e. Rlsk of loss:Owner is solely responsible for safeguarding mater'rals,and the risk af bss sheM be
trar�sferred to, and bome sotely by Owner,upon delivery of materials to projec,�. Owner bears ihe
risk of the Project beinp destroyed or damaged by an aCcident,disaster, calamity,or act of Ciod
(irx�uding but not limited to frre,storm,flood,landslide,subsidence,ar earthquake�o�by ihsft or
va�r�daliam. Conlrador ahall not be requirod to robuild vr restore the Projxt except upon peyn�e�t
therefore by Owner er�dlor an insurer.
f. Warranty:
i. Contractor WarraMy-excapt as otherwise set forth herein,the CoMracc:tar shaH provide the
werranty set torth in Adderxium C.
ii. The above-descr�ed wsrrarrties do not extend to. and exclude remedy for,darnage or
defect caused by abuse, modifications not exewted by the Contracxar, improper or
insu[ficient maintenanoe, imprriper opera6on,or normal wear and tear under normel usage.
iii. DISCU4p1AER OF WARRf�NT1ES:THE�7(PRESS WARRANTIES PROVIDED HERE�N
TAKE THE PLACE OF,AND SUPERSEDE,ALL OTHER WARRANTIES, EXPRESS OR

Owner and Contrector arfsing out of this Contred, indudirtg erbitration or trtal,the prevailing party

fumished for uae solely with respect to this project. Such documents may not be used on olher
projec.�ts or for addtions to this project witlio��t Contractor's express wrilten authorization. Neither
Owner nor any ofher person shalf awn or claim a copyright or othe�proprietary interest in auch
docur�er�ts. UMOas otherwise indicated, ConV�ctor shaq be deemed to be author of them and will
retein ati oommon law, stahAory, and other reserved rights, in addition to oopyright.
n. Succesaors and asatpns:This Contra�t is binding on the sucoessors,assigns, and leflal
representatives of Contnac�or and Owr�er.
o. Professional credlt: Conirador may r8ferenoe Owner and uss pidures of the inatalta�on end the
Project in marketing pudicationa.trade pubtlaations,press, or any other media.
p. Walvsr:The waiver by Contrada of any right or obligetion under Mis Contraci sttiall not
cc�rrfstitute a waiver of any ather right or obligation.
q. S�verability:If any provision of this A�reement is held to be unentoroeable for any reason, it will
be adJusled rather than voided, if poss(bls,to achieve the infent of the ps�ties to the extent
possible. 1n any ever�t, e�other provisions of this Agreement will be dserned valid end
�torceat�le to tAe extent possible.
r. Entine a�reement:The paRies'agrsemer►i consists af this Contr�d and all Addenda referenced
