HomeMy WebLinkAboutC27880 MOU 211 Information & Referral SvcsX I CITY OF PALM DESERT Community Services Division Staff Report REQUEST: REQUEST FOR APPROVAL OF MEMORANDUM OF UNDERSTANDING BETWEEN THE VOLUNTEER CENTER OF RIVERSIDE COUNTY AND THE CITY OF PALM DESERT AS IT RELATES TO PARTICIPATION IN THE 2-1-1 RIVERSIDE COUNTY PROGRAM SUBMITTED BY: Patricia Scully, CFEE, Senior Management Analyst DATE: July 10, 2008 CONTENTS: Memorandum of Understanding RECOMMENDATION: By Minute Motion: 1) Authorize the Mayor to execute a Memorandum of Understanding between the Volunteer Center of Riverside County and the City of Palm Desert as it relates to participation in the 2-1-1 Riverside County Program (Contract No. C27880 ); 2) appropriate $6,467.76 from the unobligated General Fund to Account No. 110-4159-415-3090. EXECUTIVE SUMMARY: The City of Palm Desert is an active participant in the 2-1-1 Riverside County Program, and this agreement will allow the City's continued participation for the 2008/2009 Fiscal Year. BACKGROUND: On January 13, 2005, the Palm Desert City Council approved a Memorandum of Understanding with the Volunteer Center of Riverside County (VCRC) for the City's participation in the 2-1-1 Riverside County Program. This program is a referral service for residents of Riverside County, which enables callers to receive information about available programs and services throughout the County. This program will provide a venue for Palm Desert residents and visitors to receive information and referral services to callers via an 800 number or 2-1-1. These services include a 24-hour response to inquiries about local human services with contracting agencies via trained staff who have the experience and ability to provide such services , which include basic human needs resources, including food, clothing, and shelter, physical and mental health resources; drug and alcohol intervention and rehabilitation; employment support including job training and transportation assistance; support for senior citizens and people with disabilities; support for children, youth, and families; child care services; legal help; hospice care; summer camps and recreation programs; and protective services. Therefore, staff recommends that the City Council authorize the Mayor to execute the subject Memorandum of Understanding and authorize payment of the Fiscal Year 2008/2009 invoice in the amount of $6,467.76 from the unobligated General Fund. Since July 1, 2005,VCRC increased service hours from 55 hours per week to 168 hours per week. Every call, at any hour, is connected with a trained Information&Referral SpecialisL Endorsements from the Riverside County Board of Supervisors, United Way,Coachella Valley Association of Govemments, Westem Riverside Counal of Governments,Community Action Partnership, Bank of America and Majestic Realty Foundation have helped to develop 2-1-1 as a responsive,vital service. All of the cities of Riverside County are asked to partner in providing this valuable service at the rate of.13 cents per resident. VCRC's RESPONSIBILITIES A. Coordinate with all telephone providers to route 211 calls to VCRC. B. Provide all equipment necessary for the performanc�e of this agreement and shall be responsible for the maintenance of said equipment. C. Maintain an up-to-date database of community heaith and human services for Riverside County. D. Employ trained Information and RefeRal Specialists to take calls from the public in search of services and refer callers to appropriate agencies to meet their needs. E. Coordinate collaborative efforts to help communities build capacities for meeting the health and human service needs of the public. F. Identify gaps in services and infom� funders and senrice providers about those gaps. G. Educate the public about available services. H. Work with the City officials to establish a prot000l for non-emergency information and referral during disasters. I. Provide annual service reports of information and referral requests from zip codes within the City limits. II. THE CITY's RESPONSIBILITIES : A. Serve as the primary focal point in the community for oonnecting people with City department information and referral. B. Refer callers to appropriate agencies and services to meet their needs, including 2-1-1 Riverside County, a program of VCRC. C. Solicit input f�om the popufation served to help shape services, design programs, and evaluate the impad of services on the community and provide the solicited information to VCRC. D. To produce a public service announcement video for the Cities' local community cabte channel. 1 ' Contract No. C27880 III. MUTUAL RESPONSIBILITIES A. The City and VCRC will work together to develop appropriate relationships, and make every effort not to duplicate efforts. B. The City and VCRC will make every ef�ort not to approach funders to duplicate programs that may be provided by partnering agencies. C. The City and VCRC will strive to educate the community about our individual roles and missions, and will work to mutually promote our roles. D. The City and VCRC agree to communicate regularly and nurture our collaboration, and will ensure that partner networks are included in the development of appropriate community initiatives. E. The City and VCRC will work together to develop an effective community plan for sharing information in local disasters. F. The City and VCRC will work together Gosely and build upon the activities of each. This may involve numerous vehicles such as: 1. Links to connect respective web sites. 