Staff Report II. DRAFT Resolution No. 08-24 III. Resolution No. 94-88 Recommendation: Waive further reading and adopt Resolution No. 08-24, relating to the production of documents. Executive Summary: Adoption of the subject resolution will update the City's current policy for production of documents, which was last addressed in 1994. While the City is limited by State law in the amount it can charge for reproduction in response to a subpoena, the updated resolution will provide for recovery of actual costs incurred in the reproduction of documents in response to a standard Public Records Act request. Discussion: Pursuant to the California Public Records Act (Government Code Section 6250, et seq.), the City is obligated to produce public records/documents upon request, subject to certain exemptions for non-disclosable records. On August 25, 1994, the Palm Desert City Council adopted Resolution No. 94-88, relating to the production of public records, and it has served the City well over the last 13' years. With faster means of both creating and requesting documents, the City Attorney's office was asked to review the current resolution and provide an update. Approval of the recommendation is respectfully requested in order to make the necessary updates to the City's current policy for production of documents.
