Approve Amendment No. 1 to Contract C27950 in the amount of $96,000.00 with Kimley-Horn and Associates, Inc. for additional engineering services for intersection improvements at Frank Sinatra Drive and Portola Avenue; 2. Authorize the Finance Department to move $51,100.00 from contingency to base; and 3. Authorize the Mayor to execute the agreement. DISCUSSION: On July 10, 2008, the City Council approved Contract No. C27950 with Kimley-Horn & Associates, Inc. in the amount of $511,000.00, plus a 10% contingency, for consultant design services for intersection improvements at Frank Sinatra Drive and Portola Avenue. Staff has prepared Amendment No. 1 to Contract 227950 with Kimley-Horn and Associates, Inc. for the following additional engineering services. The project limits for Frank Sinatra & Portola Intersection-Approval of Amendment No. 1 to KHA Contract Page 2 of 3 September 11, 2008 the intersection improvements for Frank Sinatra Drive and Portola Avenue have been extended to include the following: • Full section widening on Portola Avenue based on the General Plan Typical Section. The limits extend south of the intersection and transition just before the Santa Rosa Country Club entrance, and north of the intersection to include the transition back to the existing roadway width. • Drainage improvements along Frank Sinatra to Drexell Drive. • Drainage improvements along Heatherwood Drive including the existing retention basin. Additional services are required to: 1) Widen Portola Avenue to the typical sections based on the general plan, which includes widening south of Frank Sinatra Drive along the undeveloped lots to the west and east, and provides adequate transition to the existing section north of Frank Sinatra Drive. 2) Upon evaluation of the existing drainage it was determined that the majority of the water located at Frank Sinatra Drive and Portola Avenue is nuisance water. This nuisance water in the intersection can be resolved by providing additional drainage at Drexell Drive and Frank Sinatra, Hollister Drive and Frank Sinatra and along Heatherwood Drive. This additional drainage will utilize the existing retention basin currently maintained by the City to alleviate the nuisance water at the intersection of Frank Sinatra Drive and Portola Ave. Staff has reviewed the request for additional services and is confident with the value being received for the cost of the additional services. Staff requests City Council approval of Amendment No.1 to Contract C27950 with Kimley-Horn and Associates, Inc. in the amount of$96,000.00. The total revised contract amount will be $607,000.00. The Consultant shall perform all work as necessary or required to complete the Professional Service Amendment items for a lump sum price agreed upon between the Consultant and the City of Palm Desert, otherwise referred to as Owner. Contract Time Extension N/A Days. AMENDMENT NUMBER 1 TO THE AGREEMENT BETWEEN THE CITY OF PALM DESERT AND HIMLEY-HORN AND ASSOCIATES, INC. AMENDMENT NUMBER 1 DATED August 21, 2008 to the agreement between the City of Palm Desert, ("Client") and Kimley-Horn and Associates, Inc., ("Consultant") dated August 1, 2008 ("the Agreement") concerning Frank Sinatra & Portola Improvements (the "Project"). The Consultant has entered into the Agreement with Client for the furnishing of professional services, and the parties now desire to amend the Agreement. Therefore, it is mutually agreed that the Agreement is amended to include Additional Services to be performed by Consultant and provisions for additional compensation by the Client to the Consultant, all as set forth in Exhibit A hereto. The parties ratify the terms and conditions of the Agreement not inconsistent with this Amendment, all of which are incorporated by reference. Scope of Services Task 1.0,Preliminary Design and Concept Based on the above mentioned project understanding,these tasks have been updated. Task 1.1,Data Collection and Review The Consultant will collect recard information for the extended project limits, to the extent readily available, from the City. It is assumed the as-built plans will be researched and compiled by the City, and be made available for KHA to pick up. Consultant will perform one additional site visit during this task. Task 1.3,Field Survey KHA will obtain additional field survey which includes approximately 3000' to the south, 600' to the north along the east side of the roadway, at the intersecton of DrexeUFrank Sinatra, at the intersection of Hollister/Frank Sinatra, along Heatherwood Dr., and at the existing detention basin. The field shots to the south will include the east half of the roadway extending to the right-of-way limits. It is assumed that all of the widening to the east will remain within the existing right-of-way. Task 1.5,Drainage Analysis KHA will expand the hydrologic analysis to include the existing retention basin located within the subdivision bounded by Heatherwood Dr.,Drexell Dr. and Hollister Dr. The basin volume will be calculated. The hydraulic function of the basin will be calculated based on the increased inflow into the basin due to diverting runoff from Drexell Dr. and Hollister into the basin. Task 1.7,Prepare 30% Project Submittal KHA will prepare full widening plans as outlined below: ■ Full width widening on the south leg of the intersection. The transition will begin immediately after the golf course driveway, where the full width section will include (24' parkway, 6' bike lane, 12' lane, 12' lane, 12' lane, 18' median, 12' lane, 12' lane, 12' lane, 6' bike lane, 24' parkway ), and continue to the intersection. ■ Additional widening to the north to allow for the transition of the northbound thru lane to transition back to the existing roadway. It is assumed the transition will begin approximately 150'past the intersection. KHA will prepare storm drain improvement plans for re-routing runoff into the existing retention basin. These plans will include three catch basins at the northwest,northeast and southwest corner of Hollister and Heatherwood Dr. Two catch basins are anticipated at the northwest and nartheast corner of Heatherwood Dr. and Drexell Dr. A pipe will run east along Heatherwood Dr. to the southwest corner of the basin where it will connect to the basin. Inlets will also be included along Heatherwood Dr. to intercept flow and also to allow for maintenance access to the overall system. The existing flow line will be evaluated along Frank Sinatra between Drexell Dr. and Hollister for surface flow. It is assumed that the existing cross gutters will be replaced. KHA will extend the proposed starm drain system from Frank Sinatra/Portola west to intercept flow priar to crossing Sheperd Ln. The plans will include: ■ Typical Sections ■ Demolition Plan: 1" = 40' scale (showing saw cut lines, pavement removal, limits of grinding,minor utility adjustment) ■ Improvement Plan and Profile: 1"=40' scale (showing existing grade elevations, curb extensions, new ADA pedestrian ramps, drainage improvements, crosswalks, cross gutters,medians, channelization) ■ Construction Details: 1"=20' scale Task 2.0,60% Plans, Specifications, and Estimate(PS&E) Based on the revised Task 1.7,these tasks have been updated to reflect the complete design. Task 2.3,Landscape Concept Design Ray Lopez Associates (RLA)will provide landscape concept design for the median south of Frank Sinatra Drive, on Portola Ave. Based on the revised street section; the median width will be 18 feet and is assumed to have full landscape and irrigation. Task 3.0,Pre-Final, 90% Plans, Specifications, and Estimate(P5&E) Based on the revised Task 1.7,these tasks have been updated to reflect the complete design. Task 3.2,Landscape Construction Drawings Based on the Task 2.3,RLA will provide the following: • Landscape Plan-This plan will revise the Conceptual Landscape Plan ■ Irrigation Plan - This plan will call out proposed piping, valves control equipment, emitter, spray-heads and water calculations. ■ Details & Specifications - RLA will provide the details and specifications as required to have the landscape and irrigation plans installed per local code. Task 4.0,F�nal, 100% Plans, Specifications, and Estimate(PS&E) Based on the revised Task 1.7,these tasks have been updated to reflect the complete design. Task 5.0,Project Coordination,Meetings,Management Based on the revised Task 1.7,a total of 20 hours has been added to this task. For the Additional Services set forth above, Client shall pay Consultant the following additional compensation: Lump Sum fee of$96,000.
