Discussion: The attached MOU formalizes the arrangement between the City and DSUSD to pay for crossing guard services provided by the DSUSD. The DSUSD invoice for eight crossing guards for the 2006-2007 school year was $34,200. Funds are available in Account 110-4210-422-3090. The City has, for two years, reimbursed the DSUSD for this service, but there has been no MOU in place. In the past, the crossing guards were part-time City employees, and the annual cost was approximately $90,000.00 per year. The attached MOU creates the agreement framework for the DSUSD to hire, perform background checks, outfit with safety equipment and manage the performance of nine crossing guards for the schools in Palm Desert. The MOU provides that the City will fund the labor cost of the crossing guards at the standard DSUSD part-time employee "noon duty supervisor rate," which is currently $9.54 per hour for 2.5 total hours per day. The crossing guards are present about 75 minutes in the morning and 75 minutes in the afternoon at their assigned locations near the schools to assist the students and parents cross major intersections safely. Last year there were eight guards. Next year Staff Report Memorandum of Understanding — Crossing Guards Page 2 of 2 September 13, 2007 Contract No. C26930 there will be nine crossing guards funded. The City of Indian Wells reimburses the City for two guards at Gerald Ford School. The DSUSD has provided the City one invoice for the past school year based on the formula specified in this MOU. Washington Charter School maintains a separate calendar and budget from DSUSD and pays their two crossing guards out of a separate account. Therefore, the MOU also allows Washington Charter to invoice the City for its two crossing guards at the same DSUSD rate. Last year, DSUSD had six guards working for 180 days for the 2006-07 school year, which totals $25,758 and Washington Charter had 177 days for $$8,442.90. The total for the 2006-07 school year was $34,200.90. This is about 1/3 of what the City was paying for crossing guards when they were part time City employees. The City will reimburse DSUSD for the labor cost of the crossing guards each day school is in regular session at the "Noon Duty Supervisors hourly rate" for 2.5 hours per day. DSUSD agrees to provide seven (7) crossing guards at the locations as follows for at least 75 minutes before each school starts and for at least 75 minutes at the end of the school day. Following are the locations and number of guards: Rutledge and Palm Desert Middle School Portola and Magnesia Falls Portola and Rutledge Portola and Fred Waring Fred Waring and Warner Trail 1 Guard 1 Guard 1 Guard 2 Guards 2 Guards WCS agrees to provide two (2) crossing guards for at least 75 minutes before each school starts and for at least 75 minutes at the end of the school day. The City will reimburse WCS for (2) guards at their location, at a rate of 2.5 hours per day at the "Noon Duty Supervisors hourly rate" for each school day they are in session. Upon written mutual agreement the number and location of crossing guards may be modified. If the Noon Duty Supervisors hourly rate changes, DSUSD must notify the City in writing. DSUSD and WCS are responsible for hiring, conducting appropriate background checks, training, outfitting with reflective safety vests and traffic control paddles, and managing the performance of all crossing guards. The City's participation is limited to reimbursing DSUSD and WCS at the rate specified above. DSUSD will invoice the City for seven (7) crossing guards and WCS will invoice the City for two (2) crossing guards. Contract No. C26930 This MOU will remain in effect unless cancelled by either party upon thirty (30) day written notice of such cancellation or modified or superseded by mutual agreement in writing.
