Discussion: Section 22358 of the California Vehicle Code allows cities to establish, by ordinance, speed zones on local streets. Speeds established by ordinance must be supported by an Engineering and Traffic Study, and a new speed study must be performed every five years in order for a speed zone to remain valid. Without the support of a proper Engineering and Traffic Study, the enforcement agency is unable to use radar to enforce a posted speed, which may lead to disregard of posted speeds by the motoring public. Establish Speed Zones Page 2 of 3 September 25, 2008 Several Engineering and Traffic Survey studies have been prepared in recent months by City staff, traffic engineering consultants, and the City of Rancho Mirage. The reports provide detailed engineering and traffic survey analyses of 13 roadway segments on 10 streets in the City. The objective of the analysis was to determine appropriate speed limits on roadways previously not surveyed and to review the adequacy of existing speed limits. The reports provide recommendations for new posted speeds by examining the various roadway characteristics that contribute to the establishment of appropriate speed limits. The roadway segments studied are shown on the attached Vicinity Map Exhibit and summarized in the table below. Five segments are recommended to maintain their current speed limits, and a reduction of 5 miles per hour is recommended on the three remaining segments. Also of note, Section 10.36.010, "Speed Zones", of the Palm Desert Municipal Code incorrectly indicates a speed limit of 35 mph for El Paseo between Highway 74 and the Highway 111 (East). The current Engineering and Traffic Survey for this section of El Paseo recommends a posted speed of 25 mph. This section of El Paseo is included in the proposed ordinance to correct the error in the municipal code. Public Safety Commission unanimously concurred with the speed limit recommendations presented herein at their September 9, 2008 meeting with one exception. The 45 mph speed zone on Highway 74 between El Paseo and Pitahaya Street has been added. This section serves as the transition area between the 55 mph and 35 mph speed zones on Highway 74. Establish Speed Zones Page 3 of 3 September 25, 2008 Staff recommends that City Council, by Minute Motion, adopt Ordinance No. 1167 , amending Ordinance No. 1130 and establishing speed zones on 10 streets as recommended here in.
