HomeMy WebLinkAboutWaiver of PDMC Provisions - 2008 Fashion WeekO CITY OF PALM DESERT COMMUNITY SERVICES DEPARTMENT STAFF REPORT REQUEST: WAIVER OF MUNICIPAL CODE PROVISIONS IN CONJUNCTION WITH 2008 FASHION WEEK DATE: February 28, 2008 CONTENTS: Letter of Request from Palm Springs Life RECOMMENDATION: By Minute Motion, waive the 9 p.m. regulation on amplified sound and permit the sales of merchandise on City owned property in connection with 2008 Fashion Week. EXECUTIVE SUMMARY: Each year Paim Springs Life produces Fashion Week on El Paseo and approval of this request will allow the implementation and production of attendant activities. BACKGROUND: Each year Palm Springs Life hosts Fashion Week, which is scheduled to be held in 2008 from March 23-30. This event consists of in-store activities, merchandise promotions, fashion shows, hosted receptions, etc. In connection with the production of this event, a tent will be constructed on the City owned property located on Larkspur Avenue between El Paseo and Shadow Mountain Drive. On Sunday, March 30, 2008, from 11 a.m. to 2 p.m., vendors will be invited to sell accessories in the tent constructed on City owned property at an event entitled, "Give Back to Fashion." Profits of these sales will benefit the vendor; however, a table rental fee will be donated to "Fashion Group International" a non-profit organization. In addition, on Monday, March 24, Wednesday, March 26, Thursday, March 27, and Friday, March 28, specific events will be held in the tent located on City owned property, which include amplified sound. Each of these events will conclude by 10 p.m. and the sound will be limited to inside the tent area. Since City ordinance requires that amplified sound cease by 9 p.m., a waiver of this provision is requested. Event organizers have been most cooperative in complying with all aspects of the Municipal Code as it affects this event and have requested a waiver to ensure the successful production and promotion of this event. Monday, March 24, 2008 — Music for Pacifica Runway Bar will conclude by 10 PM. Wednesday. March 26, 2008 — Sound and music for PSWFT Hollywood Fashion Show will conclude by IOPM. Thursday. March, 27, 2008- Sound and music for Tommy Bahama's "Under the Santorini Sky" will conclude by 10PM. Friday, March 28, 2008 — Sound and music for Fashion Group International® Fashion Week Gala will conclude by 10 PM. All other events should conclude by 9 PM. There will not be street signs as previously discussed. We will not need variances for signage or display of anything outside of stores as we will not be providing them for this event. Also, on Sunday, March 30th at "Give back to Fashion" from 11AM until 2PM vendors will be selling accessories at this event and they will be collecting sales tax with their sales. Profits will go directly to the vendor. They will be donating a table rental fee to Fashion Group International® to participate in this event.
