ARCHITECTS, INC., Applicant
Request for recommendation to City Council for approval of a
Mitigated Negative Declaration of Environmental Impact,
Generai Pian Amendment, Change of Zone. Precise Plan and
a Conditional Use Permit to allow construction of a new 42,512
square foot two-story Administrative Facility for Coachella
Valley Water District. Subject property is located at 75-515
Hovley Lane East (APN's 632-030-003 and 632-030-015).
Mr. Swartr reviewed the staff report, noting one correction to the chart on the
bottom of page four from 155 to 255 parking spaces. He stated that all
findings for approval could be made, a Negative Declaration was prepared,
the project would comply with development standards as approved,
adequate parking was being provided,there would be minimal impact on the
surrounding area, and the building height was accommodated by large
setbacks. Staff recommended that the Planning Commission adopt findings
and the resolution recommending to City Council approval of Case Nos. GPA
07-02, C/Z 07-01, PP 07-09 and CUP 07-10, subject to conditions.
Commissioner Limont asked if the Architectural Review Commission
requested that the tower element be extended because they felt it would be
an enhancement. Mr. Swartz said that was correct. When the application first
came in, the roof was flat and they felt it would give the building a new
element by actually coming up to a point.
Commissioner Limont asked if there would be anything inside the tower. Mr.
Swartz indicated that an elevator would be in one of the towers.
Commissioner Limont thanked him.
Commissioner Schmidt asked about the reason for the change of zone. Mr.
Swartz explained that the current CVWD (Coachefla Valley Water District)
building is zoned P (Public Institution). The proposed construction would also
be a public building and a change of zone would incorporate the whole area
and make it compatible with the existing building's current zoning.
Commissioner Schmidt asked if there was a building height restrictivn for
public buildings. Mr. Swartz said no, development standards are as
approved.
Comrnissioner Tanner asked what CVW D was going to do with the existing
building. Mr. Swartz thought it would still be in ope�ation, but deferred the
question to the applicant.

Cornmissioner Schmidt asked what other residential dwellings were in the
area besides the country club. Mr. Swartz commented that they are all two-
stories: going east, Primrose and Sandcastle at 22-24 feet in height.
Commissioner Schmidt asked approximately how close they would be to this
building. Mr. Swartz stated that the building would be set back 100 feet from
Hovley and 384 from Beacon Hill and the street width was about 100 feet, so
about 200 feet to where the buildings would be located. Then Mountain View
Villas as it continues down. Commissioner Schmidt asked if it was elevated
at that point up toward the north. Mr. Swartz concurred.
Commissioner Campbell indicated that this building would be three feet
below street level. If the tower is 42 and the elevation was down three, it
would be like 39 feet in height. Mr. Swartz said that was correct.
Chairperson Tschopp noted that there is a stop light at Beacon Hill and one
in front of the existing Coachella Valley Water District building. He asked if
staff planned on any other lefts out of the project. Mr. Swartz explained there
would be no lefts out off of Hovley. There would only be right-ins and right-
outs. There was a left-in coming from the west with a median break at Tava
Lane West. Chairperson Tschopp pointed out that was a real racetrack along
there a�d police try and slow traffic down. He also knew that Tava Lane can
be very busy with traffic trying to get out, and there was kind of a blind comer
with the curve. His comment was that he was happy there weren't any left-
outs there, but hoped, and would confirm with the applicant, that the front
gate would primarily be for visitors and not employees. He thought that would
make it a busy intersection.
Commissioner Schmidt asked if the north elevation was the main entrance.
Mr. Swartz said that was correct. Commissioner Schmidt noted that would
be facing the residents. Mr. Swartz said yes.
There were no other questions for staff. Chairperson Tschopp o e�ned the
public hearing and asked the applicant to address the Commission.
MR. MARK JOHNSON, the Director of Engineering for the Coachella
Valley Water District, stated that their district office address is Avenue
52 in Coachella, Califomia. He explained that they have existing
facilities in Coachella and Palm Desert. Both facilities were over
popuiated right now. They have employees working in trailers in
Coachella and Palm Desert, so they really had a need for additional
space. They were planning to relocate their administrative staff,
engineering, finance, human resources, risk management and
communications from their Coachella facility to the new facility. The
new facility would also have a board room. They usually have two

meetings a month, one would be at the new facility and one at the
Coachella facility.They planned to keep their existing facitities in Palm
Desert and Coachella in service. The existing facility in Palm Desert
is an operations center and would continue to be an operations
center.
In addition to what staff presented, Mr. Johnson mentioned that the
facility would be landscaped using desert landscaping. The parking
area woufd have covered parking with solar panels on top of the
covered parking.
Mr. Johnson stated that they met with the neighbors across the street
and presented the facility at one of their homeowner's association
meetings and received no negative comments from the residents. He
hoped Planning Commission would rule favorably on their project.
Their architect and other staff were also present to help answer any
questions.
Chairperson Tschopp asked about the left-tum in from Hovley Lane East into
the main entrance. He asked if Mr. Johnson envisioned employees using that
or if it was primarily for visitors.
Mr. Johnson said it was primarily for visitors. The parking in front of
the facility would be for visitors. They have parking in the back for
employees. There were twa entrances on Beacon Hill that would be
used by employees.
There were no other questions. Chairperson Tschopp asked for any
testimony in FAVOR or OPPOSITION to the matter. There was none and the
public hearing was closed. Chairperson Tschopp asked for Commission
comments.
Commissioner Tanner said he reviewed the renderings and knew what
CVWD was capable of doing, and was certain they would bring a very nice
building to that particular corner. He said there had been some concern
about what would happen on that corner and he was in favor of saying yes
to this project going forward.
Commissioner Campbell concurred. She didn't have a problem with the
- height since no one would be up there looking at the neighbors. The parking
for the empfoyees would be on Beacon Hilf and they shouldn't have any
problem with the traffic on Hovley Lane East. She made a motion for
approval.

Action:
It was moved by Commissioner Campbell, seconded by Commissioner
Tanner, adopting the findings as presented by staff.
Chairperson Tschopp concurred with the other Commissioners and thought
the setback would override the height from Mountain View Villas. There really
wasn't anything looking out that way and wasn't btocking any view there. He
also liked the way the traffic had been engineered and didn't think there
would be a problem. He called for the vote. Motion carried 5-0.
It was moved by Commissioner Campbell, seconded by Commissioner
Tanner, adopting Planning Commission Resolution No. 2471 recommending
to City Council approval of Case Nos. GPA 07-02, C/Z 07-01, PP 07-09 and
CUP 07-10, subject to conditions. Motion carried 5-0.
C. Case No. PP 07-14 - BILL LANG, Applicant
Request for recommendation to the City Council for the
approval of a Precise Plan amendment for an extensive
remodel and minor addition to an existing 76,195 square foot
retail center on a 5.15-acre site bounded by Highway 111,
Larkspur Lane and EI Paseo. The remodel includes three
architectural elements 40 feet in height. The project would
include the following addresses: 73-547 to 73-613 Highway
111, 45-051 Larkspur Lane, and 73-540 to 73-580 EI Paseo.
Facade remodeling would include the following existing
buildings: Jensen's Market and adjacent shops facing Highway
111, Three Dog Bakery facing Larkspur Lane, and various
shop tenants in three buildings that face EI Paseo located
directly behind (south ofl the Jensen's shopping center.
Ms. Schrader distributed ful{-sized renderings and a materia{ samples board.
She reviewed the request, noting that the remodel would include three
architectural elements 42 feet in height, not 40. She recommended that the
Planning Commission approve the facade remodel as proposed. She also
noted that it had been brought to her attention that the applicant would like
to begin construction in the summer or as soon as they can. Because of the
bus lane, there might be an opportunity for them to start construction while
they were still waiting for the bus lane to be approved. Staff would work that
out with them. She mentioned that because it of it being part of the
conditions of approval and asked for any questions.
Commissioner Limont said it was her understanding with regard to the 42-
foot elevation that Architectural Review Commission (ARC) had renderings

PALM DESERT, CALIFORNIA, RECOMMENDING TO CITY COUNCIL
APPROVAL OF A MITIGATED NEGATfVE DECLARATION OF
ENVIRONMENTAL IMPACT, GENERAL PLAN AMENDMENT, CHANGE
OF ZONE, PRECISE PLAN AND A CONDITIONAL USE PERMIT TO
ALLOW CONSTRUCTION OF A NEW 42,512 SQUARE FOOT TWO-
STORY ADMINISTRATtYE FACILITY FOR COACHELLA VALLEY
WATER DISTRICT. SUBJECT PROPERTY IS LOCATED AT 75-515
HOVLEY LANE EAST. (APN: 632-030-003 AND 632-030-015)

WHEREAS, the Planning Commission of the City of Palm Desert. Califomia, did
on the 1 gt day of April 2008, hold a duly noticed public hearing to consider the request by
WLC Architects, Inc, for approval of the above noted; and
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedure for Implementation of the Califomia Environmental Quality Act",
Resolution No. 06-78, the Director of Community Development has determined that the
project has required an Environmental Assessment resulting in a Mitigated Negative
Declaration, and the Planning Commission recommends approval of the Mitigated
Negative Declaration in substantially the foRn as shown in Exhibit °C"; and
WHEREP►S, at said pubiic hearing, upon hearing and considering all testimony
and arguments, if any, of all interested persons desiring to be heard, said Planning
Commission did find the following facts and reasons to exist to justify the
recommendation to the City Counci{ of said request:
Precise P�an/Conditional Use Permit:
1. The proposed location of the project is in accordance with the objectives
of the Zoning Ordinance and the purpose of the district in which the site is
located.
The proposed projecf is located in a Sl, Service Industrial zone but the
applicant is requesting a change of zone fo P, Public lnstitution. Per
Chapfe� 25.38 of the City of Palm Deserts Zoning Ordinance section
25.38.020 sfates no use shall be permitted without a conditional use permit.
The proposed use is consistent with the uses outlined in section 25.38.030
Conditional uses. The Public lnstitution zone does nof have any
development standards excepf what is approved by City Council.
Additionally, conditions have been added to fhe project to ensure that all the
minimum requiremenfs of the Palm Desert Municipal Code are met,
including Public Works, Building and the Fire department conditions.

2. The proposed location of the project and the conditions under which it will
be operated and maintained will not be detrimental to the public health,
safety or general welfare, or be materially injurious to properties or
improvements in the vicinity.
The proposed project as conditioned wi11 comply with curnenf Building and
Safety Codes, Fire Department and Reviewed by the Cify's Engineering
Departmeni for compliance with City Orolinance. The use of the
administrafive facility is permitted within the P, Pub/ic Institution zone
subject to a general plan amendment and a change of zone, with a
Conditional Use Permit (for the land use), is consistent with fhe intent of the
City's Zoning Orriinance as described in fhe staff report. The site has been
described fo meet as it r+elates to setbacks, lot coverage, building height,
land use, and pa►1�ing such that it wil! not be detrimental to the public
inferest, health, safety, welfare and will not be materially injurious to
properties or improvements in the vicinity as described in more defail in the
Staff report. A condition of approval has been placed on the project which
will require fhe project proponent to consfruct all necessary on and off-site
infrastructure fo provide utilities to fhe proposed project prior to fhe issuance
of Building Permits. Water, sanitaiion and public utilities and services are
available in Hovley Lane Easf, a public st►ieet.
An environmental assessment leading to a mitigated negafive declaration
has been prepared that concludes that there will be no adverse
environmenta!effects.
3. The proposed project will comply with each of the applicable provisions of
this title.
The proposed use is consistent with the infent of the Zoning Ordinance
since the applicant is requesting a change of zone and fhe standards
meets and/or exceeds the minimum development standards of the P,
Public lnstitution zone. Additionally, conditions have been added fo fhe
project to ensure that all the minimum requirements of the Palm Desert
Municipa/ Code ar� met, including building, landscaping, public works,
and the fire department conditions.
4. The proposed project complies with the goals, objectives, and policies of
the city's adopted General Plan.
The General Plan land use designation for the site is "Industrial/Business
Park (1-B.P.)': The applicant is requesting a Genera/ Plan Amendment to
P.F., Public✓Quasi-Public. A primary objective sfafed in the Land Use
Element of the General Plan under Public Services and Facilifies Goa/s,
Policies and Programs is Policy 1, which sfafes the City shall pro-actively
cooperate and coordinate wifh all providers of utility and public facilities and
safety services in fhe community to assure adequaie and quality levels of
service. Program 1.A of fhe Genera/ Plan Land Use Element is fhe Cify
shall regularly coordinate and, as appropriate, cooperate with the various

The Director of the Department of Community Development, City of Palm Desert,
California, has found that the described project will not have a significant effect on
the environment. A copy of the Initial Study has been attached to document the
reasons in support of this finding. Mitigation measures, if any, included in the project
to avoid potentially significant effects, may also be found attached.

Department of Communitv Develoament:
1. The development of the property shall conform substantially with exhibits on file
with the Department of Community Development/Planning, as modified by the
following conditions.
2. Construction of a portion of said project shall commence within one year from
the date of final approval unless an extension of time is granted; otherwise said
approval shall become null, void and of no effect whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
ordinances and state and federal statutes now in force, or which hereafter may
be in force.
4. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits andJor clearance from the
following agencies:

Pafm Desert Architectural Commission
City Fire Marshal
Public Works Department
Evidence of said permit or clearance from the above agencies shall be
presented to the departrnent of building and safety at the time of issuance of a
building permit for the use contemplated herewith.
5. Access to trash/service areas shall be placed so as not to conflict with parking
areas. Said placement shall be approved by applicable waste company and
Department of Community Development and shall include a recycling prog�am.
6. All sidewalk pfans shall be reviewed and approved by the department of public
works.
7. The project shaN be subject to all applicable fees at time of issuance of building
permits including, but not limited to, Art in Public Places, Fringe-Toed Lizard,
TUMF, School Mitigation and Housing Mitigation fees.
8. A detailed parking lot and building lighting plan shall be submitted to staff for
approval, subject to applicable lighting standards, plan to be prepared by a
qualified lighting engineer.
9. All Landscaping and lighting for the facility shalf be strictly on site and will not
intrude onto surrounding properties.

10. The project is subject to the Art in Pubiic Places program per Palm Desert
Municipal Code Chapter 4.10.
11. The owner shall be responsible for installation and maintenance of landscaping
of the property, as indicated on the approved landscape plan.
12. All conditions of approval shall be recorded before any building permits are
issued. Evidence of recordation shall be submitted to the Department of
Community Development/Planning.
13. Applicant must obtain approval for a Parcel Map Waiver and have it recorded
with the County of Riverside before obtaining any and all permits. The new
property lines must meet all development standards placed on the project.
Denartment of Public Works:
GENERAL REQUIREMENTS
1. A!I landscape maintenance shall be performed by the property owner who shall
maintain the landscaping per the City approved landscape document package
for the life of the project, consistent with the Property Maintenance Ordinance
(Ord. 801) and the approved landscaped plan.
2. A complete preliminary soils investigation, conducted by a registered soils
engineer, shall be submitted to, and approved by, the Department of Public
Works prior to the issuance of a grading permit.
BONDS AND FEES
3. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17
and 79-55, shall be paid prior to issuance of grading permit.
4. The project shall be subject to Transportation Uniform Mitigation Fees (TUMF).
Payment of said fees shall be at the time of building permit issuance.
5. A standard inspection fee shall be paid prior to issuance of grading permits.
6. Drainage fees, in accordance with Section 26.49 of the Palm Desert Municipal
Code shall be paid to issuance of grading permit.
DESIGN REQUIREMENTS
7. Storm drain design and construction shall be contingent upon a drainage study
prepared by a registered civil engineer that is reviewed and approved by the
Department of Public Works prior to start of construction.

8. Complete grading and improvement plans and specifications shali be submitted
to the Director of Public Works for checking and approva{ prior to issuance of
any permits.
9. Any and ail offsite improvements shait be preceded by the approval of pians and
the issuance of valid encroachment permits by the Department of Public Works.
10. Pad elevations are subject to review and modification in accordance with
Chapter 2fi of the Palm Desert Municipal Code.
11. Landscape installation shall be drought tolerant in nature and in accordance with
the City's Water E�cient l.andscape Ordinance (24.04).
12. Landscape plans shall be submitted for review concurrently with grading pfans
and shall show all utility and vault locations.
CONSTRUCTION REQUIREMENT
13. Full public improvements, as required by Section 26 of the Palm Desert
Municipal Code, shall be installed in accordance with applicable City standards

- 6 foot curbside sidewalk on Beacon Hill and 6 foot meandering sidewafk,
4 foot back of curb, on Hovley Lane East.
- Rights-of-way necessary for the installation of the above referenced

14. All public and private improvements shall be inspected by the Department of
Public Works and a standard inspection fee shall be paid prior to issuance of
grading permits. No occupancy permit shall be granted until public improvements
have been completed.

24.12, Fugitive Dust Control as wel{ as Section 24.20, Storm water Management
and Discharge Contrvl.
16. Prior to the start of construction, the applicant shall submit satisfactory evidence
to the Director of Public Works of intended compliance with the National
Pollutant Discharge Elimination System (NPDES) General Construction Permit
for storm water discharges associated with construction. Developer must
contact Riverside County Flood Control District for informationaf materials.

Riverside Countv Fire Deaartment:
1. With respect to the conditions of approval regarding the above referenced
project, the Fire Department recommends the following fire protection measures
be provided in accordance with City Municipal Codes, NFPA, UFC and UBC, or
any recognized fire protection standards.
The Fire Department is required to set a minimum fire flow for the remodel or
construction of all buildings per UFC article 87.
2. A fire flow of 1500 gpm for a 1 hour duration at 20 psi residual pressure must be
available before any combustible material is placed on the job site.
3. Provide or show there exists a water system capable of providing a gpm fire flow
of 3000 gpm for commercial buildings.
4. The required fire flow shall be available from a wet barrel Super Hydrant(s) 4"x2-
1/2"x2-1/2", located not less than 25' nor more than 150' feet from any portion of
a commercial building measured via vehicular travelway.
5. Water plans must be approved by the Fire Marshal and include verification that
the water system will produce the required fire flow.
6. Install a complete NFPA 13 fire sprinkler system. This applies to all buildings with
a 3000 square foot total cumulative floor area. The Fire Marshal shall approve
the locations of all post indicator valves and fire department connections. All
valves and connections shall not be less than 25' from the building and within 50'
of an approved hydrant. Exempted are one and two family dwellings.
7. All valves controlling the water supply for a�tomatic sprinkler systems and water-
flow switches shall be monitored and alarmed per UBC Chapter 9.
8. Install a fire alarm system as required by the UBC Chapter 3.
9. Install portable fire extinguishers per NFPA 10, but not less than one 2A106C
extinguisher per 3004 square feet and not over 75' walking distance. A "K" type
fire extinguisher is required in all commercial kitchens.
10. All buildings shall be accessible by an all-weather roadway extending to within
150' of all portions of the exterior walls of the first story. The roadway shall not be
less than 24' of unobstructed width and 13'6" of vertical clearance. Where
parallel parking is required on both sides of the street the roadway must be 36'
wide and 32' wide with parking on one side. Dead-end roads in excess of 150'
shall be provided with a minimum 45' radius turn-around 55' in industrial
developments.

I11. PROJECT DESCRIPTION:
Coachella Valley Water District (CVWD) has a current Administrative Facility located
in Coachella and is relocating to Palm Desert next to their existing water
conservation facility. The new facility includes a board room and office space for 108
employees in the finance, communications, engineering, administration, human
resources and risk management departments. The two-story building will be
approximately 42,512 square feet in total floor area. There will be a surface parking
{ot with 150 employee parking spaces covered with solar panels aiong the west side
of the new building and 105 public parking spaces located in front of the building.
The project also includes an outdoor amphitheater that will be used for weekend
workshops on plant and water conservation, an entry gate off of Hovley Lane East
for public and staff use, and two gates off of Beacon Hill for public, staff and oversize
vehicle use.
The project will require a General Plan Amendment from Industrial, Business Park (I-
BP) to Public/Quasi-Public Facilities (PF), a Change of Zone from Service Industrial
(SI) to Public Institution (P), a Precise Plan, a Conditional Use Permit and an
Adoption of a Mitigated Negative Declaration as it relates to the project thereto. The
Initial Study and Mitigated Negative Declaration were completed in accordance the
City's Guidelines implementing the Cal'rfornia Environmental Quality Act.
A. Slte Plan:
The site plan illustrates that there are three vehicular entrances to the
property from Hovley Lane East and Beacon Hill into the facility. The main
vehicular entrance is accessed through Hovley Lane East facing north with a
secondary access through Beacon Hill facing west. Hovley Lane East has a
left in and right out. Beacon Hill will have full egress and ingress and both
entrances will be maintained by a six-foot high steel gate that will be set back
approximately 10 feet from property line and wifl be open during the hours of
7:00 a.m. to 6:00 p.m., Monday through Friday for public and staff use. A
secondary entrance for oversized vehicles located on the southwest corner of
Beacon Hi{I will have full egress and ingress, with a six-foot high steel gate.
The proposed Administrative Facility has been designed to have a pad level
three feet lower then street level and wiN be set back 100 feet from the new

side (Beacon Hill) property line. The applicant is proposing a lot line
adjustment ar►d at this time does not know where the rear and side property
lines will be located, but a condition of approval has been placed on the
project that the new property lines will meet all development standards placed
on the project including set back location.
The site plan also includes: a community plaza with a flagpole; 255 parking
spaces; (150 for staff, 105 for visitors); an outdoor trash bin area; an outdoor
amphitheater; an outdoor break area; sidewalk around perimeter of property
along with a stabilized decomposed granite path on property; and
landscaping requirements.
B. Building Descrlption:
The proposal is for a two-story 42,512 square foot building measuring 42 feet
to the highest architectural feature. A variety of roofline heights vary on the
main building and range in height from the predominant building line of 30
feet high to the taNest tower element of 42 feet high. The first floor to the
second floor is 14 feet high. From the second floor to the roof height is 27 feet
with a parapet roof at 30 feet. The upper roof maintains at 40 feet with the
tower element over the boardroom at 42 feet. A condition of approval has
been placed on the project requiring all roof mounted equipment to be
screened from public view. The building offers customers and employees
either an elevator or stairs to get from the first floor to the second floor.
The building consists of a series of defined modulations including multiple
planed facades (recessed entries, trellis, and pop-outs), gable roof pitch, and
entry ways. This style is not found in the immediate area, but is a style that
will enhance the surrounding neighborhood. The building's proposed
architecture is described in detail in the following section.
C. Architecture:
The project will incorporate a Modern architectural style, inciuding standing
seam metaf roof to present a soft appearance while protecting from solar
gain, earth-toned colors, and will include multiple planned facades (recessed
entries and pop-outs). Surface finishes consist of plaster and Angelus block
including; "4ak" splitface, "Charcoal" precision and "Sandstone" precision.
The exterior paint will be Dunn Edwards "Sandpit" and Dunn Edwards
"Regency Cream". The building will incorporate Atlantic Float glass and is
proposed to be framed with clear anodized aluminum muNions. The building
has a small portion that is proposed to be decorated with a geometrically
symmetrical pattern of glass fixed in the walls.

At its meeting of February 13, 2008 the Archit+ectural Review Commission
(ARC) reviewed the project. The Commission generally supported the
concept and offered minimal comments. The Commission stated: a restudy of
the mechanical equipment screening to create an architectural feature, and
allowing the elevator tower to come to a point. The Commission agreed that
the project architects have provided a well design project and it was approved
on a 4-0-0-2 vote, Commissioners Hanson and Lambell absent.
D. Landscaping:
� The landscape palette will focus on a desert theme, with plants requiring
minimal water usage. The plant se{ection is in conformance with the City's
Landscape Maintenance Guide and recommendations. Preliminary approval
from the City's Landscape Specialist has been approved. Also a condition of
approval has been placed on the project that all landscaping and lighting for
the facility will be strictly on site and will not intrude onto surrounding
properties.
E. General Plan and Change of Zone:
The project includes a general plan amendment and change of zone to
Publicllnstitution District which states that the development standards are as
approved.

Although the zone does not provide any development standards, the
applicant has worked diligently with staff to make sure the proposed project is
compatible with the surrounding neighborhood and provides all the services
and needs required by CVWD. The design and layout of the proposed project
will not interfere with the use and enjoyment of neighboring existing or future
development, and will not result in vehicular and/or pedestrian hazards.
B. Helght:
The current height in the S.I. zone is 35 feet. To the south and west of the
project there are existing industrial buildings ranging in size from 22 to 35 feet
in height. To the north are existing two-story condos ranging in size from 22
to 24 feet in height. The existing CVWD building is to the east at 30 feet in
height.
When the applicant first submitted the project, the proposed building height
was 52 feet to the tallest architectural feature. Knowing that taller buildings is
a potential concern issue for the adjacent residential properties, staff worked
with the applicant to reduce the size and massing of the building to be in
keeping with the surrounding neighborhood while maintaining the design
needs for CVWD. The applicant reduced the overall building height from 52
feet to 42 feet and the project was presented to the ARC. The proposed
architectural and overall building height was granted preliminary approval by
the ARC due to its substantial setbacks from the streets and surrounding
buildings and overall design integrity with the 42-foot tower element.
While height can be potentially an issue when adjacent to a residential zone
and when proposed buildings it was concluded that due to the proposed
building setbacks and being surrounded by other Industrial buildings the
height of the structure would not create a negative visual impact as seen from
Hovley Lane East and Beacon Hill.

1. The proposed location of the project is in accordance with the
objectives of the Zoning Ordinance and the purpose of the district in
which the site is located.
The proposed project is located in a Sl, Service Industrial zone but the
applicant is requesting a change of zone to P, Public lnstitution. Per
Chapter 25.38 of the City of Palm Deserts Zoning Ordinance section
25.38.020 states no use shall be permitted wiihouf a conditional use
permit. The proposed use is consistent with the uses outlined in
section 25.38.030 eonditional uses. The Public Institution zone does
noi have any development standards except what is approved by City
Council. Additionally, conditions have been added to the project to
ensure that all the minimum requirements of ihe Palm Desert
Municipal Code are met, including Public Works, Building and the Fire
departmeni condiiions.
2. The proposed focation of the project and the conditions under which it
will be operated and maintained will not be detrimental to the public
health, safety or general welfare, or be materially injurious to
properties or improvements in the vicinity.
The proposed project as conditioned will comply with current Building
and Safety Codes, Fire Department and Reviewed by the City's
Engineering Department for compliance with City Ordinance. The use
of the administrative facility is permitted within the P, Public Institution
zone subject to a general plan amendment and a change of zone, with
a Conditional Use Permit (for the land use), is consistent wifh fhe
intenf of the City's Zoning Ordinance as described in the staff report.
The site has been described to meet as it relates to setbacks, lot
coverage, building height, land use, and parking such that it will not be
detrimenta!to the public interest, health, safety, welfare and will not be
materially injurious to properties or improvements in the vicinity as
described in more detail in the Staff�eport. A condition of approval has
been placed on the project which will require the projecr proponent to
construct all necessary on and off-site infrastructure to provide utilities
to the proposed project prio� to the issuance of Building Permits.
Water, sanitation and public ufilities and services are available in
Hovley Lane East, a public street.
An environmental assessment leading fo a mitigated negafive
declaration has been prepared thaf concludes that there will be no
adverse environmenta!effects.
3. The proposed project will comply with each of the applicable
provisions of this title.

The proposed use is consistent with the intent of the Zoning Ordinance
since the applicant is requesting a change of zone and the standards
meets andlor exceeds the minimum development standards of the P,
Public Institution zone. Additionally, conditions have been added to the
project to ensure that all the minimum requirements of the Palm
Desert Municipal Code are met, including building, landscaping, public
works, and the fire departmeni conditions.
4. The proposed project complies with the goals, objectives, and policies
of the city's adopted General Plan.
The General Plan land use designation for fhe siie is "Industrial /
Business Park (I-B.P.)" The applicant is requesting a General Plan
Amendment to P.F., PublicJQuasi-Public. A primary objective stated in
the Land Use Element of the General Plan under Public Services and
Facilities Goals, Policies and Programs is Policy 1, which states the City
shall pro-actively cooperate and coordinate with all providers of utility
and public facilities and safety services in the community to assure
adequate and quality levels of service. Program 1.A of the General Plan
Land Use Elemeni is the City shall regularly coordinate and, as
appropriate, cooperate with the various public and pr'ivate providers
responsible for utilities, police, fire, health and other protection and care
services in the community. Policy 2 of the General Plan Land Use
Element is the Ciry shall encourage the timely development of public
services and facilities in a manner, which assures adequaie levels of
service, while remaining compafible with existing and future land uses.
This project maintains a land use that is consistent with the goals,
policies, and programs of the General Plan. The project is consistent
with the General Plan because the project proposes a public facility use,
which is compatible with the existing uses within the surrounding area,
and offers an excel%nt service to the communiry.
V. CONCLUSION:
In conclusion, staff finds that by granting a General Plan Amendment, Change of
Zone, Precise Plan and a Conditional Use Permit for Coachella Valley Water
DistricYs Administrative Facility the overall building height would not have a negative
visual impact due to building setbacks and being surrounded by industria! buildings
and two-story homes than another use in the P, Public Institution zone.
VI. ENVIRONMENTAL REVIEW:
Staff has prepared an Environmental Assessment that resulted in a Mitigated
Negative Declaration for the project site. (See attachments). The site was analyzed

are those regularly associated with development of this type. An impact fee for the
Fringe-toed Lizard/Multiple Species Habitat Conservation Plan as applicable will be
required when obtaining permits.

That the Planning Commission adopts the findings and adopts Planning Commission
Resofution No. , recommending to City Council approval of Case Nos. GPA
07-02, C2 07-01, PP 07-09 & CUP 07-10, subject to conditions attached.

Facility("CVWD Facilit}�')includes the construcdon of a new administrative of�ce
building on 5.84 acres of vacant land. Ttie new structure includes a board room and of�ice
space for 108 employees i.n the finance, communications, engineering, administration,
human resources and risk management departments. The two-story building will be
approximately 42,000 square-feet in total floor area. There will be a surface parlcing lot
with 114 employee parking spaces along the west side of the new buildi.ng and l 14 public
parking spaces located in front of the building. A parking area for approximately 45 heavy
vehicles is also proposed in the southernmost portion of the parcel. Site development will
include grading,sewer,water and stonn drain facilities,paving, exterior lighting and
landscape construction, security walls/fencing and gates. Also included is the installation
of a diesel-fueled generator for backup power.

completely surrounded by development: northwest and east is existing light industrial and
commercial; existing residential units are located to the northeast; the existing CVWD
Satellite Facility is]ocated east of the site; and Water Reclamation Plant No. 10 is located
south and southeast of the proposed site. A row of Tamarisk trees borders the immediate
south boundary. The site itself contains disturbed Sonoran Creosote Bush Scrub habitat,

' , COMMENTS
I. Land Use and Plrnning
The proposed CVWD Facility is located at the corner of Hovley Lane East and Beacon
� Hill Drive in Palm D��ert,Riverside County on a 5.84acre vacant lot. This "in-fill"project is
, completely surrounded by existing commercial,light industrial and residential developmezit The
site is zoned as "Light Industrial" and"Public/Quasi-Public Facilides"per the PaUn Desert
General Plan,March 2004. The zoning descriptions allow public agency facilities to be
constructed and operated within the project site. There are no agricultural lands located on or
adjacent to the project site.
II. Population and Housing
The pmposed CWVD Facility in Palm Desert is being constructed to provide office space
for 108 employees in the finauce,communications,engineering, administration,human resoum.es
and risk managemeut departments that are currendy lacated in the CVWD facility in Coachella
The new CVWD Facility will also include a board room where board of direetors meetings will
be held twice montbly. This project is not a growth-inducing project and is consistent with
appmved local planning. No existing hausing will be displaced or negatively affected by the
project.
III. Geology
The proposed site for the new CVWD Facility is relatively flat and at an elevation of
approximately 210 to 220 feet above mean sea level. The soil is Myoma fine sand typical of
dunes and alluvial fans. The site is approximately eight miles southwest of the San Andreas
Fault and as such would be subject to significant ground shaking in the event of movement on
the fault. The site is not located within an area identified as an Alquist-Priolo Earthquake Fault
Zone. The proposed facility will be designed and constructed to meet cutrent California
building standatds to withstavd seismic groundshaking. Therefore,project impacts related to
seismic ground shaking would be less than significant. .
The CVWD Facility project site is located inland and,therefore,tsunamis are not a
hazard issue. The Salton Sea is located approximately 21 miles southeast of the project site.
There are no volcanoes in the project area. The project site is not located on a landslide or
mudflow hazard area. There are no unique geologic or physical features presen�
IV. Water
During canstruction of the proposed CVWD Facility, stormwater would be managed in
accordance with Best Management Practices (BMPs) identified in a Storm Water Pollution
Prevention Plan(SWPPP). These BMPs would include measures to minimize erosion and
setiimentation and general good housekeeping practices to limit potential discharge of pollutants
associated with construction vehicle and equipment use. With implementation of BMPs per the

SWPPP,potential impacts on water quality associated with stoimwater discharges during project
construction would be less than significant.
The proposed project does not include alteration of the course of a stream or river. The
proposed project would involve earthwork for grading the site,constructing a foundation,and
improving the site with parlting,utilities and landscaping,but would not have a significant effect
on storm water runoff characteristics. The project would add approximately 3.0 acres of
impervious surfaces(concrete parking areas, sidewallcs) within the 5.84acre site with
construction of the CVWD Facility and associated parking. The SWPPP will include measures ,
to control stomawater runoff from impervious surfaces. �
With nnplementation of the SWPPP BMPs,the construction and operation of the new
CVWD Facility wtll not result in substantial erosion or siltation, flooding, or provide additional
sources of polluted runoi� Impacts would be less than significau�
V. Air Quslity
The proposed CVWD Facility is located within the Salton Sea Air Basin(SSAB),which
includes Imperial County and most of the low desert areas of central Riverside County. The
Riverside County portion of the SSAB is regulated by the South Coast Air Quality Management
District(SCAQMD). The Coachella Valley portion of Riverside County is designated as a
"serious"non-attainment area for ozone(8-hour) and particulate matter 10 microns or less in
diameter(PM10).
The applicable air quality plans for the CVWD Facility pmject are the 2003 Air Quality
Management Plan(AQMP) and the Coachella Valley PM10 State Implementation Plan(SIP).
The AQMP is designed to satisfy the planning requirements of both the federal and California
Clean Air Acts. The AQMP outlines strategies and measures to achieve federal and state
standards for healthfiil air quality for all areas under SCAQNID's jurisdiction, including portions
of the SSAB. The Coachella Valley PM10 SIP identifies additional strategies and measures to
control fugitive dust specifically in the Coachella Valley.
A project is deemed inconsistent with the applicable air quality plan if it would result in
population and/or employment growth that exceeds growth estimated in the applicable air quality
plan. The proposed project includes development of an employment center, but would not
induce population or employment gowth beyond the levels approved in the AQMP. Therefore,
the proposed project would not conflict with or obstruct the implementation of the AQMP.
Disturbance of 5,000 square feet or more requires a Dust Control Plan. The proposed
project will have a Dust Control Plan that follows the SCAQMD Rule 403 Fugitive Dust Control
Requirements within the Coachella Valley. With respect to the Coachella Valley PM10 SIP, the
proposed project will comply with the dust control requirements of the SIP, and therefore will
not conflict with or obstruct implementadon of the SIP.

� Except for ternporary emissions of diesel parkiculate matter associated with use of heavy
diesel equipment during project construction,the proposed proje�t would not r�ult in emissions
of toxic air contaminants or nuisance odors. However, these temporary consttuction-related
emissions and/or odor impacts would be confine�to the immediate vicinity of the projed
equipment and would not expose sensitive receptors to substantial pollutant concentrations
' and/or odors. The appropriate air quality permits for the diesel-fueled generator for back-up
� power will be procured from the SCAQNID before the generator is installed at the project site.
The vehicle trips created by the 108 employees at the new facility will not have a
significant effect on air quality in the Coachella Valley since these vehicle trips will be the same
employee.s currendy traveling to the existing CVWD offce in Coachella Since Palm Desert is
more centraily-located in the Coachella Valley, some employces' commutes will be lesseaed.
VI. Transportation/Ctrculation
The Riverside County Transportation Commission is the Congestion Management
Agency for the project azea. The Coachella Valley Association of Govelnments(CVAG),as a
regional planning agency,has be�n monitoring traffic counts in the Coachella Valley. A 1998
planning study projeeted daily traffic volumes on the Coachella Valley's roads in 2020. In
several locations,the 2020 figures had already been exceeded by 2005,including these
intersections in Palm Desert: Hovley Lane EastlWashington Strcet; Cook StreetiCountry Club;
and Cook Street/Fred Waring. The Hovley Lane East/Washington Street intersec�tion is the
busiest in the Coachella Valley per CWAG. The additional vehicle trips created by the 108
employees at the new facility will not have a significant effect on the average daily traffic on
local streets in the project vicinity.
The construction activities associated with the CVWD Facility project will slightly
increase heavy truck traffic on the local roads in the project area during the conshuction period.
However, such truck traffic will not exceed established local load limits. The project will
generate limited traff c during construction and may require short-term delays on local roadways.
Coordination with the City of Palm Desert will ensure that local trai�'ic impacts remain mini�mal
during construction activities.
Adequate pazking for the 108 employees at the new facility will be provided with a
parking lot with 114 parking spaces. There will also be a visitors' parking lot with 114 spaces, as
well as a parking azea for approximately 45 heavy vehicles.
VII. Biological Resources
The proposed CVWD Facility site is locatetl at the corner of Hovley Lane East and
Beacon Hill Drive in the city of Palm Desert and is completely surrounded by development(light
industrial, commercial, residential, public facility,water treahnent plant). A biological field
survey was conducted by LSA Associates, Inc. in February 2006 to record the general site
conditions, vegetation,wildlife, potential jurisdictional waters, and suitability of habitat for
sensitive species.

The"island"site contains disturbed Sonoran Creosote Bush Scrub vegetation, consisting
of creosote bush(Larrea tridentata), sand verbena(Abronia villlosa var. villosa),panamint
cryptantha(Cryptaniha angusnfolia)and desert marigold(Baileya pleniradiatu). A row of
tamarisk trees (Tamarix aphylla)borders the south boundary of the site. Wildlife and/or its sign
(scat,tracks,burrows)observed during the survey included mourning dove(Zenaidu macroura),
common raven(Corvus corax),white-crowaed spaimw(Zonotrichia leucophrys),house finch
(Carpodacus mexicanus)and desert cottontail (Sylvilagus audubonii).
Two federally/State-listed species have a low probability of occurrence at the site: , .
■ Coachella Valley milkvetch(Astragalus lentiginosus var.coachellae); and
■ Palm Springs round-tailed ground squirrel (Spermophilus tere#icaudis chlorvs)
Based on the small size of the site and site disturbance,desert tortoise,another federaUState-
listed species, is considered to be absent from the site. Seven other non-listed, sensitive species
are considered to also have a low probability of occiurence:
■ Flat-seeded spurge(Chamaesyce platysperma);
■ Glandular ditaakis(Ditaxis clariana);
■ Califomia ditaxis (Ditaxis serrata var. californica);
■ Flat-tailed horned lizard(Phrynosoma mcallii);
■ Bunowing owl (Athene cunicularia);
■ Black-tailed gnatcatcher(Polioptila melanura); and
■ Westem yellow bat(Lasiurus xanthinus)
Additional pre-construction surveys by a qualified biologist will be conducted on the site to
verify the non-existence of any of the above-mentioned sensitive species.
Since the proposed project site is surrounded by existing development,the habitat onsite
has been fragmented and regional wildlife movement has been inhibited. The site is not within a
conservation area of the proposed Coachella Valley Multiple Species Habitat Conservation Plan.
The proposed project will not have a significant effect on a regional wildlife corridor. Also,no
jurisdictional waters or wetlands regulated by various federal and state agencies are present on
the site; therefore,the project will not affect any jurisdictional waters or wedands.
VIII. Energy and Mineral Resources
The proposed CVWD Facility project does not conflict with any adopted energy
conservation plans. The project will include energy-efficient desi�and materials where feasible
and available. No wasteful use of electricity will occur. No loss of valuable mineral resources
will occur with the construction or use of the project.

The CVWD Facility design and construction will follow all applicable federal,state, and
local safety guidelines. Any hazards to workers during construetion of the pro}ect will be
minimized by adheTence to required Occupational Safety and Health Administration(OSHA)
' standards. The proposed pmject will not interfere with any emergency response plans or
� evacuation plans. The project includes the installation of ornameatal landscaping throughout the
site,but will not increase fire hazards at the project site.
X. Noise
A temporary increase in noise levels may occur during construction activities at the
proposed CVWD Facility site. Since there are adjacent residential and commercial units,
temporary construction noise will be minimized by the use of engine mufflers on construction
equipmeat. All construction activities at the site will adhere to the noise regulations established
by the City of Palm Desert. This temporary increase in noise levels during conshvction activities
will not be a significant effect. The emergency generator that will be installe�at the CVWD
Facility will run during loss of commercial power and will be"exercised"for 5 minutes weekly.
Once completed,the new CVWD Facility will not produce noise effects above the existing noise
levels in the project vicinity. �
XI. Public Services
The construction and operation of the new CVWD Facility will require some additional
fire protection,police protection, and maintenance of a public faeility,but these requirements are
not considered a significant effect.
XII. Utilities and Service Systems
The proposed, two-story CVWD Facility will be approximately 42,000 square-feet in
total floor area and provide office space for 108 employees. Site development will include
grading,sewer,water and storm drain facilities,paving, exterior lighting and landscape
construction, security walls/fencing and gates. Construction activities and operations at the new
CVWD Facility will use power provided by the local power utility. The project will include
energy-efficient design and materials where feasible and available. Daily operations at the new
facility will use telephone, gas, water, sewer, solid waste services provided by the local utilities.
The use of these utilities and services at the proposed CVWD Facility aze not considered a
significant effect.
XIII. AestheNcs
The proposed CVWD Facility will be located at the corner of Hovley Lane East and
Beacon Hill Drive in Palm Desert on a 5.84acre parcel containing distutbed Sonoran Creosote
Bush Scrub habitat. The"in-fill"project is completely sun-ounded by existing commercial, light
industrial and residential development. The two-story building will be approximately 42,000

