ORAL COMMUNICATIONS None IV. RESOLUTION A. RESOLUTION NO. 08-44 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A REQUEST TO AMEND THE EXISTING CONDITIONAL USE PERMIT TO ELIMINATE NIGHTLY AMPLIFIED MUSIC IN THE OUTDOOR DINNING PATIO AREA OF AUGUSTA RESTAURANT LOCATED AT 73-995 EL PASEO DRIVE. Case No. CUP 96-15 Amendment No. 3 (Modified), (Denise Roberge, Augusta Restaurant, Appellant). Mr. Erwin stated this item was specifically about eliminating amplified music at Augusta Restaurant, and unless there was someone present to speak on this particular item, the City Council could go ahead and take action. No testimony was offered. Mayor Pro Tem Spiegel moved to waive further reading and adopt Resolution No. 08-44. Motion was seconded by Finerty and carried by a 4-1 vote, with Ferguson voting NO. V. ADJOURNMENT Upon a motion by Spiegel, second by Ferguson, and 5-0 vote of the City Council, Mayor Benson adjourned the meeting at 3:59 p.m. ATTEST: GRACE L.
