Recommendation:
Pass to Second Reading
Background:
Considerable issues have been raised with regard to the effects of secondhand
smoke. The Council did previously by our regulation of tobacco retailers as well as
the regulation and prohibition of smoking, attempt to provide protection to the non-
smoker which is a stated goal of the State of California and all healthcare
advocates. We have provided an ordinance which should in a positive manner
protect the nonsmoker from the effects of secondhand smoke when they are
adjacent to or in close proximity to areas where smoking is permitted. I would be
happy to answer any questions that the Council may have with regard to the
additions that we are making to the ordinance. The Council will note that the items
underlined are added to Section 8.36.040 and the entire section dealing with
secondhand smoke is also added.
