Recommendation:
By Minute Motion:
1. Direct staff regarding the undergrounding of utilities along the east
side of Portola Avenue between Fred Waring Drive and Desert Star
Boulevard.
2. Award the Contract No. 27690 to David Evans and Associates in the
amount of $63,880.00 for the design of the sidewalk and aesthetic
improvements on northbound Portola Avenue between Fred Waring
Drive and Desert Star Boulevard.
3. Authorize the Mayor to execute the same.
Background and Discussion:
There currently exists a six-foot sidewalk adjacent to the curb on northbound Portola
Avenue between Fred Waring Drive and Desert Star Boulevard. With the proximity to both
Abraham Lincoln Elementary School and Palm Desert Middle School, pedestrian safety is
of paramount concern. In addition, the residential fences along this stretch are constructed
of various styles of concrete block and wood fencing that need aesthetic treatment. In the
2007-2008 budget $150,000.00 was allocated for this project, with an additional
$1,050,000.00 proposed in the 2008-2009 budget.

During staff discussions considering alternatives for this project, the subject of
undergrounding the existing Southern California Edison (SCE) utility poles was explored.
The area under consideration is within Project Area No. 3 and is slated for future utility
undergrounding. Should the undergrounding be completed at a later date, the sidewalk and
aesthetic improvements currently being considered would be negated.
Undergrounding of the SCE utility poles would require the removal and rebuilding of the
existing property walls along thirteen residences. The estimated cost for Southern
California Edison utility pole undergrounding is $445,000. The remaining utilities (Time
Warner Cable and Verizon Telephone) will also require relocation and/or undergrounding.
The design cost for the sidewalk relocation and new soundwall is estimated at $63,880.
The construction cost for the sidewalk relocation, the new soundwall, and property
restoration is estimated at $1,356,000,00. Approximately $1.2 million has been budgeted.
Moving forward with the project will require additional appropriation of funds during the
construction phase. The undergrounding of the utilities will make it necessary to complete
the relocation and construction over two summer seasons to minimize disruption to school
pedestrian traffic.
On October 20, 2007, a contract was executed with David Evans and Associates (DEA) for
the conceptual design for the sidewalk and aesthetic treatment in the amount of $24,010.00.
The attached concept design and plant palette prepared by DEA were presented to and
approved by the Landscape Beautification Committee on March 19, 2008. The sidewalk
realignment will provide a landscaped parkway between pedestrian and vehicle traffic.
There are two areas totaling approximately 30 linear feet, where a parkway is not possible
due to utility conflicts. At those locations, a decorative barrier railing will be installed.
Because of the critical nature of the project scheduling, staff is requesting that City Council
approve the award of the design contract to DEA without initiating a full Request for
Proposal process. A full Request for Proposal process could delay the selection of a
consultant to complete the design, which would in turn significantly affect the project
schedule, delaying construction possibly a full year. DEA is well acquainted with the project
location as well as the current utility configuration. DEA has prepared the conceptual
design and would be able to begin working on the engineering and landscape design
without delay. The firm has the ability to design the structural component (block soundwall),
sidewalk, landscaping and block wall aesthetic treatment. The proposed fee for this design
is well within industry standards and staff believes it to be appropriate compensation for the
scope of work involved.
Therefore, staff recommends that City Council, by Minute Motion, direct staff to incorporate
the undergrounding of the utilities into the scope of the project, award contract No. C27690
to David Evans and Associates of Riverside, California, for the design of the northbound
Portola Avenue Sidewalk and Aesthetic Improvements between Fred Waring Drive and
Desert Star Boulevard, in the amount of $63,880.00, and authorize the Mayor to execute
the same.

AGREEMENT
THIS AGREEMENT, made and entered into this 22"d day of May, 2008, by and
between THE CITY OF PALM DESERT, a municipal corporation, hereinafter referred to
as "CIT1(" and David Evans and Associates, hereinafter referred to as "ARCHITECT".
WITNESSETH:
WHEREAS, ARCHITECT is a corporation, the principal members of which are
Professional ARCHITECTS duly registered under the laws of the State of California;
and
WHEREAS, CITY desires to engage ARCHITECT to render certain technical and
professional ARCHITECT services as set forth in Exhibit "A" (ARCHITECT's Proposal of
Services) in connection with the design of Proiect: Portola Avenue Aesthetic
Treatment between Fred Waring Drive and Desert Star Boulevard.
NOW, THEREFORE, the parties hereto agree as follows:
(1) CITY hereby agrees to engage ARCHITECT to perform the
technical and/or professional services as hereinafter set forth.
(2) ARCHITECT shall perform all work necessary within the schedules
provided herein to complete the services set forth in Exhibit "A" attached hereto and by
reference incorporated herein and made a part hereof.

(3) All information, data, reports and records and maps as are existing
and available from the CITY and necessary for the carryings out of the work outlined in
Exhibit "A" hereof shall be furnished to ARCHITECT without charge by CITY and CITY
shall cooperate in every way reasonable in the carrying out of the work without delay.
(4) ARCHITECT represents that, it employs or will employ at its own
expense, all personnel required in performing the services under this Agreement.
(5) All of the services required hereunder will be performed by
ARCHITECT or under its direct supervision, and all personnel engaged in the work shall
be qualified and shall be authorized or permitted under state and local law to perform
such services.
(6) The execution of this Agreement by the parties hereto does not
constitute an authorization to proceed. CITY's Director of Public Works has not
authorized ARCHITECT to proceed.
(7) The ARCHITECT shall work closely with the CITY's Director of
Public Works, or his designated representative, who shall be the principal officer of the
CITY. The ARCHITECT shall review and receive the Director of Public Works approval
of the details of work as it progresses. The Registered Civil ARCHITECT hereby
designated by the ARCHITECT as its representative for supervision of the work
required by this Agreement is Chris Giannini L.A.No. 4287.
(8) The ARCHITECT warrants that he has not employed or retained
any company or person, other than a bona fide employee working solely for the
consultant, to solicit or secure this Agreement, and that he has not paid or agreed to
pay any company or person, other than a bona fide employee working solely for the

consultant, any fee, commission, percentage, brokerage fee, gifts, or any other
consideration, contingent upon or resulting from the award or making of this Agreement.
For breach or violation of this warranty, CITY shall have the right to annul this
Agreement without liability, or in its discretion to deduct from the contract price or
consideration, or otherwise recover, the full amount of such fee, commission,
percentage, brokerage fee, gift or contingent fee.
(9) The right is reserved by the CITY to terminate the Agreement at
any time upon seven (7) days written notice, in the event the project is to be abandoned
or indefinitely postponed, or in the event the ARCHITECT's services, in the sole
judgment of CITY, are unsatisfactory or because of the ARCHITECT's failure to
prosecute the work with diligence or within the time limits specified or because of his
disability or death. In any such case, the ARCHITECT shall be paid the reasonable
value of the services rendered, based upon ARCHITECT's standard hourly rates, up to
the time of the termination. The ARCHITECT shall keep adequate records to
substantiate costs and provide copies of original timecards in the event of termination or
suspension.
(10) All documents including tracings, drawings, estimates, reports,
investigations and computations shall be delivered to and become the property of the
CITY. CITY acknowledges and agrees that all plans, specifications, reports and other
design documents prepared by ARCHITECT pursuant to this agreement shall be used
exclusively on this project and shall not be used for any other work without the written
consent of ARCHITECT. In the event CITY and ARCHITECT permit the re-use or other
use of the plans, specifications, reports or other design documents, CITY shall require

the party using them to indemnify and hold harmless CITY and ARCHITECT regarding
such re-use or other use, and CITY shall require the party using them to eliminate any
and all references to ARCHITECT from the plans, specifications, reports and other
design documents.
(11) The ARCHITECT shall comply with all federal, state and local laws,
ordinances and regulations applicable to work.
(12) No change in the character or extent of the work to be performed
by the ARCHITECT shall be made except by supplemental authority in writing between
CITY and the ARCHITECT. The supplemental authority shall set forth the changes of
work, extension of time and adjustment of the fee to be paid by CITY to the
ARCHITECT, if any.
(13) In connection with the execution of this Agreement, the
ARCHITECT shall not discriminate against any employee or applicant for employment
because of race, religion, color, sex or national origin. The ARCHITECT shall take
affirmative actions to insure equal employment opportunity and that employees are
treated during their employment without regard to their race, religion, color, sex or
national origin. Such actions shall include, but not limited to, the following: employment,
upgrading, demotion or transfer; recruitment or recruitment advertising; layoff or
termination; rates of pay, or other forms of compensation and selection for training,
including apprenticeship. This clause shall be included in each related subcontract,
if any, awarded by the ARCHITECT.
(14) The CITY agrees to pay the ARCHITECT for the work required by
this Agreement on the following basis:

ARCHITECT shall submit invoices monthly for services performed in the
previous month not to exceed the total contract amount of: $63.880.00 (Sixty Three
Thousand Eight Hundred Ei�htv Dollars and 00/100 ONLY). CITY agrees to pay all
undisputed invoices within thirty (30) days of receipt of invoice. CITY agrees to notify
ARCHITECT of disputed invoices within fifteen (15) days of receipt of said invoice.
(15) The ARCHITECT agrees to complete the work and submit the Final
Design ARCHITECT phase as displayed in Exhibit "A".
(16) In the event that any judgment is entered in any action upon this
Agreement, the party hereto against whom such judgment is rendered agrees to pay the
other party an amount equal to the reasonable value of the legal services performed in
his or its behalf in such action and that such amount may be added to and made a part
of such judgment.
(17) This Agreement shall be binding on the successors and assigns of
the parties, but it shall not be assigned by the ARCHITECT without written consent of
the CITY.
(18) The ARCHITECT shall be an independent contractor, not an
employee of the CITY.
(19) Prohibited interests are as follows:
No officer, member or employee of the CITY during his tenure or one year
thereafter shall have any interest, direct or indirect, in this Agreement or the proceeds
thereof. The parties hereto covenant and agree that to their knowledge no member of
the City Council, officer or employee of the CITY has any interest, whether contractual,
non-contractual, financial or otherwise, in this transaction, or in business of the

contracting party other than the CITY, and that if any such interest comes to the
knowledge of either party at any time a full and complete disclosure of all such
information will be made in writing to the other party or parties, even if such interest
would not be considered a conflict of interest under applicable laws.
The ARCHITECT hereby covenants that he has, at the time of this
Agreement, no interest, and that he shall not acquire any interest in the future, direct or
indirect, which would conflict in any manner or degree with the performance of services
required to be performed pursuant to this Agreement. The ARCHITECT further
covenants that in the performance of this work no person having any such interest shall
be employed by the ARCHITECT.
(20) The ARCHITECT shall indemnify and save harmless the CITY, its
officers and employees from and against any liability, loss, cost or expense resulting
from any injury or damage to persons or property caused by the negligent acts or
omission of the ARCHITECT, its agents or employees, while engaged in the
perFormance of this Agreement. The ARCHITECT shall submit to CITY, prior to the
Notice to Proceed is issued, certification of adequate coverage for "errors and omission"
insurance in amounts approved by the City Attorney. Any such insurance shall not be
canceled prior to written notice to and approval from the CITY.
(21) In case of conflicts within the contract documents, the document
precedence shall be as follows:
(a) This Agreement;
(b) Exhibit "A" (ARCHITECT's Proposal of Services, and any
written modifications thereto).

Thank you for the opporfiunity to continue our working relafionship on this project. I
have provided a scope of work and design fee for construction documents for the
parkway area on the east side of Porfola Avenue between Fred Waring and
Rutfedge. The conceptual drawings that DEA has already prepared for the project
will serve as the approved site plan. Construction drawings will be devefoped from
the conceptual plan. The scope and fees are represented below.
Task 1 - Topographic Survey 8� Record Right-of-Way Delineation $13,120 �
DEA will provide a topographic survey to iocate curb, gutter,surface visible�tilities, �
walls pnd fences within the limi#s described as follows: bounded on the east by the �
wall along the east right-of-way of Portola Avenue, on the north by the south curb of �
Rutledge Avenue,on the west by the east curb of Portola Avenue and on the south �
by the north curb of Fred Waring Drive. Elevations will be based upon City of Palm
Deserf benchmarks. �

The centerline anct east right-of-way of Portola Avenue wilf be determined using �
record mapping data based upon a minimum of two found centerline monuments
in the project area. The centerline and right-of-way will not be surveyed.
Utility Research 8� Plotting �
DEA will perform utility research in preparation of the base map for this
project. This research will include searching for available record utility data �
within or adjacent to the project limits. DEA will gather available information �
from fihe utility purveyors regarding their facilities in the project area.

Underground utilities will be mapped by record public information only; �
subsurface utilities that are not identified on existing record maps will not be �
shown. 11 is nofied that the utility purveyors will be notified upon written �
authorization fo proceed. DEA can nof control the response time from the
utilify purveyors.

Task 2--Geotechnical investigation $5,900 �
Converse Consul#ants will provide the geotechnica! investigation services.Their �
proposed geotechnical investigation will provide personnel, equipment and f
materials to dril! exploratory borings, conduct geofechnical laboratory testing of soil (
samples, perform geotechnical engineering and geological analyses, and provide '
recommendations for earfhwork, foundations, and other related developments. Their i
scope of work will include the following tasks:

Project Set-up
As parf of fhe project set-up, staff personnel from our office will conduct the
following:

