Waive further reading and adopt:
1. Resolution No. 08-37 initiating proceedings for the formation of Silver
Spur Ranch Landscaping and Lighting District, the concurrent annexation
and consolidation of said district into the Palm Desert Consolidated
Landscaping and Lighting District as Zone 17; and the levy and collection
of assessments related thereto commencing with fiscal year 2008/2009
and;
2. Resolution no. 08-38 declaring its intention to form Silver Spur Ranch
Landscaping and Lighting District, concurrently annex and consolidate
said district into the Palm Desert Consolidated Landscaping and Lighting
District as Zone 17; and declaring its intention to conduct a property owner
balloting on the matter of assessments related thereto commencing with
fiscal year 2008/2009
BACKGROUND:
The Silver Spur Rancher Association is requesting funding the medians and traffic circle
of Silver Spur Trail by means of a Landscape and Lighting Assessment District, instead
of the current Homeowners Association (HOA) financing mechanism.

The 233 Silver Spur property owners are currently assessed $100 per year; however,
there is very limited interest in serving on the HOA Board. The existing Board's only
option is to retain a management company to oversee administration of landscape
maintenance. The Board estimates that this action will increase their existing dues from
$100 to $254 per year. The option that the Board and many residents prefer is to form
a landscape and lighting assessment district. The preliminary engineers report for the
proposed district sets the maximum assessment of $85.00 per year plus an annual cost
of living increase at a maximum of 3%.
The attached resolutions initiate the process to establish the assessment district and
allow the property owners to vote on the formation. Staff will return to Council at its
regular meeting of July 10, 2008 with the results of the vote.
Staff recommends the City Council adopt the resolutions to initiate the formation of the
district.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, INITIATING PROCEEDINGS FOR THE FORMATION OF
SILVER SPUR RANCH LANDSCAPING AND LIGHTING DISTRICT, THE
CONCURRENT ANNEXATION AND CONSOLIDATION OF SAID DISTRICT

LIGHTING DISTRICT AS ZONE 17; AND THE LEVY AND COLLECTION OF
ASSESSMENTS RELATED THERETO COMMENCING WITH FISCAL YEAR
2008/2009
The City Council of the City of Palm Desert (hereafter referred to as the "City Council") does
resolve as follows:
WHEREAS, the City Council, pursuant to the provisions of the Landscaping and
Lighting Act of 1972, Part 2, Division 15 of the California Streets and Highways Code (commencing with
Section 22300) (hereafter referred to as the "Act"), desires to initiate proceedings for the
formation of "Silver Spur Ranch Landscaping and Lighting District" (hereafter referred to
as "District"), and to levy and collect annual assessments to pay for the ongoing operation,
maintenance and servicing of landscape improvements, and appurtenant facilities related
thereto; and per Chapter 2, Article 2 of the Act, concurrently annex and consolidate said District
into the "Palm Desert Consolidated Landscaping and Lighting District" (hereafter referred to as
the "Consolidated District") as Zone No. 17 ("hereafter referred to as Zone 17"); and,
WHEREAS, the City has retained Munih'inancial as the Engineer of Work, for the
purpose of assisting with the formation of the District, the establishment of annual assessments,
and to prepare and file an Engineer's Report with the City Clerk pursuant to the provisions of
Chapter 4 Article 2 of the Act and in accordance with the California Constitution Article XIIID
(hereafter referred to as the "Constitution").
NOW, THEREFORE BE IT RESOLVED, by the City Council for the district,
pursuant to Chapter 2, Article 1, Section 22585 of the Act, as follows:
Section 1 The foregoing recitals are true and correct.
Section 2 The City Council hereby orders the Engineer of Work to prepare the
Engineer's Report concerning the formation of Silver Spur Ranch Landscaping and
Lighting District and the concurrent annexation of said District and territories to the
Consolidated District as Zone 17, and the levy of special benefit assessments for
properties therein; and
Section 3 The proposed improvements for the District and subsequently Zone 17
of the Consolidated District generally include, but are not limited to the median islands
that extend the length of Silver Spur Trail (Portola Avenue to the end of Silver Spur
Trail), a distance of approximately 2,475 linear feet. These improvements may include
but is not limited to ground cover, shrubs, trees, plants, irrigation and drainage systems,
ornamental lighting, walls or other fencing, entryway monuments and facilities, and
associated appurtenant facilities. The maintenance of the District improvements
generally includes, but is not limited to, all materials, equipment, utilities, labor and
incidental expenses including administrative expenses for annual operation of the
District as well as the performance of periodic repairs, replacement and rehabilitation

