HomeMy WebLinkAboutAppropriate Funds - HHW Facility by BurrtecCITY OF PALM DESERT SPECIAL PROGRAMS DEPARTMENT STAFF REPORT REQUEST: APPROPRIATE FUNDS IN THE AMOUNT OF $150,000 FOR THE CONTINUED OPERATION OF THE HOUSEHOLD HAZARDOUS WASTE FACILITY BY BURRTEC WASTE & RECYCLING SERVICES SUBMITTED BY: Frankie Riddle, Director of Special Programs DATE: June 26, 2008 CONTENT: Copy of Solid Waste Contract Page No. 30 RECOMMENDATION: By Minute Motion, approve appropriation of funds in the amount of $150,000 from Account No. 236-4195-454-3090 (Recycling Funds) for the continued operation of the Household Hazardous Waste (HHW) Facility operated by Burrtec Waste & Recycling Services. DISCUSSION: In 2000, the City opened its permanent HHW Facility, which is operated by the City's contracted solid waste hauler, Burrtec Waste & Recycling Services. Since that time, the City has utilized grant funds to pay for the continued operational costs of the facility; however, those grant funds were recently expended. Although staff is currently in the process of preparing a grant application for the California Integrated Waste Management Board's Household Hazardous Waste Discretionary Grant, which would provide funds for continued operation of the facility, this is a competitive grant process. The City has previously received funding three times. Per the City's Contract with Burrtec, both agencies must pay for the continued operation of the HHW Facility at a 50/50 split up to $50,000 (over grant funds), after which the City and Burrtec are required to negotiate a funding arrangement to keep the facility open. As both agencies have reached the $50,000 limit, and the City must continue to reimburse Burrtec for the operation of the Facility, staff is requesting that additional operation costs be appropriated from Recycling Funds. Staff will be addressing the HHW facility and operations as part of the contract negotiations. In the event that grant monies are insufficient to offset the direct out-of-pocket costs of hiring a subcontractor to operate the HHW Facility, City and Company agree to share the unfunded cost of operating the HHW Facility for Palm Desert customers on an equal basis, with the City and Company contributing up to $25,000 each annually, to be adjusted annually after the second Rate Year for changes in the PPI in accordance with Section 6.4. If the actual amount required to operate the HHW Facility exceeds the grant funds plus the combined $50,000 contributed by the City and the Company (or the adjusted amount in subsequent years), City and Company agree to negotiate in good faith a funding arrangement to keep the facility open as contemplated in Section 4.7.12(A). C. Annual Statement of Cost - The Company shall submit an annual statement to the City by February 28th of each year for operations during the previous calendar year. This report shall include the detailed costs and operating statistics (e.g. number of Customers and quantities by waste type) for the HHW Facility during the previous calendar year. Costs shall be broken down by jurisdiction so that costs attributable to the City's use of the Facility shall be segregated. Any grant funds received by the Company in excess of the cost of operations attributable to City Customers shall be either returned to the City or applied against the future costs of HHW Facility operations, as directed by the City. D.
