REQUEST: By Minute Motion:
(1) Authorize the City Manager to negotiate and execute an agreement

Recommendation: By Minute Motion: (1) Authorize the City Manager to negotiate and
execute an agreement between the City, Coachella Valley Water District, and Palm Desert
Mobile Estates for the installation of appropriate landscape, maintenance, and provision of
irrigation along the Whitewater Channel adjacent to Palm Desert Mobile Estates; and (2)
Authorize the City Manager to award a bid, if necessary, for the installation of such irrigation
system.
Background: At the City Council meeting of September 13, 2007, the Council considered
staffs recommendation that the City coordinate with the Coachella Valley Water District and
Palm Desert Mobile Estates for the installation of trees to screen the recreational vehicle
storage area.
The recommendation was the installation of 150, 24" box trees and an appropriate irrigation
system at an approximately cost of $85,000.

The Council directed staff to look at planting larger trees so that the recreational vehicles
would be immediately screened. The City's landscape manager indicates that in order to
achieve immediate screening, 48" box trees would have to be installed that range from 10 to
14 feet tall, causing the projected costs to increase to $250,000.
In my previous conversations with the manager/chief engineer for CVWD, I requested that
CVWD pay one-half of the $85,000. That request has been changed to their participation in
half of the $250,000 if the Council would ultimately direct the installation of the $250,000
option. He has advised that his Board will consider it at their meeting of September 25.
Staff feels it should also be the responsibility of Palm Desert Mobile Estates to provide the
screening. So far, the manager for the mobile home park has responded with an agreement
to provide one gallon plants for a cost of $3,000, and that any additional costs, including
continued maintenance of the trees, would be in the form of a capital improvement to be
passed on to the residents. The City's response has been that the vehicle storage is not
related to the provision of mobile home spaces and we would not recommend that.
Therefore, the City has issued a Notice To Abate the recreational vehicle storage area, or in
the alternative for them to seek a permit from the City for the operation of such. If the
mobile home park chooses to seek a permit from the City, one of the conditions I
recommend be placed is that the park assume responsibility not only for a portion of the cost
of the screening, but also that they assume responsibility of the continuing maintenance of
such.
Attached are scenarios that depict the level of screening that would be achieved by (1)
staffs initial recommendation, and (2) the more expensive alternative.

Background:
Earlier this year, Coachella Valley Water District removed tamarisk trees along ihe
Whitewater Channel adjacent to Palm Desert Mobile Estates. CVWD did so as a result of
complaints from the mobile home park owners that the tamarisk trees created a large
amount of debris and a nuisance on the park site.

As a result, the mobile home storage area was exposed which created an unsightly view to
the north because there is only a chain link fence and many of the motor homes were
screened with unattractive shade structures. .
I am recommending that the City participate, to a limited extent, in a solution. City staff and I
have met with CVWD and the manager of Palm Desert Mobile Estates. I have proposed
that the three agencies arrive at a compromise which would involve planting trees of
sufficient size that will eventually provide screening for the storage area. The compromise
will need to involve funding of the necessary improvements plus an agreement by someone
other than the City that they will continue to irrigate and provide maintenance to the trees.
The Public Works Department has provided me with an estimate for the installation of 150
24" box trees and an appropriate irrigation system at an approximate cost of$85,000.

As Chairman for our ROV Committee(Restore Our View&Restore Our Values this is
a follow up letter since my appearance to speak at the City Council Meeting on
September 13, 2007,which is noted in the Preliminary Minutes on page 16. That
presentation was made on behalf of the Chaparral Association Board of Directors
regarding the City's efforts to provide screening to hide the vehicle storage lot a#PDME.
On August 23, 2007 our Committee approved a motion to place a request to you and the
City to consider a proposal for a commercial grade tennis court type fence with wind
netting to hide the PDME Storage yard in lieu of planting trees.
I am enclosing photos with notations and we respectfully request that the City consider
this proposal for reasons and benefits to all parties as follows:
- Immediate Screening in lieu of a 3 to 4 year waiting period for trees to mature.
- Economical: Cost estimates, $50,000 to include labor&materiai, 12 ft. high, 1400
lineal feet, green vinyl coated 1 3/4 mesh with gates and wind control netting.
- Very Low Maintenance: Possibility of Chaparral Association being involved.
- Fence and Wind Netting over mesh to help prevent wind damage to PDME vehicles,
storage barns and potential for collateral damage.
- Snail vine or other desert friendly vine possibly to be added with irrigation emitters.

D. CONSfDERATION QF REEMBURSEMENT OPTIONS FOR THE �
COOK STREET WIDENlNG PROJECT (PR4JECT NO. 609-05}.
: Mr. Ortega noted this �tem was retumed for further consideration by Councit.
The ques#ion whether the Cffy ►,voufd take 50% reimbursernent when the
project was completed, or enter a fut�re reirtzbursement agreement to be
reimbursed in fihe year 2�13 at 75%. Counci! had also asked what the
fQregoing interest wauid be for the City to wait. He said the Finance Director
ca(culated both options and it was determined that at this point, #he City
cou(d go ei#her way.
Mayor Keily exp{ained the City applied for a bond program that was set at
50/5� reimbursemen# with the project getting done rtaw, or go fihraugh the
regular process with the City paying for the whole project up front and getting
reimbursed in 20'I3. He said with the arnount of in#erest fost from the
compensation, the City would be better off jus# paying 50% and getting the
project done.
Councilman Ferguson moved to, by Minute Motion, direct staff to maintain the
current 50% bond reimbursemer�# agreement with the Coachelia Va{ley Association of
�Qvemm.ents {CVAG) for the Cook Street Widening Project. Motion was seconded by
Firterty and carried by a 5-0 vote.

MS. GALE BROEKER, Palm Desert, CA, read a resolution proposed by the Palm
Desert Greens Democratic Club to stop the fanding of the iraq War. She provided
copies of it for the City Cauncii, it was received for the record and is now on file with

MR. TRACY TURNER, Palm Springs, CA, opposed the iraq War and provided
comments by Scott Ritter, Ch'tef United Nations Weapons inspeotor in Iraq, 199'I-
1998, including his claims #hat iraq had effectively been disarmed, which were
ignored by both the administration and mainstream media. He said in the wake of
the debacle, Mr. Ritter had been vindicated for his previous cQmments. He also
� read excerpts from Mr. Ritter's boak, as well as on� by Janet Karpinsky.

Additionally, removal of those trees allowed fight spiffover fram the recreational

impact on the southernrnost street in Chaparrat Country Club. He noted the trees
were removed without any notice to Chaparrai Country Club, which includes 625

their marketability. He would appreciate anything the City Council could do to
atleviate this issue.
�{f MR. BtLL SCHUMACHER, Chaparral Cauntry Cfub, Palm Desert, CA, aiso
expressed concem for the blighted area that was exposed after remova!of the trees
along the border of PDME. He no#ed that the existir�g zoning there was R-1-M for
a mobile home park, and such facitities inciuded storage areas. He suggested a
zone change far that area with a conditional use permit that woufd require the PDME
storage yard be cleaned up. He agreed that this issue was a detriment to home
values and a real irritan# to residents of Chaparra! Country Club. Therefore, he
asked Ci#y Co�ncil and City staff to he(p resolve#he issue and eiiminate this blighted
condition in Palm Desert.
Mayor Keily assured Messrs. Autterson and Schumacher that the Ci#y and its staff
were already working on the matter.