activities (available funding permitting) that are associated with those improvements.
Documentation and maps of the location and extent of the improvements to be
maintained by the District arc on file at the City of Palm Springs Public Works
Depainuent and by reference are made part of this Resolution.
Section 4 The territory within this District and subsequently Zone 17 of the
Consolidated District is located in the southwestern portion of the City, west and north
of Portola Avenue and generally south of Haystack Road, and east of Alamo Drive,
Chia Drive and Arrow Trail. The District includes the lots and parcels of land identified
as:
• Silver Spur Ranch Units No. 1, 2, 3 and 5 consisting of two hundred seventeen
(217) residential lots and three (3) exempt utility/casement parcels; and,
• Tract 2298 consisting of fifteen (15) residential lots on Feather Trail; and,
• Two residential lots at the end of Feather Trail that arc designated as a portion of
Tract 2521; and,
• Four residential lots located at the southwest end of Silver Spur Trail that are
designated as a portion of Tract 5553; and,
• Five residential lots and two exempt utility/easement parcels located on the north
side of Silver Spur Trail between Sun Corral Trail and Portola Avenue (These
parcels are generally considered to be part of Silver Spur Ranch Unit No. 1, but
were not included as part of the original tract map for that development).

The Ciry Council of the Ciry of Palm llesert (hereafter referred to as the "Ciry Council")
does resolve as follows:

said District and territory of land therein as lone 17 within thc I'alm Desert Consolidated
Landscaping and Lighting District (hereafter referred to as the "Consolidated District"); and
the proposed levy and collection of annual assessments related thereto;and,
WHEREAS, the City Council desires to form the llistrict; to concurrendy annex,
consolidate said llistrict and territory into the Consolidated District as Lone 17; and to levy
and collect annual assessments against lots and parcels of land therein to pay the cost and
expenses related to the maintenance, servicing and operation of improvements that provide
special benefits to the parcels therein pursuant to the Act and the provisions of the Cal fornia
Con�titution�rticle XIIID (hereaftcr referred to as thc "Constiturion");and,
WHEREAS, the ��ssessment �nginecr of Work has prepared and filcd with the City
Clerk an Engineer's Report (hereafter referred to as the "Report") in connection with such
proceedings for the formation of the District; the concurrent establishment of the llistrict as
Lone 17 within the Consolidated District, and the proposed levy of assessments related thereto
commencing�vith fiscal year 2008/2009 (Beginning July 1, 2008 and ending June 30, 2009); in
accordance with the rlct and the Constitution; and said Report has been presented to the City
Council.
NOW, THEREFORE BE IT RESOLVED, by the Ciry Council for the district,
pursuant to Chapter 2, Article 1,Secdon 22587 of the Act,as follows:

Section 2 The Report as presented consists of the following:

Parcel I�;umber within the District and subsequendy as "Lone 17 of the

maximum assessment rate and method of apportionment described therein;and,
Section 3 The Report presented is hereby approved on a preliminary basis as
submitted or amended by direction of this City Council, and is herby ordered to be
filed in the Office of the City Clerk as a permanent record and to remain open to
public inspection;and,
Seetion 4 The City Council hereby declares its intention to establish the District
designated as "Siber Spur Ranch Landscaping and Lighting District"; to
concurrendy annex and consolidate said District and territory as Lone 17 within the
Consolidated llistrict, and to le�ry and collect annual assessments against parcels of
land therein to fund the ongoing cost and expenses of maintauiuig, operating and
ser�ricing the improvements as outlined in the Report prepared in connecrion
therewith, commencing with fiscal year 2008/2009;and,
The City Council fi�rther declares its intendon to conduct a public hearing rcgarding
the formation of the I�istrict; and the proposed levy of assessments connected
therewith; and calls for a property owner protest balloring proceeding in accordance
with the pro�risions of the California Constitution :�rticle XIIID. The City Council
finds that the public's best interest requires such action and le�ry of assessments;and,

Section 7 The City Council hereby deternzines that in order to provide an
appropriate level of maintenance and related services and activiries for the
improvements associated with the District, as generally described in Section G of this
Resolution, it is necessary to levy annual assessments against lots and parcels within
said territory commencing in fiscal year 2008/2009. "111e Report referred to in Section 2
of this Resolution establishes the estimated budget of anricipated expenses and the
resulting ma:�imum assessments including an annual inflationary adjustment;and,
Seetion 8 The City Council hereby declares its intention to conduct a public
hearing concenung the levy of assessments for the District,in accordance with the Act;
Government Code, Section 549�4.G; and California Constitution, :lrticle �IIID,
Scction 4(e);and,
Notice is hereby given that a public hearing on these matters will be held by the City
Council on Thursday,July 10, 2008 at 4:00 P.�1., or as soon thereafter as feasible in the
Cit�- Council Chambers, located at 73-510 Fred Waring Drive, Palm Desert, California.
At the Public Hearing, all interested persons shall be afforded the opportuiury to hear
and bc heard;and,
Section 9 1'ursuant to �rticle XIIIll of the California Constitution, an
assessment ballot proceeciing is hereby called on the matter of confirniuig the
proposed assessments for the District and subsequendy as %one 17 of the
Consolidated llistrict. The Ciry Council hereby authorizes and directs rhe C:iry Clerk or
their designee to prepare and mail norice of the Public Hearing and properry owner
protest ballots to the property owners of record regarding the proposed assessments
including the assessment range formula as outlined in the Report, for retum receipt
prior to the date and time of the public hcaring set forth in this Resolution;and,
The notice of the hearing and ballot shall be ciistributed by first class mail to the
property owner of record for each parcel within the proposed District subject to an
assessment, not less than 45 days before the date of thc public hcaring pursuant to
California Constitution,Articic�iIIID;and,

Seetion 10 The property owner protest ballot proceeding conducted for the
District shall consutute the property owners' approval or rejecrion of the annual le�ry of
assessments and assessmcnt range formula describcd in the Report presented and
pre��iously approved by the City Council. Each propert�� owner may return the ballot
by mail or in person to the City Clerk no later than the conclusion of the public hearing
scheduled for'1liursday,July 10, 2008. r�fter the close of the Public Hearing, pursuant
to Secdon 4 (e) of the Califomia Consriturion, tl�►e City Clerk or their designee shall
open and tabulate the ballots rcturned to detern�ine if majoriry protest exits. Only those
ballots issucd by or on behalf of the City� and signed by the property owner of rccord
or authorized representative, shall be considered as valid ballots and shall be weighted
according to the proportional financial obligation of each affected property. �lajoriry
protest exists if, upon the conclusion of the hcaring, valid ballots submitted in
opposition to the assessment exceed nc� ballots submitted in favor of thc assessment;
and,
In addition to the ballot proceedings, property o�vners may also file a separate written
protest with the City Clerk prior to the conclusion of the hearing, or having previously
filed such protest, may file a writtcn withdrawal of that protest. r1 written protest shall
state all grounds of objecrion and shall contain a description sufficient to identify the
property owned by such property owner. At the public hearing, all interested persons
shall be afforded the opportunity to hear and be heard; and,

