Discussion: On April 19, 2007, the City Clerk advertised and called for bids for Landscape Maintenance Areas 1, 2, and 7 and the contracts were ultimately awarded to Greenscape Landscape, Inc. On November 1, 2007, Greenscape Landscape, Inc. abandoned its contract and ceased all work for the City. On November 26, 2007, the City Clerk advertised and called for bids for Landscape Maintenance Area No. 7. Contract was awarded to Sierra Landscape, Inc. in the amount of $85,380.00. Then two actions: 1) By Minute Motion, authorized staff to: a)Immediately address the blighted parkway landscaping area along Monterey Avenue south of Hovley Lane West with appropriate maintenance measures and plantings, as necessary; b) return to City Council with a policy for handling similar landscaping issues in the future.5-0 2) Approved the recommendations stated above for P. 5-0 Amend Contract C27200 Landscape Maintenance Area No. 7 Page 2of2 March 27, 2008 Staff requested bids be submitted reflecting an annual amount; however, the term of the agreement was from February 1, 2008 through June 30, 2009 (17 months). At the time that contract was presented to Council, the amount requested was for 12 months instead of 17 months as per the contract agreement. Funds are available in respective Landscape and Lighting Assessment District accounts. Therefore, staff recommends that, by minute motion, City Council amend Contract No. C27200 for Landscape Maintenance Area No. 7 for the additional time of the contract term (5 months) by adding $35,575, bringing the contract to a grand total $120,955.00, and authorize the Mayor to execute amendment. Contract C27200 Contract Amendment No. 1 Continued from front This Contract Amendment covers changes to the subject contract as described herein. The Contractor shall construct, furnish equipment and materials, and perform all work as necessary or required to complete the Change Amendment items for a lump sum price agreed upon between the Contractor and the City of Palm Desert, otherwise referred to as Owner. Contract Time Extension -0- Days Revised Contract Total $120,955.00 The undersigned Contractor approves the foregoing Contract Amendment # 1 as to the changes, if any, in the contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said Contract Amendment # 1. The Contractor agrees to furnish all labor and materials and perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Change Amendment items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood that the Change Amendment shall be effective when approved by the Owner. Execution of this Contract Amendment by the Contractor constitutes a binding accord and satisfaction that fully satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity, arising out of or related to the subject of the Contract Amendment, whether known or unknown, including but not limited to direct and indirect costs and/or damages for delay, disruption, acceleration, loss of productivity, and stacking of trades, as well as any and all consequential damages.
