HomeMy WebLinkAboutRes 08-23 Surrending Permit for CVMSHCPCITY OF PALM DESERT DEPARTMENT OF COMMUNITY DEVELOPMENT STAFF REPORT REQUEST: Consideration of Surrendering of Permit (PRT-698685) for the Coachella Valley Fringe -Toed Lizard Habitat Conservation Plan SUBMITTED BY: Renee Schrader Associate Planner DATE: April 10, 2008 CONTENTS: Draft Resolution Recommendation: That the City Council, by Minute Motion, adopt Resolution No. 08-23 surrendering the Permit for the Coachella Valley Fringe -Toed Lizard Habitat Conservation Plan. Discussion: The Coachella Valley Multiple Species Habitat Conservation Plan (CVMSHCP) will replace the current Coachella Valley Fringe -Toed Lizard Habitat Conservation Plan (CVFTL HCP) when final permits for the CVMSHCP are issued. The CVMSHCP provides complete coverage for the Coachella Valley fringe -toed lizard, including coverage of areas that are not currently covered under the CVFTL HCP. In order for there to be a smooth transition from the CVFTL HCP to the CVMSHCP, the Coachella Valley Association of Governments (CVAG) is requesting that the Permittees surrender the CVFTL HCP incidental take permit when collection of the CVMSHCP fee begins. This will allow federal permit coverage of the Coachella Valley fringe -toed lizard to continue without interruption. While CVAG expects the CVMSHCP permit to be issued in March of this year, there are some close-out accounting procedures that must be completed before the federal CVFTL HCP permit is formally cancelled. The CVMSHCP calls for the formal cancellation of the CVFTL HCP within six months of the issuance of the CVMSHCP permit. A City Manager HOMER CROY ACM for Develor(ent Services ":ITY COUNCIL ION: APPROVEDDENIED RE E I\TED .,,, OTHER, f, T J NG 1p,7iJ frier NCE S :1� AE SENT : ocori. 6/ rj? .r VERIFIED BY: 1JK /Van Driginal onFile with City Clerk's Office G:\Planning\Tonya Monroe\word files\City Council Staff Reports\Coachella Valley Fringe -Toed Lizard Habitat Conservation Plan Permit.doc RESOLUTION NO. 08-23 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, SURRENDERING THE PERMIT FOR THE COACHELLA VALLEY FRINGE -TOED LIZARD HABITAT CONSERVATION PLAN WHEREAS, the Coachella Valley fringe -toed lizard (Uma inornata), is a species listed as "threatened' under the Federal Endangered Species Act of 1973, as amended; and WHEREAS, the Coachella Valley fringe -toed lizard (Uma inornata), is a species listed as "endangered' under the California Endangered Species Act; and WHEREAS, a habitat conservation plan developed for the Coachella Valley fringe -toed lizard received a Federal permit (PRT-698685) in 1986 (Permit); and WHEREAS, the City of Palm Desert was a signatory to the Implementing Agreement for the Coachella Valley Fringe -toed Lizard Habitat Conservation Plan and has faithfully executed all its obligations; and WHEREAS, the Coachella Valley fringe -toed lizard is covered under the Coachella Valley Multiple Species Habitat Conservation Plan/Natural Community Conservation Plan; and WHEREAS, the Coachella Valley Multiple Species Habitat Conservation Plan/Natural Community Conservation Plan provides superior biological protection of the Coachella Valley fringe -toed lizard and its habitat; and WHEREAS, the Coachella Valley Multiple Species Habitat Conservation Plan/Natural Community Conservation Plan provides a permit under California law; and WHEREAS, the Coachella Valley Fringe -toed Lizard Habitat Conservation Plan does not provide a permit under California law; NOW, THEREFORE, BE IT RESOLVED that the Palm Desert City Council approves surrendering the Permit for the Coachella Valley Fringe -Toed Lizard Habitat Conservation Plan. Surrender of the Permit shall be effective upon implementation of the Fee Ordinance for the Coachella Valley Multiple Species Habitat Conservation Plan/Natural Community Conservation Plan.