This Report and the enclosed budget, assessments, diagram and descriptions outline the proposed
formation of Silver Spur Ranch Landscaping and Lighting District, that includes each lot and parcel
of land within said District, as the same existed at the time this Report was prepared. Reference is
hereby made to the Riverside County Assessor's Parcel Maps for a detailed description of the lines
and dimensions of each lot and patcel within the District. Upon successful foYmation, the District
and the parcels therein shall be concurrently annexed and consolidated into the Consolidated Palm
Desert Landscaping and Lighting District as Zone 17. The undersigned respectfully submits the
enclosed Report as directed by the City Council of the City of Palm Desert.

Introduction
Pursuant to the ptovisions of the Land,rcape and I�ighting Act of�972, l�eing Part 2 of Divi.rion 15 of tl�e
California Streets and Highways Code, commencing zvith Section 22500 (hereafteY referYed to as the "1972
Act"), and in compliance with the substantive and proceduYal Yequirements of 1�rticle XIIID of t6�e
California State Constitution (hereafter referYed to as the "California Constitution"), the City Council of
the City of Palm Desert, County of Riverside, State of California (heYeafteY referred to as "City"),
propose to form a special benefit assessment district designated as:
City of Palm Desert
Silver Spur Ranch Landscaping and Lighting District
(hereafter referred to as "District"),which includes the lots and parcels of land within the residential
development known as Silver Spur Ranch Unit No.'s 1, 2, 3 and 5 (hereafter referred to collectively
as "Silver Spur Ranch"); and certain various lots and parcels that utilize Silver Spur Trail (the
location of the improvements) to access such property. Upon successful formation of said District,
the development and properties described herein shall concurrendy be annexed and consolidated as
Zone No. 17 (hereafter referred to as "Zone 17") within the Consolidated Palm Desert
Landscaping and Lighting District (hereafter referred to as "Consolidated District"). This
Engineer's Report (hereafter referred to as "Report") has been prepared in connection with the
formation of said District and the levy and collection of annual assessments related thereto as
required pursuant to Cbapter 9, Artzcle 4 of the 1972 Act, and in connection with the concurYent
annexation and consolidation of said District to the Consolidated District pursuant to Cbapter 2,
Article 2 of the 1972 Act.
The Ciry Council proposes to form the District; concurrently annex said District to the Consolidated
District; and to levy and collect annual assessments on the County tax rolls to provide ongoing
funding for the costs and expenses required to service and maintain the local landscape
improvements for which the properties within the District receive special benefits. The
improvements to be maintained were originally installed and constructed as part of the Silver Spur
Ranch developments and have been maintained and funded through the e�sting Silver Spur Ranch
Homeowners Association (HOA). Although these unprovements have historically been maintained
and funded through the HOA, over the years this has become the only remaining function of the
association. Therefore, the association has requested that the City form this District to take over
those responsibiliues which would allow the HOA to be disbanded. However, because these
improvements are also directly associated with some adjacent residenual parcels that were developed
subsequent to the Silver Spur Ranch development, the proposed District includes some parcels that
were not part of the original Silver Spur Ranch development.
This Report descYibes the District, the impYovements, and the proposed assessments to be levied
against properties in connection with the special benefits the properties will receive from the
maintenance and servicing of the Disttict improvements. The formation of this District and the
annual assessments to be levied on properties within the District and subsequently as Zone 17 of the
Consolidated District,will provide a funding source for the continued operation and maintenance of
local landscape improvements for the special benefit of properties to be assessed.

