NPDES Stormwater Discharge Permit Implementation Agreement
That City Council, by Minute Motion, authorize the Mayor to execute the
National Pollutant Elimination Discharge System Stormwater Discharge Permit
Implementation Agreement.
Background:
The NPDES was enacted by Congress in 1987, amending the Federal Clean Water Act and
requiring public agencies to obtain urban stormwater discharge permits. The NPDES Municipal
Separate Storm Sewer System (MS4) Permit is being renewed and will reflect changes
adopted by the Colorado River Basin Regional Water Quality Control Board. It is anticipated
that the California Regional Water Quality Control Board — Colorado River Basin Region will
issue our new permit May 21, 2008.
Discussion:
Under the NPDES Permit municipalities are required to enter into an Implementation
Agreement (Agreement) with the agencies that manage the regional and local stormwater
facilities. The Agreement between the Riverside County Flood Control and Water Conservation
District (RCFC), the County of Riverside, the Coachella Valley Water District, the City of
Banning, and the nine (9) Coachella Valley cities is designed to implement the NPDES permit.
This Agreement identifies RCFC as the lead agency responsible for coordinating fulfillment of
the various requirements of the permit. It also provides for reimbursement to RCFC for
program and administrative costs associated with the development, implementation and
management of the federally mandated NPDES program.

The City of Palm Desert, along with the co-permittees, is currently working under an expired
Agreement. A new Agreement has been prepared and now requires approval by the co-
permittees. The methodology for reimbursement in this agreement remains the same. Section
3D has been added to more clearly identify the duties of RCFC as lead agency while also
incorporating Section 3D into the payment methodology. The attached Agreement has been
reviewed and approved by RCFC's legal counsel and our City Attorney.
Staff recommends that the City Council, by minute motion, authorize the Mayor to execute the
subject agreement.