2. Participation with 211 Steering Committee meetings. IV. FISCAL PROVISIONS A. The City agrees to pay VCRC an annual amourrt of$6,467.76 (49,752 (population) .13¢)for the services to be performed hereunder. B. The City agrees to pay annually, unless some oit�er method of payment is mutually agreed to in writing. C. VCRC agrees to submit annual invoices to the City. V. INDEPENDENT CONTRACTOR In the perFormance of the obligations under this agreement, it is understood and agreed that VCRC is at all times acting and perfoRning services as an independent contractor, and the City shall exercise no control or direcdon over the manner and means by which VCRC performs its obligations under this contract, except as herein stated. VCRC will report to a contract administrator appointed by the City. All persons employed by or volunteering for VCRC in the performance of VCRC's services and functions shall be considered employees, volunteers, and agents of VCRC. No person employed or volunteering for VCRC shall be entitled to a City pension, civil service, or any status or right, nor shall he or she be deemed to be a City employee as a result of this Agreement. Additionally, all persons employed by or volunteering for VCRC shall not represent themselves to be affiliated with the City. V!. lNDEMNIFICATION VCRC promises and agrees to defend, protect, indemnify, and save haRnless the City, its officers, agents, and employees, from and against any, and all Gaims, demands, and liability for damages for personal injury or property damage suffered by reason of any aci or omission of VCRC, or VCRC's employees, volurrteers, agents, or contractors, or by reason of any dangerous or defective condition caused or permitted by VCRC or VCRC's employees, vo{unteers, agents, or contractors. The City promises and agrees to defend, indemnify, and save haRnless VCRC, its officers, employees, and volunteers from all Gaims, demands, and liability for damages for personal injury or property damage suffered by reason of any act or omission of the City or the City's o�cers or employees, or by reason of any dangerous or defective condition caused or permitted by the City of the City's offrcers or employees, except where such action, omission, or condition is caused by or is the result of an action, omission, or request of VCRC or VCRC's officers, employees, or volunteers or is alleged to arise out of the execution of this Agreement_ VII. INSURANCE 2 Contract No. C2788Q ' A. VCRC shall secure and maintain throughout the contract period and any extensions thereof, professional liability insurance, public liability insurance, , property damage, and vehiGe tiability insurance effective as of the effective date of this Agreement, and shall be protected from claims for damages for personal injury, including accidental death, as well as from Gaims for property damage which may arise from operations from this Agreement. Said insurance shall be maintained in fu�l force and effect during the term of ihe Agreement or renewals or e�ensions thereof. Such a policy shall be for not less than $1,000,000, for injuries, including accidental death, to anyone person and, subject to the same limit for each person, in an amount not less than $1,000,000 on account for any one occuRence, and $1,000,000 for property damage, and shall be placed with a company authorized to conduct business in the State of Califomia. The City shall be named as an additional insured on all policies and/or certificates of insurance. Copies of all policies or certiflcates s(iall provide for thirty (30) days written notice to the City prior to any reduction in coverage or canoellation. Such insurance coverage shall be primary and shall not require any contribution by the City or by the City's insurance carriers. The amass of such insurance shall not be deemed a limitation of VCRC's agreement to save and hold harmless and if the City beoomes liable for an amount in excess of the insurance, VCRC will save and hold the City harmless from the whoie thereof. B. VCRC shall secure and maintain throughout the term of this Agreement, Workers' Compensation insurance as prescribed by the laws of the State of Califomia. A certificate evidencing such coverage shall be filed with the City Manager's Office. Said cert�cate shall provide that the City will be given at least thirty (30) days written notice prior to canoellation. VIII. TERM This MOU shalt be in effect from July 1, 2008 through June 30, 2009, but may be terminated earlier in accordance with Section IX. IX. EARLY TERMINATION A. For Cause. If either party fails to perform any duties or obligations imposed on it by this Agr�eement and such failure corrtinues for thirty (30) days after written notification by one party to the other, then this Agreement will be in breach and the party providing such nofice may terminate this Agreement immediately thereafter. B. Without Cause. Either party at any time may terminate this Agreement without cause upon giving of thirty (30) days prior written notice to the other of such intent io terminate at the address set out in Sedion of tt�is Agneement. C. Reimbursement of Compensation. If this Agreement is terminated prior to the end of the terrn set forth in Section,VCRC shall be compensated on a pro rata basis. X. NOTICES Notices shall be deemed given under this MOU when in writing and personally delivered or placed in the U.S. Mail, first Gass, postage prepaid, addressed as follows: City: Carlos L. This MOU constitutes tt�e entire ag�ement between the parties_ No waiver of any term or condition of tfiis Agreement shall be deemed a o�ntinuing waiver hereof. This Agreement is binding upon VCRC and their successors and assignees. F�ccept as othervvise provided herein, VCRC shall not assign, sublet, or transfer its interest in this Agreement or any part thereof without the prior written consent of the City. Any such assignment shall, at the option of the City, immediately void this Agreement. B. Any altemations, variations, modifications, or waivers of provisions of the MOU, untess specifically allowed in the MOU, shaN be vaiid oniy when they have been reduced to writing, duly signed and approved by the Authorized Representatives of both parties as an amendment to this MOU. No oral understanding or agreement not incorporated herein shall be binding on any of the Parties hereto. XII GONCLUSION A. This MOU, consisting of four pages, is the full and complete document describing services to be rendered by VCRC and the City including a!I vovenants, conditions, and benefits. B. The signatures of the Parties affixed to this MOU affirm that they are duly authorized to commit and bind their respective agencies to the terms and conditions set forth in this document.