The word"parcel," for the purposes of this Report,refers to an individual property assigned its own
1�ssessor's Parcel Number (APN) by the Rivetside County Assessoi's Office. The Riverside County
Auditor/Controller uses Assessor's Parcel NumbeYs and specific Fund Numbers to identify
properries to be assessed on the tax roll for the special benefit assessments.
Pursuant to the provisions of Article XIIID, Section 4 of the California Constitution the City shall
conduct a property owner protest ballot proceeding (referred to as "Ballot Proceeding") for the
proposed levy of the new assessments as described in this Report. In conjunction with this Ballot
Proceeding, the City Council will conduct a noticed public hearing to consider public testimonies,
comments and written protests regaYding the formarion of the District, the establishment of the
District as Zone 17, and the levy of the proposed new assessments. Upon conclusion of the public
hearing, pYopeYty owner protest ballots received will be opened and tabulated to determine whether
majoriry protest exists:

After complerion of the ballot tabulation, the City Council will confirm the results of the balloring.
If majority protest exists, proceedings for the formation of the District and levy of assessments shall
be abandoned. If tabulation of the ballots indicates that majority protest does not exist for the
assessments and the assessment range formula presented and described herein, the Ciry Council
may: approve this Report, as submitted or amended; order the formarion of the District and the
concurrent annexation of the District to the Consolidated District as Zone 17; approve the
assessment diagram contained herein; order the improvements to be made; and confirm and order
the levy and collecuon of assessments. In such case, the assessments for fiscal year 2008/2009 as
approved or amended by the City Council shall be submitted to the Riverside County
Auditor/Controller for inclusion on the property tax roll for each affected parcel.
Each subsequent fiscal year, an engineer's report for the Consolidated District shall be prepared and
presented to the City Council to address any proposed changes to any of the Zones within the
Consolidated District, including Zone 17, as well as any proposed changes to the improvements,
budgets and assessments for that fiscal year. The Ciry Council shall hold a noticed public hearing
regarding these matters prior to approving and ordering the levy of assessments. At the discreuon of
the City Council, a separate engineer's report for this District may be prepared and presented, but
such a report is not required if the improvements, budgets and assessments for this District are
included in the engineer's report for the Consolidated District.

Overview of the Consolidated District
In general, the Consolidated District provides for the continued maintenance, servicing,
administration and operation of specific landscaping and lighting improvements and associated
appurtenances for each of the thirteen (13) Zones (Zones 02 through 09; 11; and 13 through 16) of
which 7ones 05, 06 and 16 are further divided into Subzones (Currently a total of 33 Zones and
Subzones).
Most of the Zones and Subzones within the Consolidated District were originally established in
connection with the development of properties within those Zones or Subzones to fund the
improvements installed in connection with those developments. The City provides for the annual
maintenance, servicing, and administration of the Consolidated District and improvements through
the annual levy of special benefit assessments for each of the various Zones and Subzones. The
assessment revenue collected in each respective Zone and/or Subzone funds only the improvements
and costs of that Zone and/or Subzone.
Description of the Proposed District
The territory within this District and subsequently Zone 17 of the Consolidated District is located in
the southwestern portion of the City, west and north of Portola Avenue and generally south of
Haystack Road, and east of Alamo Drive, Chia Drive and Arrow Trail. The District includes the lots
and parcels of land identified as:
• Silver Spur Ranch Units No. 1, 2, 3 and 5 consisting of two hundred seventeen (217) residential
lots and three (3) exempt utility/easement parcels; and,
• Tract 2298 consisting of fifteen (15) residential lots on Feather TYail; and,
• Two residential lots at the end of Feather Trail that are designated as a portion of Tract 2521;
and,
• Four residential lots located at the southwest end of Silver Spur Trail that are designated as a
portion of Tract 5553;and,
• Five residential lots and two exempt utility/easement parcels located on the north side of Silver
Spur Trail between Sun Corral Trail and Portola Avenue (These parcels are generally considered
to be part of Silver Spur Ranch Unit No. 1, but were not included as part of the original tract
map for that development).

