Resolution No.08-35 initiating proceedings for a proposed new or increased assessment for zone 05 - sandcastles of the palm desert consolidated landscaping and lighting district; commencing with fiscal year 2008/2009 2. Resolution No. 08-36 declaring its intention to add landscape improvements to zone 05 - sandcastles of the palm desert consolidated landscaping and lighting district; and declaring its intention to conduct a property owner balloting on the matter of a new or increased assessment related thereto commencing with fiscal year 2008/2009 BACKGROUND: Staff has received numerous complaints on the condition of the landscaping perimeter at the Sandcastles neighborhood. The current Sandcastles Assessment District consists of 41 single-family units formed while under Riverside County's jurisdiction and only maintains street lighting (no landscape maintenance provided). The City of Palm Desert annexed this area in 1989 and the District's administration was transferred from the County to the City. The City did not install the existing landscaping at this area or ever have a water meter to service it. This landscaping was most likely provided, irrigated, and maintained by a resident who may no longer reside within this neighborhood. Therefore, the City currently does not provide any maintenance or utilities at this location. The City owns the landscaping areas and the Property Maintenance Ordinance does not require property owners to maintain areas they do not directly have frontage on. Staff brought this issue before the City Council on January 12, 2006, and presented the following three options: Option No. 1: Leave the landscape perimeter as is and have the City provide periodic maintenance. Option No. 2: Renovate the perimeter to a drought tolerant design that includes decomposed granite and boulders, while retaining the existing palm trees. Option No.3: Propose a modification to the assessment district levy to include the maintenance and utility cost of the perimeter landscaping. The City Council unanimously approved staff's recommendation of Option No. 3. Staff sent out an informal resident survey to determine if a majority of the residents favor the aforementioned modification to their assessment district. If the survey results were positive, staff would return to the City Council for authorization to proceed with the district balloting processing and subsequent renovation. The survey response was as follows: Yes 36.59% No 21.95% Unresponsive 41.46% As fewer than 50% of survey results were positive, the balloting did not proceed and no further action was taken concerning this matter. However, almost half of those balloted did not return a response. Orte'ga City Manager RESOLUTION NO. 08-35 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, INITIATING PROCEEDINGS FOR A PROPOSED NEW OR INCREASED ASSESSMENT FOR ZONE 05 — SANDCASTLES OF THE PALM DESERT CONSOLIDATED LANDSCAPING AND LIGHTING DISTRICT; COMMENCING WITH FISCAL YEAR 2008/2009 The City Council of the City of Palm Desert (hereafter referred to as the "City Council") does resolve as follows: WHEREAS, the City Council, pursuant to the provisions of the Landscaping and Lighting Act of 1972, Part 2, Division 15 of the California Streets and l lighways Code (commencing with Section 22500) (hereafter referred to as the "Act"), desires to initiate proceedings for a proposed assessment increase (new maximum assessment) for " Zone 05 — Sandcastles of the Consolidated Palm Desert Landscaping and Lighting District" (hereafter referred to as "Sandcastle Zone"), and to levy and collect annual assessments to pay for the ongoing operation, maintenance and servicing of the existing lighting improvements; new landscape improvements, and appurtenant facilities related thereto; and, WHEREAS, the City has retained MuniFinancial as the Engineer of Work, for the purpose of assisting with the establishment of a proposed new maximum assessment for the Sandcastle Zone, and to prepare and file an Engineer's Report with the City Clerk pursuant to the provisions of Chapter 4 Article 2 of the Act and in accordance with the California Constitution Article XIIID (hereafter referred to as the "Constitution"). NOW, THEREFORE BE IT RESOLVED, by the City Council for the district, pursuant to Chapter 2, Article 1, Section 22585 of the Act, as follows: Section 1 The foregoing recitals are true and correct. Section 2 The City Council hereby orders the Engineer of Work to prepare the Engineer's Report concerning the proposed addition of new improvements and assessment increase related thereto for the special benefit of properties within the Sandcasde Zone of the Consolidated District; and Section 3 The proposed improvements for the Sandcastle Zone generally include, but are not limited to the materials, equipment, utilities, labor and incidental expenses including administrative expenses required for the annual operation, as well as the performance of periodic repairs, replacement and expanded maintenance activities as needed to provide for the proper operation and functioning of the existing street light improvements as well as the growth, health, and beauty of the landscaped areas proposed to be maintained. The proposed improvements for the Sandcastles Zone include: • The existing local street lighting improvements associated with Tract 21338-1 including eleven (11) street lights located on or near Hovley Lane East; Carlotta Drive; Easy Street; Dolmar Court; Duval Court; and Sandcastle Lane. • The proposed addition of approximately 2,945 square feet of landscape areas that may include shrubs, plants; trees; ground cover; irrigation system; sidewalks, 1 RESOLUTION NO. 08-35 fencing; monuments or other ornamental structures; and associated appurtenant facilities associated with Tract 21338-1 including: Approximately 1,560 square feet of irrigated landscaping on the north side of Hovley Lane East, east of Carlotta Drive to the eastern boundary of Tract 21338-1; and Approximately 1,385 square feet of irrigated landscaping and trees on the east side of Carlotta Drive, between Hovley Lane East and Easy Street. Section 4 The territory within the Sandcastles Zone of the Consolidated District is located in the central portion of the City, north of Hovley Lane East and generally south of Country Club Drive and Sandcastle Lane, and west of Eldorado Drive and Harrison Drive, and west of Carlotta Drive. The District includes the lots and parcels of land identified as Tract 21338-1 (Sandcastles), which includes forty-one single family residential properties. The parcels of land that comprise the Sandcastles development are identified on the Riverside County Assessor's Parcel Maps as Book 655, Page 36: Parcels 632-361 (001 through 039); and 632-362 (001 and 002).