• Co-ordinate site access with you. �
• Stake/mark the boring locations in the field such that drill rig access to all I
locations is available_
• Notify underground Service Aierf (USA) at least 4&hours prior to driliing to
clear the boring location of any conflict with existing underground utilities.
Field Exploration . �
The field expforaiion will consist of a subsurface explorption program consisting �
of drilling and sampling two exploratory borings.The purpose of the borings will
be to:
• Obtain subsurface information afi the site
• Obtain undisturbed and bulk samples of the various soil types for laboratory
testing
The borings will be drilled 20 feet below ground surface (bgs) or to refusal,
whichever is shallower.Soils will be confinuously logged and classified by the
geologist/engineer in the field by visual examination in accordance with the
Unified Soil Classification System.
Undisturbed ring samples of the subsurface maferials will be obtained at ffve-
foot intervals, at changes in soil profiles, or where unusual conditions c�re f
encountered.The relatively undisturbed ring samples will be obtained using a �
Moctified California Spmpler (2,4 inches inside diameter and 3.0 inches outside
diameter) lined with thin-walled sample rings.The sampler will be driven into the
bottom of the borehole with successive drops of a 140-pound hammer falling 3Q
inches.The number of successive drops of the driving weight ("blows") required
for one foot of penetration will be shown on the boring summary sheet in the
"blow/6-inch" column.7he soil will be retained in brass rings (2.4 inches in
diameter and one inch in height). The centrpl portion of the sample will be �
retained and carefully sealed in waterproof plastic confc�iners for shipment to
the laboratory. Buik samples of representative soil types will be collected in

Laboratory Testing
�
Soil samples bbtained in the subsurface exploration will be transported to our �
geotechnicai laboratory. Geotechnicai testing may inciude the following: �
• ln-place moisture and density tests �
• Sieve analysis �
• Direct shear tests �
• pH, resistivity, and soluble sulfate and chloride tests j

Samples wilf be stored in our la6oratory for at least 30 days after the report is ��
completed. At that time, samples wilf be disposed of unless we receive
notification to do otherwise.
Deliverables: Geotechnical Analyses and Reporf Preparation-Data obtained from
the exploratory borings and the laboratory-testing program will be evaluated.
Engineering and geologic analysis will be performecf to develop earthwork and
preliminary foundation design foc the proposed project. A report will be prepared for
the site,which will include the following items: #

• A discussion of the materials encountered in the borings and their measured
engineering properties
• Logs of the exploratory borings summarizing the subsurface conditions

Appropriate details will be provided to instruct contractors how to build and ins#all �
the project amenities as designed by�the project team. For prefabricated items, t

provided. Structural calculations wi11 be included for the new section of bfock wall.

The irrigafion plan will identify the point of connection and meter location, irrigation
equipmenf location and type (backflow preventer, controller,gate valves, remote
control valves, main line, latera! lines, sieeves,and irrigation heads), irrigation ,
equipment legend,satellite controls (as applicable), consfiruction notes and details. i
DEA's design team wil! coordinate with the City and appropriate agencies such as
CVWD to provide a system that safiisfies appropriate guidelines and requirements.

project design. In addition DEA's project manager or other appropripte key

utilifiy�gencies,attend presentations, public meetings and public hearings if
necessary. Overall DEA is applying 30 hours of time to this meeting task during the �
construction drawing phase of the project. Additional meeting time may be subject

Task 15: Site Visitc�tions/ Final Observation $2,820
DEA fieam members will provide three (3) site visitations as needed a Landscape
Architect. Two visits will take pface during the construction process and one at the
end of the construction process in order to perform a final review for acceptance of
. all sys#ems. Observations by the team include some or most of the following items:
observation reports, quality control of installation and iocation of amenities,
inspection of plant material af #he sit�,inspection of installed material quafity, .
inspection of construcfion conformance fio design documenfs, and consfiruction
sch�duEe monitoring. It is.our understanding that the City will provide a full-time �
inspector for the project in addition to necessary building /engineering inspectors to �
check forms,steel placement, concrete, and utilities. - . �
Deliverables:Three (3) site visits by DEA. A written field report will be provided for all �
site visifis. �

Government fees, mileage, delivery costs such as Federal Express charges,and T
plotting/reproducfion services are considered reimbursable fees and shall be billed i
to you at our direct cost. The fee noted is an estimate only. If actual reimbursable �
costs exceed our estima#e, additional fees may be necessary. The city will onfy be
billed for actual reimbursable expenses.

Design services for structural considerations for existing walls, drainage structures, �
agronomic and geotechnical soils reports, additional color renderings or simulations,
boundary survey, corner records, record of survey, establishment of properfy corners,
and underground utility locations are not included in this fee proposal. Additional
tasks required beyond the scope of services noted above, or changes requested by
City shall be charged on an "Extra services" basis and negotiated accordingly.
