Recommendation:
By Minute Motion: 1.) By four-fifths vote find that roadbed repair on Fred Waring Drive is an
urgent health and public safety matter and that an emergency exists; 2.) Waive the bidding
requirements of the City purchasing policies and procedures; and 3.) Authorize the City
Manager to issue a purchase order in the amount of$52,514.00 to Kemp � Kemp Senrices
for emergency repair of the roadbed on Fred Waring Drive between Adonis Drive and San
Luis Drive.
Discussion:
Public Works Department crews recently found that the pavement on Fred Waring Drive beiween
Adonis Drive and San Luis Drive was failing. Crews removed a small area of the pavement and
found that the soil in this area is saturated with water and is in need of immediate replacement to
prevent further damage. The scope of this work is beyond the abilities of the City's equipment;
therefore, staff requested quotes from four contractors to replace the soil, base material, and paving
in an area of 4,774 square feet. The quotes are as follows:
Kemp 8 Kemp Services,Thousand Palms $52,514.00
Granite Canstruction, tndio $54,875.30
Dateland Construction, Coachella $84,523.00
Hazard Construction, San Diego $103,320.00
It is recommended that this repair be considered an urgent matter and that the City Manager be
authorized to pro with repairs immediately.

Upon a motion by Spiegel, second by Finerty, and 5-0 vote of the City Council,
the following action item was added to the agenda.
Request for Authorization to Perform Emergency Repair of Roadbed on
Fred Waring Drive.
Mr. Ortega called attention to Mr. Greenwood's red-cover report that had
been distributed to the City Council before today's meeting, indicating that
some emergency repairs were necessary on Fred Waring Drive. Four
bids were obtained for the repairs, and City Council was being asked to
award the project to the lowest bidder.
Mayor Pro Tem Spiegel moved to, by Minute Motion: 1) By four-fifths vote of the
City Council find that roadbed repair on Fred Waring Drive is an urgent health and
public safety matter and that an emergency exists; 2) waive the bidding requirements of
the City's Purchasing Policies and Procedures; 3) authorize the City Manager to issue a
purchase order in the amount of $52,514 to Kemp & Kemp Services, Thousand Palms,
California, for emergency repair of the roadbed on Fred Waring Drive befinreen Adonis
Drive and San Luis Drive. Motion was seconded by Finerty and carried by a 5-0 vote.

i. This Contract is subject to Hazard's approval of Buyer's credit ability afterreturn of the executed Contract to Hazard.
2. On the t�venty-fifth day of each month,Hazard shall bill for all work then performed and said bilting shall be due and
payable in full on die tenth day of the following month, unless otherwise provided herein.
3. Any amount not paid when due shall bear interest at the maximum rate ailowed by law.
4. This Contract may not be assigned or otherwise transfened by Buyer without Hazard's prior, written consent.
5. Should Buyer fait to make any payment to Hazard when due,this Contract shall be deemed breached and Hazard's
further performance hereunder shall be executed.
6. T-Iazard shall not be liable for any damage resulting from cielays caused by acts of God, weatt�er, strikes, lockouts,
unavailability of labar,equipment or materials,act of others or any other cause beyond Hazard's control.
7. Buyer agrees to pay upon demand therefore,all attorney's fees incurred by Hazard in enforcing its rights hereunder.
8. For one year after completion of this Contract Hazard agrees to correct any defective work performed by it. If Hazard
fails to repair such defective work within a reasonable time after receipt of written notice from Buyer describing the
defective work,Hazard's tiability to Buyer shall be limited to the reasonable cost of repairiag the defective work.
Defective work will he considered to be work which fails due to faulty materials or workrnanship.
9. Shauld Hazard encounter unvsual subsurface conditions which are not reasonably discernable from a visual
inspection of the job site as of the date of this Contract,Hazard shall be entitled to extra compensation for the cost of
all additional work required as the result of said conditions plus fifteen percent of said cost for overhead and profit.
10. Th'rs Contract supersedes all prior bids, negotiations and agreements between Hazard and Buyer and contains the
entire agreement between parties.
11. This proposat excludes the handiing,processing or disposa3 of all material that may be categorized as"Hazardous".
12. tinless otherwise specificaliy incIuded in this proposal,preparation and campaction of subgrade is Iimited to the top
6" of material directly below the lowest lift of base or paving.
