REQUEST: AUTHORIZE STAFF TO NEGOTIATE A NEW FRANCHISE
AGREEMENT WITH BURRTEC WASTE AND RECYCLING

RECOMMENDATION:
By Minute Motion, authorize staff to negotiate a new Franchise Agreement with Burrtec
Waste and Recycling for Municipal Solid Waste Services and submit negotiated
contract to City Council for approval.
DISCUSSION:
The City's Franchise Agreement with Burrtec Waste and Recycling expires February 28,
2009. Staff has discussed the pros and cons of negotiating a new contract with Burrtec
or going out to bid for municipal solid waste services. Dave Erwin, City Attorney has
been consulted regarding the City's ability to negotiate the contract without advertising
for bids. According to the City Attorney, the City is not required to advertise for bids for
waste hauling services as this is considered professional services.
The Solid Waste Committee (Councilmember Richard Kelly, Councilmember Robert
Spiegel, ACM Sheila Gilligan, and myself) met on February 12, 2008, to discuss the
City's options. The Committee felt that the best option and benefit to Palm Desert
residents would be to negotiate a new Franchise Agreement with Burrtec.
There are certain benefits to continuing solid waste and recycling services with Burrtec
as opposed to advertising for bids. Listed below are some of the pros and cons of
continuing the City's municipal solid waste services with Burrtec:
PROS:
• Well established hauler that is already fully operational
• Well established in the community
• Extensive waste and recycling programs in place
• Good working relationship

• Currently building a Material Recycling Facility (MRF) in North Palm Springs,
which will assist in creating and possibly bringing new markets for recyclable
materials to better
• Great rates
CONS:
• It is unknown as to who or how many haulers would be interested in providing
services to Palm Desert
• It is unknown whether or not rates would be lower or higher than Burrtec
• It is unknown as to the quality of service that would be provided by competitors
• No competitive bids to compare services and rates against
Through the negotiation process some of the less than optimal issues can be addressed
as well as the creation and expansion of future diversion programs.
Staffs recommends that the City Council authorize staff to negotiate a new Franchise
Agreement with Burrtec Waste and Recycling.
