HomeMy WebLinkAboutSB 1237 - Lot Line AdjustmentsREQUEST: DATE: BAR CITY OF PALM DESERT COMMUNITY SERVICES DEPARTMENT STAFF REPORT CONSIDERATION OF LEGISLATIVE REVIEW COMMITTEE ACTION ON SB 1237 (Cox) AT ITS MEETING OF FEBRUARY 26, 2008 March 27, 2008 CONTENTS: SB 1237 Language RECOMMENDATION: By Minute Motion, concur with the action taken by the Legislative Review Committee at its meeting of February 26, 2008, and direct staff to prepare a letter of opposition for the Mayor's signature with regard to SB 1237 (Cox) relative to lot line adjustments. EXECUTIVE SUMMARY: Passage of SB 1237 would require local agencies to approve or disapprove lot line adjustments within sixty (60) days after the receipt of an application. BACKGROUND: The Subdivision Map Act establishes standards and procedures for subdivision of land in the state by prohibiting the selling, leasing, and financing of any parcel of real property with map review, approval, and the recordation requirements of the Act. The provisions of SB 1237 would require local agencies to act to approve or disapprove lot line adjustments within sixty (60) days after the receipt of an application for a lot line adjustment. In addition, it would require that exterior boundaries included in the subdivision not include a parcel that has been designated as a remainder of the subdivision or has been omitted from the subdivision. If a sub -divider is required under the Act, the local agency must specify whether this dedication is to be in fee or an easement for public services. The bill goes on to require that the expiration date of any tentative subdivision map or parcel map, for which a tentative map has been approved and has not expired, be extended by 24 months. The provisions of SB 1237 may constitute an unfunded state mandate. In addition, the provisions of this bill remove local control from the manner in which agencies conduct their day- to-day business. Therefore, the Legislative Review Committee recommends that the City Council oppose SB 1237 and direct staff to prepare a letter stating that position to appropriate legisIOtures for the Mayor's signature.
