Discussion: Palm Desert established itself as a leader when we developed our Golf Cart Transportation Program in January of 1993 under Assembly Bill 1229 and Assembly Bill 110. The success of this program is evident on our local streets, along EI Paseo and throughout the community. By permitting our residents to travel to shopping centers, schools, businesses and government offices in zero emission golf carts we are reducing green house gases. This is also in keeping with Palm DeserYs commitment to lessen our overall carbon footprint and to maintain the quality of life for our residents. This amendment addresses the way golf carts have evolved over time. Many residential carts seat four people and our shuttles on EI Paseo seat six. Staff recognized that in order to maintain the highest safety standards for our residents certain sections of the code needed clarification. Amending the Ordinance allows for golf carts to seat up to six people (including the driver) and stipulates that driver and passengers must wear safety belts at all times. The amendment also defines golf carts as being "electric powered" and having "not less than four wheels in contact with the ground," because staff believes three wheeled gotf carts are unsafe. Staff Report—Amendment to Golf Cart Ordinance November 20, 2008 Page2of2 The City Attorney has reviewed and approved the proposed amendments. Therefore, staff recommends that Council, by Minute Motion, waive further reading and pass to second reading the amendment to sections of Chapter 10.76 of the Palm Desert Municipal Code relating to Golf Carts.