which are necessary or convenient for the maintenance or servicing thereof;
5) The installation of park or recreational improvements, including, but not limited to, all of the
following:
a) Land preparation, such as grading, leveling, cutting and filling, sod, landscaping, irrigation
systems, sidewalks, and drainage.
b) Lights, playground equipment,play courts, and public restrooms.
6) The acquisition of land for park, recreational, or open-space purposes or any existing
improvement otherwise authorized pursuant to this section.
7) The maintenance or servicing, of any of the foregoing including the furnishing of services and
materials for the ordinary and usual maintenance, operation, and servicing of any improvement
including but not limited to:
a) Repair,removal, or replacement of all or any part of any improvements;
b) Grading, clearing, removal of debris, the installation or construction of curbs, gutters, walls,
sidewalks, or paving, or water,irrigation, drainage, or electrical facilities;

Description of the District Improvements
The purpose of this District is to ensure the ongoing maintenance, operation and servicing of local
landscape improvements that benefit properries within the District that wexe established oY installed
in connection �vith development of residential properties within Silver Spur Ranch. The
improvements installed as part of this development shall be maintained and funded entirely through
the District assessments.
The unprovements to be maintained are located within the median islands that extend the length of
Silver Spur Trail (Portola Avenue to the end of Silver Spur Trail), a distance of appro�mately 2,475
linear feet These improvements may include but is not limited to ground cover, shrubs, trees,
plants, irrigation and drainage systems, ornamental lighting, walls or other fencing, entryway
monuments and faciliries, and associated appurtenant facilities. The maintenance of the District
improvements generally includes, but is not limited to, all materials, equipment, uulities, labor and
incidental expenses including administrative expenses foY annual operarion of the District as well as
the performance of periodic repairs, replacement and rehabilitation activities (available funding
permitting) that aYe associated with those impxovements. Documentation and maps of the location
and extent of the improvements to be maintained by the District are on file at the City of Palm
Springs Public Works Department and by reference are made part of this Report.

Excluded Improvements
Although the District may maintain the ornamental landscape lighting within the median islands
(low voltage lighting),it is not ptoposed that this Distiict will fund or provided for the maintenance
and operation of the street lights within the boundaries of this District. However, the maintenance
and operation of the street lights could be incorpoYated into the District impxovements at a latter
date provide the property owners approve a new or increased assessment to support the cost of
those improvements.
Similarly, although the District will fund and maintain the landscaped areas within the median
islands on Silver Spux Trail including the entryway area at Portola Avenue and the turnabout
(median circle) at the intersection of Si1veY Spux Trail, Buckboard Trail and L.ittle Bend TYail, the
District does not fund or maintain any of the landscaped parkways along Silver Spur Trail. These
areas are privately owned and to be maintained by each respective properry owner including the two
pYivately owned landscape circles on the southwest side of SilveY Spur TYail just south of Riata Trail.
The estimated annual cost to provide and maintain the unprovements within the District shall be
allocated to each pYopeYty in proporrion to the special benefits received. The Method of
Apportionment described in this Report urilizes commonly accepted assessment engineering
practices and has been established pursuant to the 1972 r,ct and the provisions of the California

providing certain public impYovements,which includes the construction, maintenance, and servicing
of public lights, landscaping, paYks and appurtenant facilities. "lhe 1972 Act fi�thex requires that the

