RECOMMENDATION:
By Minute Motion, accept the funding supplied by the California Office of Traffic Safety,
specificalty earmarked for implementation of the "Click It or TickeY' seat belt compliance
program in the amount of $28,910.00, said program scheduled to run from October 1,
2008, through September 8, 2009.
EXECUTIVE SUMMARY:
Approval of this request will allow funding for this program to move forward.
BACKGROUND:
Each year the California Office of Traffic Safety (OTS) promotes a statewide "Click It or
Ticket" program to increase the use of seatbelts in local jurisdictions. The goal is to
generate a statewide 93.7% compliance by drivers, using funded overtime for law
enforcement officers to enforce violations and educate the public in the proper and
important use of seat belt restraint devices. Last year, OTS authorized funding specifically
for the Palm Desert Police Department in the amount of $7,000.00. These funds were
utilized by front line supervisors and officers on an overtime basis coupled with
administrative time to meet the grant reporting requirements.
Over the past several years,the program has been specifically designed to run only during
the month of May, using a zero tolerance approach to violation of the seat belt laws. This
year, OTS has expanded the program to run from October 1, 2008, through September 8,
2009. This year-long program specifies two Mobilization Periods, November 17-30, 2008,
and May 18-31, 2009. Additional saturation seat belt enforcement is authorized, with
reimbursable overtime, in the months before, during, and after the mobilization periods.

The mini-grant uses a six-phase set of project objectives to accomplish this task,and these
objectives are included in the attached memorandum.
Costs incurred by the City of Palm Desert for overtime during the implementation of this
program will be reimbursed by OTS to the City in the amount of $28,910.00. This
reimbursement covers actual costs to the City not to exceed the total amount of the grant.
No additional operational costs are expected to be incurred by the City of Palm Desert.
At its meeting of October 8, 2008, the Palm Desert Public Safety Commission
recommended to the City Council acceptance of funding supplied by the California Office
of Traffic Safety, specifically earmarked for implementation of the "Click It or Ticket" seat
belt compliance program in the amount of$28,910.00.

It only takes two seconds to buckle up.Two seconds!And those two seconds could literally
save your life.They will also keep you from getting a ticket and a fine.
Police departments throughout California will be looking for drivers and passengers who don't
buckle up during the"Click It or Ticket"seat beit enforcement campaign.And that includes
passengers in the back seat.
�� "Click It or TickeY'debuted in California in 2005,and since then over one million more vehicle
occupants have started buckling up.
� � The fine for a seat belt violation costs between$80 and$91 depending on the county and up to
":,r� �rt "' $350 for not properly restraining a child under 16. If the parent is not in the car,the driver gets

Facts and Figures
• California's 2007 seat belt use rate is 94.6 percent, up from 93.4 percent in 2006, fourth highest in the
nation.
• Since the Click It or Ticket campaign began in California in 2005, Califomia's seat belt use rate has
increased from 90.4 percent in 2004 to 94.6 percent in 2007. This represents well over one million
more people who are now buckling up. .
• California's 2007 teen seat belt use rate is 88.9 percent, a disturbing decrease from the 90.8 in 2006
• California's 2007 child safety seat usage rate is 87.7 percent—down from 87.8 percent in 2006.
• The 2007 national average for seat belt use is 82 percent.
• The cost for a seat belt violation in California for unbuckled vehicle occupants over age 16 is between
$80-$91, depending on the county.
• When children under age six are not properly secured in a vehicle, the parent or driver can receive `one
poinY on their driving record, in addition to a fine ranging from $330 to$401 on a first offense and
between $795 and $971 on a second offense. If the parent is not in the car, the driver gets the ticket.
• According to the National Highway Traffic Safety Administration (NHTSA), seat belts reduce a person's
changes of dying in a crash by 50 percent.
• Seat belts are the single most effective motor vehicle occupant safety device yet developed for older
children and adults.

Dear Chief of Police:
The Office of Tra�c Safety(OTS)is soliciting applications from law enforcement agencies to impiement the"Next Generation-
Click It or TickeY'(Next Generation CIOT)seat belt enforcement mini-grant program. The Next Generation program wili include
two well publicized seat belt enforcement mobilizations in November 17-30,2008,and May 18-31,2009,and promotes sustained
enforcement by including one to four days and/or nights of intensified seat belt enforcement each month.
Grants will be awarded on a competitive basis,with the goal of including local law enforcement agencies representing at least 50
percent of California's population or serving geographic subdivisions that account for at least 50 percent of California's unbelted fatal
vehicle occupants.
The mini-grants offset overtime and reporting costs for seat belt enforcement conducted during the two mobilization periods and
sustained enforcement throughout the year. Local law enforcement agencies,state college and universiry police departments,and
Sheriffs'Departments with contract cities(agreements are made with each individual contract city)are eligible to apply for a mini-
grant.
The Office of Traffic Safety(OTS)contracts with the University of California,Berkeley,Tra�c Safety Center(TSC)to manage the
application,contract,reporting and financial processes for the mini grant program. All funding decisions will be made with OTS

The Next Generation CIOT goal is to increase seat belt use statewide to 95 percent in 2009 through the combined efforts of the
California Highway Patrol(CHP),OTS and local law enforcement. The Next Generation CIOT strategy is to focus public information
and enforcement on persons who fail to use seat belts during the November 2008 and May 2009 Next Generation National
Mobilizations and promote sustained enforcement throughout the year. OTS will coordinate the public information element of the
campaign for one week prior to,and during the November and May enforcement mobilization periods.

The University of California Berkeley, Traffic Safety Center(TSC) is very pleased to inform you that a mini-
grant has been approved for Palm Desert, City of to conduct Next Generation seat belt enforcements. The
mini-grant funds are being provided by the California Office of Traffic Safety(OTS). The TSC is
administering the mini-grant funds for the OTS.
The mini-grant period is October 01, 2008 to September 08, 2009.The Palm Desert, City of has been
approved for$28,910.00 to conduct seat belt enforcements in Palm Desert during:
- The November 17-30, 2008 Mobilization Period
- The May 18-31, 2009 Mobilization Period
- Each of the remaining months of the grant period starting in December 2008
A mini-grant document will be emailed to the contact listed on the application to obtain the signature(s)of the
Authorizing Official and any additional individuals authorized to sign claims.We will issue a purchase order
when a signed mini-grant document is returned. For your reference,the Catalogue of Federal Domestic
Assistance(CFDA) number is 20.600.
The TSC will be conducting pre-operational training in October/November to review the contract provisions
and answer any questions of the applicant agency. We strongly recommend the attendance of a
representative(s)from the finance department.
OTS requires mini-grantees to distribute Next Generation kick-off press releases prior to the November 17-30
Mobilization Period. The TSC will provide an OTS-approved kickoff press release template.

COST ANALYSIS:
