The City Council, by Minute Motion:
1. Approve Change Order No. 4 to Contract No. C25570A with
Skanska Civil USA West for the construction of Section 29
Assessment District 2004-02 in the amount of $59,020.03;
2. Move $59,020.03 from contingency to base; and
3. Authorize the Mayor to execute the same.
Discussion:
On April 26, 2007, City Council awarded the construction contract for the infrastructure
of Assessment District 2004-02 (Section 29) to Yeager-Skanska, Inc., in the amount of
$14,470,270.58. Construction on Assessment District 2004-02 has been underway
since July 25, 2007 and progress has been exceptional.
On July 12, 2007, Change Order No. 1 in the amount of $97,076.80 was approved. The
change was necessary to meet technical requirements of the geo-grid material to be
used on the project.
Contract Change Order No. 2 was approved on September 13, 2007 in the amount of
$88,324.86. This item included modifications to both the storm drain system and water
line design.
Due to a change in conditions encountered during construction and the addition of water
line phasing elements not provided for in the initial project plans it was necessary to
bring Contract Change Order No. 3 to the Council for approval on October 25, 2007, in
the amount of $97,496.60.

Construction Change Order No. 4 consists of a number of different items involving
changes in field conditions, design corrections and material substitutions.
A recap of the items follows:

Funds are available for these changes in the project account 469-4350-433-4001.
Although construction progress on the project has been excellent we are experiencing
some compliance issues with respect to rubberized asphalt. The issues are nearing
resolution and with the existing Southern California Edison transmission pole
relocations finally complete, steady progress can now resume on the project.
Therefore, staff recommends that City Council approve Change Order No. 4 to Contract
No. C25570A with Skanska Civil USA West (formerly Yeager-Skanska Inc., in the
amount of $59,020.03; move $59,020.03 from contingency to base and authorize the
Mayor to execute the same.

This Change Order covers changes to the subject contract as described herein. The Contractor shall construct, furnish
equipment and materials, and perform all work as necessary or required to complete the Change Order items for a
lump sum price agreed upon between the Contractor and the City of Palm Desert, otherwise referred to as Owner.

The undersigned Contractor approves the foregoing Change Order # 4 as to the changes, if any, in the contract price
specified for each item including any and all supervision costs and other miscellaneous costs relating to the change in
work, and as to the extension of time allowed, if any, for completion of the entire work on account of said Change
Order # 4. The Contractor agrees to furnish all labor and materials and perform all other necessary work, inclusive of
that directly or indirectly related to the approved time extension, required to complete the Change Order items. This
document will become a supplement of the contract and all provisions will apply hereto. It is understood that the
Change Order shall be effective when approved by the Owner.
Execution of this Change Order by the Contractor constitutes a binding accord and satisfaction that fully satisfies,
waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity, arising out of
or related to the subject of the Change Order, whether known or unknown, including but not limited to direct and
indirect costs and/or damages for delay, disruption, acceleration, loss of productivity, and stacking of trades, as well as
any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.