square-feet in total floor area There will be a surface parking lot with 114 employee parking
spaces along the west side of the new building, 114 public parking spaces located in front of the
building, and heavy vehicle parking behind the building. Site development will include grading,
sewer,water and storm drain facilities,paving, exterior lighting and landscape construction,
security walls/fencing and gates. The project desiga will follow all City of Palm Desert design
guidelines and will not be out of context with other structures in the project vicinity. The new
building will be approxunately 35 feet at its highest point The residential buildings north of the
new facility are also two-story structures with a�maximum height of approximately 30 feet. The
project will not have a significant effect on the current viewshed of these residential units. The � ,
proposed proje�t will not impact any scenic vistas and is not located along a designated scetic
road.
Additional light sources will be created by the proposed facility with safety/security
lighting on end suirounding the building, and parking lot lighting. All lighting will be shielded
downward to avoid any potential e�ects on adjacent resideatiaUcommercial units. All lighting
guidelines established by the City of Palm Desert will be followed during project development.
XIV. Cultural Resoarces
�
On January 27, 2006, LSA Associates, Ina conducted a field survey at the proposed
CVWD Facility site for archaeologicaUcultural resources. No archaeologicaUcultural resources
were observed at the project site. A cultural resource records search through the University of
California Eastem Information Centgr was also conducted by LSA in January 2006. Data from
the records search indicated that 16 cultural resource studies have been conducted within a one-
mile radius of the project site. No cultural resources have been recorded within the project
boundaries. The nearest recorded cultural resource is an adobe structure(CA-RN-3886) located
about one-mile southeast of the project site.
Per the cultlu�al resources report,the development of the project will not likely affect any
cultural resowces;therefore,no fiuther cultural resource investigations or monitoring are
recommended. However, if cultural resources are identified during construction activities at the
site, a qualified archaeologist will be notified to record any findings per CEQA guidelines. If
human remains are discovered, construction activities shall cease until the Coroner has been
notified and has made a determination of origin and deposition. If the remains aze determined to
be prehistoric, the Coroner will nodfy the Native American Heritage Commission which will
determine and notify the Most Likely Descendant.
A paleontological resource records search and field survey were also conducted for the
proposed project site. Paleontological resource sites have not been recorded within a mile radius
of the site; fossil localities aze known from the mid-Pleistocene sediments in the Indio Hills,
about 4 miles north of the project site. No paleontological resources were observed during a field
reconnaissance at the site. However, if paleontological resources are discovered during
construction activities, a qualified paleontologist will be retained to evaluate and remove those
resources per CEQA guidelines.

� XV. Recreation
The construction and operation of the proposed CVWD Facility will not increase the
demand for neighborhood or regional parks,or any other recreational facilities. Nor will the
project affect any existing recreational opportunities in the project area.
� XVI. MandAtory Findings of Si�ificance.
a.) The proposed CVWD Facility site is completely surnounded by development(light
industrial, commercial,residential,public facility,wastewater treatment plant).The
"island" site contains disturbed Sonoran Creosote Bush Scrub vegetation. Since the
proposed project site is sutmunded by existing development,the habitat onsite has
been fragmented and regional wildlife movement has been inhibited The site is not
within a conservation area of the proposed Coachella Valley Multiple Species Habitat
Conservation Plan. The proposed project will not have a significant effect on any
regional wildlife corridor. Sensitive species were not found on the site and will not be
affected by the project. No cultural resources were found on the project site,thus,the
project will not eliminate important examples of the major periods of California
history or prehistory.

b.) The constcuction and operation of the proposed CVWD Facility project will not have
a negative effect on long-term environmental goals. The proposed CVWD Facility is
being constructed to provide office space for 108 e�mployee.s in the Finance,
Communications, Engineering,Administration, Human Resources and Risk
Management departments, as well as a Board Room, customers, other meetings. This
pmject is an"in-fill"project; the project site is surrounded by existing residential,
commercial and light industrial use. The project is not a growth-inducing project and
� is consistent with approved local planning. The project will use the latest energy-
efficient design and materials. The new facility will be in Palm Desert,a more
centrally-located area of the Coachella Valley, which may lessen work commutes for
some employees.
c.) The new CVWD Facility will have temporary effects associated with dust,noise, and
local traffic circulation during construction activities. Project canstruction will follow
all federal, state and local regulations regarding air quality,noise and traffic
circulation. The cumulative effects, if any, of this project and other projeds in the
vicinity are not expected to have a significant effect on the environment or the
commuruty.
d.) Since the proposed project will follow all federal, state and local regulations regarding
air quality, water quality, and worker safety during consttuction activities, the project
will not have any environmental effects that will cause substantial, adverse effects on
human beings, either direcdy or indirectly.

building. A paiicing area for approximately 45 heavy vehicles is also proposed in the southernmost portion
of the parcel. Site developtncm will include grading, sewer,water and storm drain facilities,paving,
exterior lighting and landscape construction,security walls/feacing and gates. Also included is the
_ installation of a diesel-fueled gencrator for back-up power.
4n July 31, 200'7,the Board of Directors of the Coachells Valley Water Dishict approved the above
described pmject and made the following determinations:
1. Determined the project will not have a significant effect on the environment.
2. A Negative Declaration was prepared for this project pursuant to the provisions of CEQA.
3. Mitigation measures were not made a condition of the approval of the project.

1 BE IT RESOLVED by the Board of Directors of the Coachella Valley Water District
2 as.sembled in adjourned regular meeting this 31�day of July,2007, after independently
3 reviewing and analyzing the proceedings and recommendations of the District's Environmental
4 Assessment Committee, which independently reviewed and considered the DraR Negative
5 Declaration dated June 14,2007, for CVWD Palm Desert Administration Facility in accordance

Investigations should be summarized in the document. All sampling results in
which hazardous substances were found should be dearly summarized in a � .
table.
5) Proper Investigation, sampling and remedial actions overseen by the respective
� . regulatory agencies� 'rf necessary� should be conducted at the site prior to the

approval reports by these agencies should be induded in the ND.

7) If buildings ar other structures, asphalt or concrete-paved surtace areas are
� being planned to be demolished, an investiga�on should be conducted for the
presence of other related hazardous chemicals, lead-based paints o�products,
. mercury, and asbestos containing materials (ACMs). If other hazardous
chemicats, lead-based paints or products, mercury or ACMs.are identified, proper
precautions should be taken during demolition activities. Additionallj►� the �

8). The project construction may require soil excavation or filling in certain areas.
Sampling may be required. If soii is contaminated, it must be properly disposed
and not simply placed in another location onsite. Land Disposal Restrictions
(LDRs) may be applicable to such soils. Also, if the project proposes to import
soil to bac�ll the areas excavated, sampling should be conducted to ensure that
the imported soil is free of cantamination. �

GENERAL REQUIREMENTS
1. All landscape maintenance shall be performed by the property owner and the
applicant shall enter into a landscape maintenance agreement with the city for the
life of the project, consistent with the Property Maintenance Ordinance ( Ord.
801) and the approved landscaped plan.
2. A complete preliminary soils investigation, conducted by a registered soils
engineer, shall be submitted to, and approved by, the Department of Public
Works prior to the issuance of a grading permit.
BONDS AND FEES
3. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17
and 79-55, shall be paid prior to issuance of grading permit.
4. The project shall be subject to Transportation Uniform Mitigation Fees ( TUMF� .
Payment of said fees shall be at the time of building permit issuance.
5. A standard inspection fee shall be paid prior to issuance of grading permits.
6. Drainage fees, in accordance with Section 26.49 of the Palm Desert Municipal
Code shall be paid.prior to issuance of grading permits
DESIGN REQUIREMENTS
7. Storm drain design and construction shall be contingent upon a drainage study
prepared by a registered civil engineer that is reviewed and approved by the
Department of Public Works prior to start of construction.
8. Complete grading and improvement plans/specifications shall be submitted to the
Public Works Director for checking and approval prior to issuance of any permits.
9. Any and all offsite improvements shall be preceded by the approval of plans and
the issuance of valid encroachment permits by the Department of Public Works.
10. Pad elevations are subject to review and modification in accordance with Chapter
26 of the Palm Desert Municipal Code.

• 11. Landscape installation shall be drought tolerant in nature and in accordance with
the City_s Water Efficient Landscape Ordinance ( 24.04) .
12. Landscape plans shall be submitted for review concurrently with grading plans
and shall show all utility ( and vault) locations.
CONSTRUCTION REQUIREMENTS
13. Full public improvements, as required by Section 26 of the Palm Desert Municipal
Code, shall be installed in accordance with applicable City standards including:
� 6' curbside sidewalk on Beacon Hill and 6' meandering sidewalk, 4' back of curb,
on Hovley Lane.
• Rights-of-way necessary for the installation of the above referenced
improvements shall be dedicated to the city prior to the issuance of any permits
associated with this project.
14. All public and private improvements shall be inspected by the Department of
Public Works and a standard inspection fee shall be paid prior to issuance of
grading permits. No occupancy permit shall be granted until public improvements
have been completed.
15. Applicant shall comply with provisions of Palm Desert Municipal Code Section
24.12, Fugitive Dust Control as well as Section 24.20, Storm water Management
and Discharge Control.
16. Prior to the start of construction, the applicant shall submit satisfactory evidence
to the Director of Public Works of intended compliance with the National Pollutant
Discharge Elimination System ( NPDES) General Construction Permit for storm
water discharges associated with construction. Developer must contact Riverside
County Flood Control District for informational materials.
SPECIAL CONDITIONS
17. Parcel map(waiver) shall be required to alter lot line that extends through proposed

all architectural building elevations in detail. Any possible obstructions, shadows,
lighting, landscaping, backgrounds or other reasons that may render the building
address unreadable shall be addressed during the plan review process. You may

Mr. Swartz presented the project and summarized the staff report.
He stated that this project was reviewed a couple of months ago as
a miscellaneous item. The building was 52 feet in height and it has
since been reduced to 40 feet in height. He presented the
elevations and stated that this was without any landscaping. From
residential to building it will be 200 feet set back from property.
Commissioner DeLuna asked for the height on the two story
condominiums across the street. Mr. Swartz stated that it was
around 25 feet. Commissioner DeLuna wanted to know what the
continuity was of the 40 foot height with the other commercial
buildings around it. Mr. Swartz stated that it blends in with the
other commercial buildings and that the overall height of the zone,
Service Industrial is 35 feet. If they want it to be comparable to the

surrounding buildings in the area, we would want it around 35 feet
in height. Commissioner DeLuna asked what the percentage of
space was above the 35 feet. Mr. Swartz stated that the main
parapet is right at 30 feet so the percentage above the 35 feet was
minimal compared to the overall height. He suggested that they
could on certain tower elevations lower the pitch a little.
Commissioner DeLuna asked if this sits down below the street level
and how far. Mr. Swartz answered that it was three feet.
Commissioner Van Vliet stated that the height wasn't really an
issue; iYs a detached building and not right next door to anything.
Commissioner Vuksic asked how they were getting on the roof. Mr.
Phuc Tran, Architect, stated that there was a stairway and an
elevator up to the roof for maintenance purposes.
Commissioner Vuksic asked what the parapet heights were in
relation to the mechanical equipment. Mr. Tran answered that it
was about three or four feet. Commissioner Vuksic stated that he
was concerned with the west elevation. Mr. Tran stated that you
will see a little of the mechanical screen wal{ on the west elevation
facing Beacon Hill. Commissioner Vuksic stated that the screen
wall looks as high as the ridge of the main roof element and asked
if the mechanical equipment was that high. Mr. Tran stated that
with the mechanical curb it would be about seven to eight feet high.
The unit is six feet or so with the mechanical curb and then you
need room for flashing for the roof to come up so you would want at
least fourteen inches for mechanical curb. Commissioner Vuksic
asked if they could have more of a continuous element there that
connects the sloped roof elements. Looking at the west elevation
on the right side of it there is a nice hip roof and back from that is
the screen. He asked if there was some way they could run that
element across to continue it back from the hip to maintain those
lines.
Commissioner Vuksic stated that the windows were pretty close to
the surface of the walls. There was a lot of windows and he did not
see any shadow lines which is probably an accurate depiction. Mr.
Tran stated that they have a twelve inch CMU wall and where the
windows occur there would be eight inch CMU. The Commission
reviewed and discussed the shadow lines.
Commissioner Vuksic indicated that on the north elevation there
are a couple of roofs that have steeper pitches than the others. He
also pointed out another bigger one on the north elevation with a

steep roof and asked it was steeper. Mr. Tran said that that was
the original pitch and when they had to lower the building they had
to revise the pitch to a 40 foot high roof. Commissioner Vuksic
asked if it would hurt them to shallow the pitch of that element to
match the other pitches. Mr. Tran stated that they could take a look
at that but indicated that it was getting too squatty. The two roofs in
front will help make the building look less squatty. Commissioner
Gregory stated that it would show a lot more of the building surface
if they flattened the plan.
Commissioner Gregory asked if they were truncating the tower just
to maintain the maximum roof height and if so, he advised them not
to do that because it would look better if they didn't. Mr. Tran
agreed. Commissioner Gregory stated that penetrating the
maximum height with some type of architectural feature is a good
thing and makes a building more interesting, but trying to keep
everything below a certain height makes buildings less interesting.
Commissioner Van Vliet asked if there were two huge air handlers
on the roof; was it one big system and how was it controlled. Mr.
Tran stated that there would be one for the first floor and one for
the second floor. It is a water cooler system with a mechanical
closure at grade level that feeds the water to the air handlers.
Commissioner Vuksic stated that he wanted to move the project
forward and as far as screening the mechanical equipment he
asked if staff would review the applicanYs solution.
Mr. Levine stated that the way the staff report was written up it only
talks about the building and architecture and what they were
looking for was landscaping as well. He indicated that Mr. Spencer
Knight, Landscape Manager had talked with Ms. Diane Hollinger,
Landscape Specialist, and that she could comment on that. Ms.
Hollinger stated that they have been working with the landscape
architect on the design and they have come in and made some
changes that we have suggested and we are fine with those
changes at this stage. Mr. Swartz handed out copies of the
landscape plans and the Commission reviewed them.

Commissioner Vuksic made the motion to approve with the
condition that the applicants restudy the screening of the
mechanical equipment creating an architectural feature that
connects some of the other hip roof forms and reviewed by staff,
and that the elevator tower be allowed to come to a point rather
than being truncated.

It was moved by Commissioner Vuksic and seconded by Commissioner
DeLuna, to grant preliminary approval of architecture and landscaping
subject to: 1) a restudy of the mechanical equipment screening to create
