Recommendation:
That City Council, by Minute Motion, waive further reading and pass to second
reading the amendment to sections of Chapter 10.76 of the Palm Desert Municipal
Code relating to Golf Carts.
Discussion:
Palm Desert established itself as a leader when we developed our Golf Cart
Transportation Program in January of 1993 under Assembly Bill 1229 and Assembly
Bill 110. The success of this program is evident on our local streets, along EI Paseo
and throughout the community. By permitting our residents to travel to shopping
centers, schools, businesses and government offices in zero emission golf carts we
are reducing green house gases. This is also in keeping with Palm DeserYs
commitment to lessen our overall carbon footprint and to maintain the quality of life
for our residents.
This amendment addresses the way golf carts have evolved over time. Many
residential carts seat four people and our shuttles on EI Paseo seat six. Staff
recognized that in order to maintain the highest safety standards for our residents
certain sections of the code needed clarification. Amending the Ordinance allows for
golf carts to seat up to six people (including the driver) and stipulates that driver and
passengers must wear safety belts at all times. The amendment also defines golf
carts as being "electric powered" and having "not less than four wheels in contact
with the ground," because staff believes three wheeled gotf carts are unsafe.

The City Attorney has reviewed and approved the proposed amendments.
Therefore, staff recommends that Council, by Minute Motion, waive further reading
and pass to second reading the amendment to sections of Chapter 10.76 of the
Palm Desert Municipal Code relating to Golf Carts.

ORDINANCE NO. 1174
AN ORDINANCE OF THE CITY COUNCIL OF PALM DESERT,
CALIFORNIA AMENDING SECTIONS OF CHAPTER 10.76 RELATED
TO GOLF CARTS
The City Council of the City of Palm Desert, California does hereby ordain
as follows:
Section 1. That Section 10.76.020 be and the same is hereby amended to
read as follows:
"Golf cart" means an electric powered motor vehicle having not less than four
wheels in contact with the ground and an unladen weight of less than three thousand
pounds which is designed to be and is operated at not more than twenty-five miles per
hour and is designed to carry not more than six persons, including the driver."
Section 2. That Subparagraph j. of Subparagraph 4. of Section 10.76.100 be
and the same is hereby amended to read as follows:
`j. Seat belts for the driver and for all passengers;"
Section 3. That Subparagraph 5. of Subparagraph B. of Section 10.76.110 be
and the same is hereby amended to read as follows:
"5. A maximum of six persons may ride in the golf cart and may only ride in
the main passenger compartment equipped with safety belts. The driver and all
passengers must wear safety belts at all times that the golf cart is being operated on
public streets."
Section 4. The City Clerk of the City of Palm Desert, California, is hereby
directed to publish this ordinance in the Desert Sun, a newspaper of general circulation,
published and circulated in the City of Palm Desert, California, and shall be in full force
and effective thirty (30) days after its adoption.
