Recommendation:
By Minute Motion, waive further reading and adopt Resolution No. 08-9Q,
approving Parcel Map No. 35870.
Discussion:
Parcel Map 35870 is located on the south side of Enfield Lane in the Country Club Business
Park. The map provides for the subdivision of one 0.50-acre parcel into three parcels for
industrial/warehouse condominium purposes, and one common parcel for parking, drainage and
trash facilities. The precise plan of design was approved by the Planning Commission at its
meeting of December 7, 2004 and a 6,935-square-foot building has been constructed on the
subject parcel. The building units and common walls coincide with the division lines of the map.
The tentative map was approved by the Planning Commission on February 5, 2008 and will
expire in February 2011 with the 12-month extension per Senate Bill 1185.
Those conditions of approval related to the map have been satisfied. The c)ndifors of
approval for the related precise plan (P. P. 04-16) do not affect the map. This map conf rns to
the requirements of the Subdivision Map Act and City ordinance and it is substan :ia ly th , Earle
as it appeared on the tentative map. Reciprocal easements for parking, access d -aina►je and
use of trash enclosure is not necessary because there is only one common pa}ce'I for Js : ry 311
three units/parcels, and CC&Rs will be recorded concurrently with the map.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING THE MAP OF PARCEL MAP NO.
35870.
BE IT HEREBY RESOLVED, by the City Council of Palm Desert,
California, as follows:
(1) The Map of Parcel Map No. 35870 of the City of Palm Desert,
California, is hereby approved as the official map of said parcel
map, subject to the conditions of the Tentative Map.
(2) The City Engineer is directed to process the Parcel Map for
recording upon receipt of payment of all fees.

Palm Desert, California, on this 11th day of September, 2008 by the following

Department of Communitv Development:
1. The development of the property shali conform substantially wi#h exhibits on file
with the Departmen# of Community Development, as modified by the foElowing
conditions.
2. Tentative Parcef Map 35870 shall be recorded witi�in twa years from the date of
final approval unless an extension of time is granted; otherwise said parcel map
approval shall become null, void and of no effect whatsoever.
3. The development of the property described herein shall b� subject to the
restrictions and limitations set forth herein, which are in addition to all municipal
ordinances and state and federal sfatutes now in force, or which hereafter may
be in force.
4. Applicant agrees to maintain the existing landscaping installed pursuan� to these
condifions. Applicant shall enter into an agreement or revise an existing agreement
through a property owners' association to maintain said landscaping for the life of
the project, which agreement shall be notarized and which agreement shall b�
recorded. It is the speci�c intent of the parties that this conditian and agreement
run with the land and bind successors and assigns.
5. All conditions of approval shall be recarded with the Riverside County Clerk
before the final map is approved. Evidence of recordation shall be submifted to
fhe Department of Community Development/Planning.
6. All conditions of approval for Case No. PP 04-16, approved by Planning
Commission Resolution No.2312 shalf apply to the abave noted project.

of construction, dis#ances between buildings, house number, parking layout, city-
� county boundary iine, zone change boundary line, locations of all easements,
street cen#erline, area separation walls, sewers, existing cesspaofs and sep#ic
tanks and sewage disposal system is required.
3. Show on the plans the area justification for each structure. The mezzanine floor
area must be induded in the area ('tf appiicable) af the story in which it is loca#ed.

4. Projecfions beyond the exterior wali must nat extend beyond:
a. A point one-third the distance to fhe lat line from an assumed vertical
plane located where protected of openings are required in accordance
with Section 704.8. (704.2)
b. A poin# more than 12 inches into area wi�en openings are prohibited.

5. Where areas of exterior wall and opening protection changes, these areas must
be addressed in detaif (i.e. Fire resistive construction, percentage of openin�s,
etc.}
6. Where multiple buildings are concerned, the utili#ies, water meters and sewers
must be lacated on the property of the building served, unless an easement is
recarded �i.e. sewer laterals must not be located on an adjacent property).
7. Address numerals shall comply with Palm Desert Ordinance No. 10p6 {Palm
Desert Municipa! Cocie 15.04.110 through 15.04.160). Compliance with
Ordinance 1006 regarding street address location, dimension, stroEce of line,
distance #rom street, height trom grade, height from street, e#c. shall be shown
on all architectural building elevatians in detail. Any possible obs#ruc#ions,
shadows, lighting, landscaping, backgrounds or other reasons that may render
the building address unreadable shal! be addressed during the plan review
process. You may request a copy of Ordinance 1006 from the Department of
Building and Safety counter staff.
Deaartment o€ Public Works:
1. Complete parcel map s�all be submitted as required by ordinance to the Director
af Public Works for checking and appraval prior to issuance of any permits.
2. The map shall record a recipracaf easement for parking, access, cfrainage, and
use of#rash enclosure as applicable.
