascment.

as follo�vs:
1. Grantin� of F,asement. Mayen c�rcby y�rants tu thc City an easement (thc
"Replacement Easement") over the portion of the I'roperty described in Exhibit "A" and depicted
on Exhibit "F3" attached hereto (thc "Easemcnt Arca") for the purpose oC allowing thc C:ity to
use, maintain, repair anci reconstruct the Stonn Drain Irnprovements and for related and
incidental drainage purposes, ��vhich Replacement Easer��ent includes rights of ingress and egress
over the Property as reasonably necessary to accomplish SL1CI� purposes, provided that to the
exlent feasible, all sucl� ingress and egress s}�all be limited anci confined to t}�e Easement Area.
By its acceptance of this Replacement Easement, the City acknowled�es that it has accepted and
owns thc Storm Drain Improvements, includinb the maintenance obligations associated
therewith.
2. Successurs and Assigns. This Grant of Easement shall constitute a covenant
which runs with the land and which is binding upon the successors and assigns of Mayer.
3. IN VV1T\'ESS WHI:RCOF, the Mayer has cxecutcd this Grant of Easement as of

STORM DRAIN EASEMENT
IN THE CITY OF PALM DESERT, COUNTY OF RIVERSIDE,
STATE OF CALIFORNIA
A 15.00 foot wide easement, lying over, under and across that portion of the remainder parcel of
Tract No. 27882-1, in the City of Palm Desert, County of Riverside, State of California, as per
map filed in Book 253, Pages 8 through 12, of Maps in the office of the County Recorder of said
County more particularly described as follows:
Said easement lies 7.50 feet on each side of the following described centerline;
COMMENCING at the southwesterly corner of Lot 7, of said Tract No. 27882-1, thence along
the southerly line of said Lot 7, North 89°37'30" East, a distance of 7.90 feet to the TRUE
POINT OF BEGINI�tING;
Thence, South 00°28'17" East, a distance of 223 feet, to the beginning of a tangent curve,
concave northeasterly and having a radius of 22.50 feet;
Thence southerly, southeasterly, and easterly along said tangent curve, through a central angle of'
90°00'00", an arc distance of 35.34 feet, to a point on a tangent line;
Thence along said tangent line, NoRh 89°31'43" East, a distance of 87.79 feet, to the beginning
of a tangent curve,concave southwesterly and having a radius of 45.00 feet;

Easement Vacation and Grant of Easement Processing

At your request, please accept this letter as the formal application of The Robert Mayer
Corporation, as agent for the owner, The Robert L. Mayer Trust of 1982 (collectively
"Mayer"), to commence the vacation/abandonment of Easement "D"on Map 27882-1.
The basis of this vacation request rests upon the fact that underground storm drain
improvements were installed(subject to permits and inspections by the City of Palm
Desert) in a location other than that covered by Easement"D".
Additionally, please commence the process for recording a new Grant of Easement from
Mayer to the City of Palm Desert over a portion of our property upon and within which
the underground storm drain improvements are located. I have previously transmitted to
you the draft"Grant of Easement" for these improvements and await your comments.
If you require anything further in order to complete the above requests, please do not