The method of apportionment described in this Report for allocation of special benefit assessments
utilizes commonly accepted engineering practices and have been established pursuant to the 1972
Act and the provisions of the California Constitution. The formula used for calculating assessments
in this District and each Zone of the Consolidated District reflect the composition of the parcels,
and the impYovements and services provided, to fairly apportion the costs based on benefit to each
parcel.
Benefit Analysis
Each of the proposed improvements, the associated costs, and assessments have been carefully
reviewed, identified and allocated based on special benefit pursuant to the provisions of the 1972
r,ct and the California Constitution. The improvements to be provided by this District and for
which properties will be assessed have been identified as necessary, desired or required for the
orderly development of properties within the District to their fullest potenual, consistent with the
development plans and applicable portions of the City's General Plan. As such, the ongoing
operation, servicing and maintenance of these improvements have historically been funded by most
of the property owners within the proposed District (namely Silver Spur Ranch) through their
Homeowners Association dues. Therefore, it is reasonable to conclude that the annual costs of
ensuring the maintenance and operation of the impYovements are considexed a disrinct and special
benefit to the Yesidential properties within Silver Spur Ranch, but also to the subsequent residential
developments that are directly related to those improvements.
The method of apportionment (also referred to as the "method of assessment") established herein is
based on the premise that each assessed parcel within the District receives special benefits from the
improvements, and the desirability and security of those properties is enhanced by said
improvements, including the presence of street lighting and well-maintained landscaping in close
pro�mity to the propeYties within the District As defined b� Article XIIID, Section 4 of the
California Constitution:
"Special l�enefit mean.r aparticular and distinct benefit over and above general benefit.r conferred on real
property located in the Di.rtrict or to the public at large."

Special Benefit
The special bcnefits associated with landscape improvements are specifically:
• Enhanced desirability of pYoperties through association with the improvements;
• Improved aesthetic appeal of propeYties providing a positive representation of the area;
• Enhanced adaptation of the urban environment within the natural environment froin
adequate gYeen space and landscaping;
• Environmental enhancement through improved eYosion resistance, dust and debris contYol;
• Increased sense of pride in ownership of property within the Consolidated District and
DistYict resulting from well-maintained improvements associated with the properties;
• Reduced criminal activity and properry-related crimes (especially vandalism) against
properties through well-maintained surroundings and amenities including abatement of
graffiti; and
• Enhanced environmental quality of the parcels by moderating temperatures, providing
ox��genation and attenuating noise.
The preceding benefits collectively contribute to the overall aesthetic value and desirability of each
of the assessed parcels and thereby provide a special enhancement to those properties. Furthermore,
it has been determined that the lack of funding to properly service and maintain the improvements
would likely have a direct negative impact on those properties.
General Benefit
In reviewing the improvements and the proximity of those improvements to properties within the
proposed District as well as adjacent properties outside of the boundaries of the District, and the
reasons for installing and constructing such improvements;it is apparent that the need to maintain these
particular improvements are exclusively a local issue and are associated with only the parcels within this
District, and the condirion of these improvements and the level of service provided will direcdy affect
only those properries.
Although the improvements are within public areas ox easements that may be available or visible to
the public at large, these improvements are not necessarily required nor desired by any properties or
developments outside the proposed District. As such, it has been determined that these
improvements provide no measurable benefit (special or general) to properties outside the District
or to the public at large, but are clearly a distinct and special benefit to only properties within the
District.
Assessment Methodology
Upon review of the proposed improvements, it has been determined that each of the residential
parcels within the District will receive substantially similar and proportional special benefits from the
overall improvements to be provided. As such, a single zone of benefit utilizing the Equivalent
Benefit Unit (hereafter referred to as the "EBU") method of apportionment, which was previously

or paYcel within this District and subsequently as Zone 17 of the Consolidated District This E13U
method of apportionment uses the single-family home site as the basic unit of assessment with each
individual single-fatnily residenrial property being assigned one (1.00) EBU. All other land uses are
assigned a proportionately weighted EBU based on an assessment formula that equates the
property's specific development status, type of development (collectively referYed to as "land use"),
and pYopeYty size as compared to a single-family home site.
The EBU method of appoYtioning benefit is rypically viewed as one of the most appropriate and
equitable assessment methodologies for distYicts formed under the 1972 Act, as the benefit to each
parcel from the improvements are apportioned as a function of various components, including land
use rype, size and development. Each parcel within the Consolidated District and this District is
assigned a land-use classification based on available parcel infoYmation obtained from the County
Assessor's OfEice and City tecords and is assigned a calculated EBU based on that parcel
information.

