MEMORANDUM
To: Mayor and City Council
City of Palm Desert
FROM: David J. Erwin
DATE: September 23, 2008
RE: Hillside Regulation Ordinance
The City Council was very clear in reviewing the application of Mr.
Kuykendall with regard to his parcel on the hillside and the ridgeline. I would note for
the Council that 25.15.030(F) reads as follows: "development on or across ridges is
prohibited."
In addition, what seems to be creating the stir is our optional preliminary
approval. Section 25.15.130 provides for that and reads as follows:
"The applicant may choose to submit information and
request a preliminary approval from the planning commission which
will assign the appropriate development standard option, determine
density, identify building sites, access roads and locations. No permits
shall be issued until final approval is obtained."
I am attaching to this memo an ordinance which I assume the Council would
like to see. This would eliminate this procedure totally from our filing process. Assuming that
is the wish of the Council, let me know and we'll start the process of hearings before Planning
Commission and City Council. CITY COUNCIL ACTION:
