STAFF REPORT
TO: Honorable Mayor and City Council
REQUEST: COUNCIL DIRECTION CONCERNING AN ORDINANCE OF THE
CITY OF PALM DESERT, CALIFORNIA, PROVIDING FOR THE
IDENTIFICATION, DESIGNATION, PROTECTION, AND
ENHANCEMENT OF THE CITY'S CULTURAL RESOURCES.

Recommendation:
That the City Council provide direction regarding preparation of a Cultural
Resources Ordinance for the City of Palm Desert.
Background:
On March 13, 2008 the City Council directed staff to appoint a subcommittee
comprising two Council representatives, two Committee members, two real
estate agents, two city residents, the City Attorney, and appropriate staff to work
through the remaining issues relative to a cultural resources ordinance, and to
return to Council with a recommendation.
The subcommittee met on May 12, 2008 and the following three (3) items
needing clarification or direction from the City Council were identified:
1. Is a property owner's approval required prior to the City's
certification of a survey? Please refer to the following proposed
definitions of "Certified Survey".

2. Does the City Council wish to pursue attaining "Certified Local
Government" (CLG) status as outlined in the General Plan?
3. Does the City Council want to authorize the Historic Preservation
Committee to work on the top ten properties as delineated on a list
developed by Riverside County Historic Resources Committee dated
August 4, 1981.
There still remain differences between the recommendation of staff and those of
the Committee that have not been resolved. These differences are seen as being
secondary to the three broader issues discussed above, and will be tackled by
the Subcommittee once Council direction is received in the subject areas. These
secondary issues are:
• The Board be named a Commission versus Committee;
o If Council wishes to have the City of Palm Desert acquire "Certified Local
Government" (CLG) then having a body named Commission is one of the
necessary requirements.
• Members not be required to be a resident of the city;
o Per PDMC section 2.34.010(A) Council is authorized to appoint a member to
the Committee that is not a resident if specific expertise is needed.
• Definitions; e.g. Administrator, Alteration, Certified Local Government
etc...
o Definitions vary between jurisdictions throughout the State and differ to
address specific local needs.

• The frequency of meetings be increased;
o The Committee wants the authority to establish times, dates and frequency of
meetings, whether there are any projects or agenda items to discuss.
• Duties and authority of Administrator and Committee be revised to give the
Committee greater authority;
o The Committee does not like the revised section of the ordinance that limits
their job duties and authority and shifts some of those duties and authority to
the Administrator.
• Certificate of Appropriateness (remains), Administrative Certificate of
Appropriateness process(deleted)
o The Administrative Certificate of Appropriateness process was eliminated to
ensure that all projects garner approvals from the City Council and not
administratively so Council would have knowledge of all projects due to the
sensitive nature in dealing with property owners rights.
