APPROVE a Memorandum of Understanding (MOU) Between the Joslyn Senior Center and the City of Palm Desert as it relates to the Maintenance of the Center's Lawn Bowling Green. 2. AUTHORIZE the Mayor to execute the finalized agreement, substantially as to form. 3. ALLOCATE $10,000 from the unobligated General Fund Reserves. Backqround In 2005, the Joslyn Senior Center (JSC) Board made a decision to discontinue lawn bowling at the Center based on the fact that the venue was not recovering maintenance and operating costs. Many individuals who participate in this activity subsequently contacted the City to express their concern over the recommended closing of the green. In early 2006, after exploring construction of a City lawn bowling green, staff recommended entering into an agreement with JSC to fund the operation and maintenance cost of its green. It was estimated that the cost to construct a City green was $185,000, exclusive of maintenance costs. Therefore, the City entered into a two year agreement with JSC to fund the Center's lawn bowling maintenance costs at an annual rate of $10,000. In 2008, City Manager Carlos L. Ortega authorized extending the contract through the end of Fiscal Year 2008/2009. � Joslyn Senior Center Lawn Bowling Page 2 of 2 August 27, 2009 Joslyn Senior Center's Executive Director recently sent correspondence to the City Manager to ascertain if the City would continue with funding the green's operation and maintenance cost this fiscal year, in the amount of $10,000. Staff respectfully recommends that the City Council approve the MOU agreement with Joslyn Senior Center for the maintenance of the Center's lawn bowling green. The agreement commences on September 1 , 2009 through June 30, 2010. The Center would be required to provide an expense report to the City and reimburse any unused funds. Wohlmuth MF,f;TING DATE_ - �7-Z; ^ �� �� ity Manager AYFS:.�'ZNn��n.��r��us-�F-i2� j ,��,7�._ NOES: _�3�n�. � AI3SF,NT: �1an�e � A13STAIN:�U�e _ �--� VF,RIFIEU I3Y;�n�-�rU Ori�inal on File with City Clerk s Oftice G:ICITYMGRISTEPHENARYANIAGENDAREPORTSVSCL4WNBOWLWGMOU.00C � Contract No. C29180 MEMORANDUM OF UNDERSTANDING BETWEEN THE JOSLYN SENIOR CENTER AND THE CITY OF PALM DESERT AS IT RELATES TO THE MAINTENANCE OF THE CENTER'S LAWN BOWLING GREEN Whereas, Since 1981, the Joslyn Senior Center (JSC) has been serving the seniors of the City of Palm Desert (CITY) to encourage them to lead active, stimulating, and rewarding lives; and , Whereas, JSC has made available a lawn bowling green for individuals to participate in lawn bowling; and Whereas, up to forty (40) people use the green three days per week during season; and Whereas, in 2005, the JSC made a decision to discontinue lawn bowling due to unrecoverable maintenance and operation costs; and Whereas, in 2006, CITY staff determined that the cost of constructing a lawn bowling green was $185,000; and Whereas, there is limited space available to construct a lawn bowling green at the Civic Center Park; and Whereas, in 2006, the JSC and CITY entered into a two year agreement (2006- 2008) in which the CITY paid $10,000 annually for the maintenance and operations of JSC's lawn bowling green; and Whereas, in 2008, the City Manager authorized extending this agreement through FY2008/ 2009 Now, therefore, it is agreed that CITY will assist JSC with the operation and maintenance of the lawn bowling green as follows: 1. CITY will allocate $10,000 for the purpose of funding operation and maintenance costs of JSC's lawn bowling green. 2. This MOU is for operation and maintenance cost reimbursement between the period of September 1, 2009 through June 30, 2010. 3. This MOU will not be modified in any way, without the mutual consent of all parties involved. 4. Upon conclusion of the MOU term, JSC will provide CITY a detailed expense report for lawn bowling operation and maintenance costs incurred between September 1, 2009, and June 30, 2010. Any unused funds shall be reimbursed to the CITY. PAGE 1 of 2 Contract No. C29180 In Witness Thereof, this Memorandum of Understanding has been executed this day of August, 2009, for a period of nine months, after which it may become eligible for renewal, subject to agreement by both parties.
