HomeMy WebLinkAboutREQ 4 ACTN - Hillside Regulation Ordinance* Councilman Kelly moved to, by Minute Motion, instructed the City Attorney to proceed with amending the City's Hillside Ordinance as proposed, repealing the preliminary approval option. Motion was seconded by Finerty and carried by 3-0 vote, with Ferguson and Spiegel ABSENT. MEMORANDUM To: Mayor and City Council City of Palm Desert FROM: David J. Erwin DATE: September 23, 2008 RE: Hillside Regulation Ordinance The City Council was very clear in reviewing the application of Mr. Kuykendall with regard to his parcel on the hillside and the ridgeline. I would note for the Council that 25.15.030(F) reads as follows: "development on or across ridges is prohibited." In addition, what seems to be creating the stir is our optional preliminary approval. Section 25.15.130 provides for that and reads as follows: "The applicant may choose to submit information and request a preliminary approval from the planning commission which will assign the appropriate development standard option, determine density, identify building sites, access roads and locations. No permits shall be issued until final approval is obtained." I am attaching to this memo an ordinance which I assume the Council would like to see. This would eliminate this procedure totally from our filing process. Assuming that is the wish of the Council, let me know and we'll start the process of hearings before Planning Commission and City Council. AN ORDINANCE OF THE CITY COUNCIL OF PALM DESERT, CALIFORNIA AMENDING SECTION 25.15.1530 OF CHAPTER 25.15 RELATED TO OPTIONAL PRELIMINARY APPROVAL PROCEDURE The City Council of the City of Palm Desert, California does hereby ordain as follows: Section 1. That Section 25.15.130 be and the same is hereby repealed. Section 2. The City Clerk of the City of Palm Desert, California, is hereby directed to publish this ordinance in the Desert Sun, a newspaper of'general circulation, published and circulated in the City of Palm Desert, California, and shall be in full force and effective thirty (30) days after its adoption.
