REQUEST: RATIFY THE CITY MANAGER'S APPROVAL OF CONTRACT NO.
C28160 WITH FIRST AMERICAN TITLE COMPANY (RANCHO
CUCAMONGA, CA) FOR TITLE SERVICES NECESSARY FOR THE PALM
DESERT INDEPENDENCE PROGRAM. AUTHORIZE THE DIRECTOR OF
FINANCE TO APPROPRIATE $45,000 FROM UNALLOCATED GENERAL
FUND RESERVES INTO PROFESSIONAL SERVICES ACCOUNT NO. 110-
4511-442-3090 FOR THESE SERVICES.

1) Contract with First American Title
By Minute Motion:
1) Ratify the City Manager's approval of Contract No. C28160 with First
American Title Company (Rancho Cucamonga, CA) for title services necessary
for the Palm Desert Independence Program.
2) Authorize the Director of Finance to appropriate $45,000 from unallocated
General Fund reserves into Professional Services Account No. 110-4511-442-
3090 for these services.
Discussion:
This contract includes the following services: preliminary title reports, title insurance and recording
services, which are necessary for the expedited Energy Independence Program loan process. The
cost of the services is $360 per loan application. The loan applicant will pay $200 and the City will pay
$160, as was outlined in the Energy Independence plan approved by Council at the August 28, 2008
meeting.

Dear Mr. Conlon,
I want to thank you for this opportunity to submit our proposal to you for the new
program being developed by the City of Palm Desert pursuant to the program created
through the passage of Assembly Bill No. 811. As a result of our conversation, I would
like to submit the following to you as our proposal for title services:
• We will provide a Legal & Vesting for each property, upon request. The legal and
vesting will consist of the last recorded grant deed(s) or other conveyance
documents evidencing a change in ownership.
• We will issue a preliminary report for each individual parcel within 3 days of the
specific request for such a report. Each report will be reviewed by The City of
Palm Desert prior to the issuance of any policy of title insurance.
• Preliminary reports will be emailed via hyperlink to the City of Palm Desert
through our Eagle Pro2 system. The prelim will be available online, 24 hours a
day for your review.
• Upon written request from the City of Palm Desert, we will record the Notice of
Lien and issue a 2006 ALTA Lenders Policy of title insurance. Said policy will
insure the amount of the indebtedness that is evidenced by the recorded Notice
of Lien submitted to our office for recordation. The liability amount will be based
upon the contractual agreement between the City and the homeowner.
• We will record the Notice of Lien and issue the policy with the same date. The
effective date of the policy will be the same as the recording date of the Notice.
There is no additional service charge for this service.
• The policy will insure "The City of Palm Desert, a California municipal
corporation"
• The cost of the policy will be based solely on the liability. As a guideline, liabilities
up to and including $60,000 will be issued for $360 per policy. Our Schedule of
Fees is posted with the Department of Insurance for further review of liabilities
exceeding $60,000.
• A cancellation fee of $360.00 will be charged for any prelim issued by First
American Title that does not result in a title policy.
• A purchase order will be submitted monthly to your office for services rendered.
We understand we can expect payment within 10 days of the submittal of said
purchase order.
• This agreement can be terminated at will by either party.

• Randy Paslay will be the initial point of contact for the establishment of the
program.
• Porscha Peterson will be the Title Officer handling the opening of each order and
the closing of each policy.
• We will provide any additional staffing necessary to meet the volume needs
pursuant to the program. We currently have a very experienced and productive
staff that can handle all of your volume needs.