Annual Infiationary Adjustment
It is recognized that most costs associated with the maintenance and operation of public
improvements will ultimately be impacted by inflation in subsequent years. In an effort to minimize
this impact, a formula for an inflation adjustment has been incorpoYated and included as part of the
approved assessments for the various Zones and Subzones of the Consolidated Palm Desert
Landscaping and Lighting District. This previously adopted inflauonary formula is described below
and will be applied and continued as part of the proposed assessment and annual inflationary
adjustment for the Silver Spur Ranch Landscaping and Lighting District that will be presented to
properry owners of record for approval commencing in fiscal year 2008/2009 prior to the
imposition of such an assessment and inflationary formula.
New or increased assessments require certain noticing, meeting, and balloting requirements.
However, Government Code Section 54954.6(a) provides that a "neav or increa.red as.res.rment" does not
include "an a.r.re.r.rment zvhich doe,c not exceed an ae�.re.r.rment formula or range of as.res.rment.r..previou.rly adapted by
the agency or approved by the voter.r in the area avhere the a.r.re.rsment i.c impo.red." This definition of an increased
assessment was later confirmed by Senate Bill 919 (the Implementing Legislation for Proposition
218).
The Consolidated District and its Zone and/or Subzone assessments include a formula for
increasing assessments for each future fiscal year to offset increases in costs due to inflation. This
assessment adjustrnent formula complies with the above referenced Government Code Section and
was approved by the City Council and the property owners within the various Zones and Subzones
of the Consolidated District. This same formula is proposed to be applied to the Silver Spur Ranch
Landscaping and Lighting District and is described below:
The ma�mum assessment amount allowed for each fiscal year shall be increased in an amount equal
to the lesser of: (1) three percent (3.0%), or (2) the annual percentage increase of the Local
Consumer Price Index (CPI) for "All Urban Consumers" for the Los Angeles-Riverside-0range
Counry Area.
Each fiscal year the City shall identify the percentage difference between the CPI on January 1 of
each year and CPI for the previous January 1 (or similar time period). This percentage difference
shall then establish the range of increased assessments allowed based on CPI. Should the Bureau of
Labor Statistics revise such index or discontinue the preparation of such index, the City shall use the
revised index or comparable system as approved by the City Council for determining fluctuations in
the cost of living.
The fact that an assessment range formula is adopted for the Consolidated District and this
District's assessments does not require that the adjustment be applied each year, nor does it restrict
the assessments to the adjustment amount. In the event that the Ciry Council determines that an
inflation adjustment is not required for a given fiscal yeaY, the City Council may authorize the
assessment without applying the adjustment formula to the amount levied. If the budget and
assessments require an increase greater than the adjustment set forth in the formula, then the
proposed increase would be subject to approval by the property owners. Each fiscal year, the
maximum assessment rate shall increase at the maximum amount allowable regardless of whether or
not the incYease is levied to the parcels within the District.

Part V Assessment Roll
Parcel identificarion, for each lot or parcel within the District and subsequendy Zone 17 of the
Consolidated District, shall be the parcel as shown on the Riverside County Assessor Parcel Maps
and the Riverside CountS� Secured Tax Roll for that fiscal year. The proposed assessment for each
paYcel has been filed with the City Clerk and have been calculated in accordance with the assessment
rate presented in the budget and the method of apportionment described in this Report.
Non-assessable lots or parcels may include government owned land; public utility owned property,
land principally encumbered with public right-of-ways or easements and dedicated common areas.
The assessment information for each parcel as outlined in this Report and confirmed by the City
Council, shall be incorporated into the annual Engineer's Report for the Consolidated District and
submitted to the County Auditor/Controller along with all other Consolidated District assessments
after the Consolidated District's annual Public Hearing to be included on the properry tax roll for
Fiscal Year 2008/2009. If the parcels or assessment numbers referenced by this Report are re-
numbered, re-apporuoned or changed by the County Assessor's Office after approval of this
Report, the new parcel or assessment numbers with the appropriate assessment amount will be
submitted to the County Auditor/Controller.
