Director of Public Works DATE: May 22, 2008 CONTENTS: Amendment No. 4 Vicinity Map Recommendation: Authorize the Mayor to execute Amendment No. 4 to the Reimbursement Agreement between the City of Indian Wells, the City of Palm Desert and the Coachella Valley Association of Governments related to the Fred Waring Drive Widening from California Avenue to Washington Street. Discussion: The City of Palm Desert has completed the widening of Fred Waring to six lanes throughout the City. The projects to widen Fred Waring Drive would not have been completed without the financial support of the Coachella Valley Association of Governments (CVAG). The original agreement dated January 11, 2001 between CVAG and the City of Palm Desert provided approximately sixteen million dollars in funding for the length of Fred Waring from Highway 111 to Washington Street. The cost estimate for the widening of the full length of Fred Waring through Palm Desert was also generated in January 2001 and did not include any inflation factors. Since that time, the cost of construction materials has increased dramatically; specifically, the costs of major components in the widening projects, such as asphalt and concrete, have skyrocketed. Due to the major increase in construction costs, the City encountered a shortfall in matching funds from CVAG. The City spent $5.75 million above that which was originally estimated. At the matching rate of 75%, CVAG's portion is $4.3 million. Authorize Mayor to Execute Amendment No. 4 - CVAG Fred Waring Drive Agreement May 22, 2008 Page 2 of 2 Amendment Nos. 1 and 2 were specifically related to Indian Wells and were generated prior to the pooling of Indian Wells and Palm Desert funds. In October 2004, CVAG executed Amendment No. 3 which combined the Fred Waring Drive funds from the City of Indian Wells and the City of Palm Desert. The funds were pooled because the construction of the widening between Phyllis Jackson Drive and Washington Street were joint projects, and it streamlined the reimbursement process. The total funding from CVAG for the Fred Waring Drive improvements after Amendment No. 3 was $24,383,938.00. The additional $4.3 million brings the total to $28,683,938.00 for CVAG's portion. This total includes all work on Fred Waring Drive in Palm Desert and Indian Wells from Highway 111 to Washington Street. Fiscal Impact: This Amendment increases funding for the Fred Waring Drive widening project by $4.3 million. The City spent $5.75 million more than originally estimated as approved by City Council action on June 8, 2006 and July 12, 2007. We will be reimbursed $4.3 million (75%), resulting in a net expenditure by the City of $1.45 million. The funding has already been budgeted and expended for this project. The City of Indian Wells and CVAG have already executed the Amendment. Therefore, staff recommends that the City Council, by Minute Motion, Authorize the Mayor to execute Amendment No. Four to the Reimbursement Agreement between the City of Indian Wells, the City of Palm Desert and the Coachella Valley Association of Governments related to the Fred Waring Drive Widening from California Avenue to Washington Street. All other provisions in the existing Reimbursement Agreements with the Cities of Palm Desert and Incfian Welis for the Fred Waring Drive Project from Highway 111 to Washington Street are considered in force.
