Discussion: Parcel Map No. 35741 is located at the southwest corner of Gerald Ford Drive and Cook Street in University Village. The map provides for the subdivision of one 5.3-acre commercial parcel into two parcels for the purpose of conveyance and financing. An existing building is located on each of the two new parcels for retail use, including parking. The tentative map was approved by the Planning Commission on January 15, 2008 and will expire in January 2010. Reciprocal easements between the two new parcels are provided for ingress and egress, parking, trash facilities and drainage, as well as to perpetuate the aforementioned easements between this map and all adjacent and adjoining parcels of the underlying map (Parcel Map 31515). Those conditions of approval related to the map have been satisfied. This map conforms to the requirements of the Subdivision Map Act and City ordinance and it is substantially the same as it appeared on the tentative map. BE IT HEREBY RESOLVED, by the City Council of Palm Desert, California, as follows: (1) The Map of Parcel Map No. 35741 of the City of Palm Desert, California, is hereby approved as the official map of said parcel map, subject to the conditions of the Tentative Map. (2) The City Engineer is directed to process the Parcel Map for recording upon receipt of payment of all fees. Construction of a portion of said project shall commence within �nro years from the date of final approval unless an extension of time is granted; otherwise said parcel map approval shall become null, void and of no effect whatsoever. Construction documents must be submitfed for review and approval with the Department of Building and Safety and permits must be issued within 18d days from the date of the building permit applicafion, December 27, 2007. 3. The existing archway sign connecting Buildings 2A and 2B shall be the only . above ground improvement connecting these two buildings. No other archways or other improvements which cross over the property line dividing Parcel 1 and 2 of Parcel Map 35741, nor any replacement of or modifications to the archway sign are permitted without the prior approval of the Planning and Buifding and Safety Departments. Prior to recardation of the parcel map, applicant shaH record a reciprocal maintenance agreement, in form acceptable to the City Attorney that requires both parcels to cooperate in the maintenance of the archway sign 4. The development of the property described herein shall be subject to the restrictions and limitations set forth herein, which are in addition to alf municipa! ordinances and state and federal statutes now in force, or which hereafter may be in force. 5. Where multiple buildings are concerned the utilities, water meters and sewers must be located on the property of the building served, unless an easement is recarded (i.e. sewer laterais, must not be located on an adjacent property). Department of Public Works: 1. Complete parcel map shall be submitted as required by ordinance to the Director of Public Works for checking and approval prior to issuance of any permits. 2. A1f underfying canditions from subject precise plans shall apply to parcel map. 3. The map shall record a reciprocal easement for parking, access, drainage, and use of trash enclosure as applicable. Fire Department: 1. With respect to the conditions of approval regarding the above referenced project, the fire department recvmmends the following fire protection measures be provided in accordance with City Municipal Code, NFPA, CFC, and CBC or any recognized Fire Protection Standards: The Fire Department is required to set a minimum #ire fEow for the remodel or construction of all buildings per UFC article 87. 2. Water Plans must be approved by the Fire Marshal and include verification that the water system wiN produce the required fire flow prior to obtaining building permits. 4 PLANNING COMMISSION RESOLUTION NO. 2264 �. CONDITIONS OF APPROVAL CASE NO. TPM 31515 Dgpartmen�of Community Devefopment: 1. The development of the property shall conform substantialiy with exhibits on file with the Department of Community Development, as modified by the following conditions. 2. Recordation of the map shall occur within two years of the date of this approval unless an extension of time is granted; othervvise, said approva! shall become null, void and of no effect whatsoever. 3. The deve{opment of the property described herein shall be subject to restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. � 4. Development of lots contained within the subject map shall be subject to the provisions of PP 03-11. 5. That this tentative parcel map shall not record until TPM 31730 has recorded. Department of Public Warks 1. Any drainage facility construction required for this project shall be contingent upon a drainage study prepared by a registered civil engineerthat is reviewed and approved by the Department of Pubfic Works prior ta siart of corrstruction. The project shall be designed to retain storm waters associated with the increase in developed vs. undeveloped condition for a 100 year storm. 2. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17 and 79- 55, shall be paid prior to issuance of any permits associated with this project. Modification of existing signals at Gerald Ford and Technology Drive, and at Cook and Berger Circle West, may be used as credit against these fees, at the discretion of the City Council. 3. The project shall be subject to 7ransportation Uniform Mitigation Fees (TUMF). Payment of said fees shall be at the time of building permit issuance. � 3 PLANNING COMMISSION RESOLUTION NO. 2264 � 4. A complete preliminary soils investigation, conducted by a registered soils engineer, shall � be submitted to, and approved by, the Department of Public Works prior to the issuance of a g�ading permit. 5. All public and private improvements shall be inspected by the Department of Public Warks and a standard inspection fee shall be paid prior to issuance of grading permits. fi_ Any and all offsite improvements shall be preceded by the approval af plans and the issuance of valid encroachment permits by the Depart►rtent of Public Works. 7. As required under Palm Desert Municipal Code Section 26.28, and in accordance with Sections 26.40 and 26.44, complete improvement plans and specifcations shall be submitted to the Director of Public Works for checking and approval before construction of any improvements is commenced. Offsite improvement plans to be approved by the Public Warks Department and a surety posted to guarantee the installation of required offsite improvements prior to permit issuance. 8. Landscape instaliation on the property frontages as well as on-site shall be drought tolerant in nature and maintenance shall be provided by the property owner. 9. App(icant shall comply with the provisions of Municipai Code Section 24.12, Fugitive Dust � Control and Section 24.20, Stormwater Management and Discharge Control. � 10. In accordance with Palm Desert Municipal Cade Section 26.44, complete grading plans/site improvement plans and specifications shall be submitted to the Director of Public Warks for checking and approval prior to issuance of any permits. Preliminary landscape plans shall be submitted ior review concurrently with grading plans. 11. Proposed building pad elevations are subject to review and modification in accordance with Chapter 27 of the Palm Desert Municipal Code. 12. Full public improvements, as required by Sections 26.40 and 26.44 of the Palm Oesert Municipa! This project sha11 be Eimited to one driveway on Gerafd Ford Orive and one drrveway on Cook Str�ef,with right tum ing�ess and egress. The Cook Street driveway may a/so be `r provided with left tum ingress subjecf to frnal design and approval by fhe Cify Engineer. The Gerald Ford Drrve driveway may also be provided with left turn ingress subject fo final design and approval by the City Engineer. Two ful! access driveways may be permitfed on Spine Road. Driveways and parking lots shall be inspected by the Public Works Department and a standard inspection fee paid prior to the issuance of a grading permit. 14. Propased Berger Drive shall match the width of Berger Drive to the east. Proposed Wonder Palms Drive shall be constructed to a width of 52'on 76' right of way to match Technology Drive to the north. Spine Road shall be consfructed fo a half sfreef widfh of 26' on 38' right of way minimum, with a 12'raised, landscaped median island. Spine Road shall be widened fo provide a minimum of four fraffrc lanes at key rnfersecfions, as determined by fhe City Engineer. Inferrm street widths shall conform fo the approved rough grading plan. 15. Parcel Map shaU be required to erase existing properiy lines, establish new properfy lines and make dedications for future street widening. 16.
