Recommendation:
By Minute Motion: 1) Approve the reimbursement of $66,326.82 of additional
AIPP fees for the art component for the Village at University Park project, located
at 36-891 Cook Street, Palm Desert, California. Funds are available in Account
No. 436-0000-312-2700; 2) authorize Mayor to execute same.
Executive Summary:
At its meeting of August 24, 2006, the City Council: 1) Approved the design
proposal "Ground Swell" by Phillip K. Smith, III, for the Village at University Park
project, and 2) appropriated $70,000 from Account No. 436-0000-312-2700 for
future reimbursement as part of the Art in Public Places art component fee. At
the time of application the developer had only paid in $70,000 to the public art
fund, while the actual cost of the piece totaled $136,326.82.
Discussion:
The artwork has been completed and installed, and the developer has now
requested a refund of AIPP fees paid in an amount equal to the total cost of the
artwork itself. Staff has reviewed and verified the invoices submitted by the
developer in the amount of $136,326.82. Based on the City Council's action of
August 24, 2006, $70,000 has been reimbursed to the developer, and staff
requests authorization to reimburse the additional $66,326.82. The developer
has paid to the City a total of $165,029.86 in AIPP fees for this project, and the
balance will remain in the AIPP fund.

G. REQUEST FOR APPROVAL OF DESIGN PROPOSAL FOR THE ART IN
PUBLIC PLACES COMPONENT FOR VILLAGE AT UNIVERSITY PARK
PROJECT, 36-891 COOK STREET (The Evans Company, Applicant).
w�s Councilmember Benson shared that the art piece was presented to the Art
In Public Places Commission twice and was well received by all.
In response to comment about the proposal's similarity to The Gardens'
public art piece, it was noted that this piece was more dense and compact
than the one at The Gardens.
Councilman Spiegel moved to, by Minute Motion: 1) Approve the design proposal
"Ground Swell" by Phillip K. Smith, III, for the Village at University Park Project;
2) appropriate$70,000 from Account No. 436-0000-312-2700 forfuture reimbursement as
part of the Art In Public Places Component Fee. Motion was seconded by Kelly and
carried by a 4-0 vote.
H. REQUEST FOR APPROVAL OF THE COMMISSIONING OF A RECYCLED
ART PROJECT USING RECYCLED MATERIALS (CONTRACT
NO. C25690).
Councilman Spiegel moved to, by Minute Motion, approve the commissioning of
John Branstetter in the amount of$15,000 to create a recycled art project using recycled
materials — funds are available in Account Nos. 436-4650-454-4001 and
236-4195-454-3090. Motion was seconded by Kelly and carried by a 4-0 vote.
I. REQUEST FOR AUTHORIZATION TO REJECT NON-RESPONSIVE BID
AND APPROVE ANNUAL PURCHASE OF GRASS SEED.
Mayor Pro Tem Kelly moved to, by Minute Motion: 1) Reject the bid received from
Imperial Sprinkler Company, Anaheim, California, as non-responsive; 2) authorize the
purchase of 316,800 pounds of grass seed from Simplot Partners, Palm Desert, California,
in the amount of $290,087.25 (includes sales tax, shipping, and handling) — funds are
available in Account Nos. 110-4610-453-2190, 110-4614-453-3370, and
110-4611-453-3371 for the City's portion; Desert Willow to fund the balance. Motion was
seconded by Spiegel and carried by 4-0 vote.

Recommendation:
By Minute Motion: 1) Approve the design proposal "Ground Swell° by Philiip K.
Smith, I11, for the vllage at University Park project, located at 3fi-891 Cook St.,
Palm Desert, Califomia; 2) appropriate $70,000 from Account No. 436-0000-312-
2700 for future reimbursement, as part of the Art in Public Places art component
fee.
Executive Summary:
At its meeting of July 19, 2006, the Art in Public Places Commission approved
the proposed design by artist Phillip K Smith, III, as the art component for the
Village at University Park project.
The artwork consists of two basalt fountains located along the axis between two
retail buildings at the comer of Gerald Ford Drive and Cook Street. The piece
located closest to both streets is the largest sculpture of approximately 14' in
diameter, ranging from 3' to 11' in height and will function as the gateway piece
to the development. The second sculpture wiil function as the focus of fhe plaza
area of the development. Half of the basatt columns will be drilled for water to
flow slowly out of the top of the columns. Several of the tops of the columns will
be drilted for uplights to emphasize the tridcle of water at night. Baja Cresta
cobble ranging in size from 4„ to 8" will cover the bases of the fountains so the
basalt columns will appear to be rising up from the stones.

Discussion:
Mr. Smith is a well-known artist, designer, and architect in the Coachella Valley,
who recently was selected to exhibit some of his artwork in a group exhibition in
New York City. An example of his architectu�e can be seen on Highway 74 with
the new addition to the Presbyterian Church.
