Authorize the Desert Recreation District to hold their 4th Annual "Desert Rock" Concert Series in the Palm Desert Civic Center Park Amphitheater; and 2. Authorize the Desert Recreation District to provide food vendors at the event. 3. Approve contribution of Sheriff's Department services in the amount of $1,059.04. Discussion: The Desert Recreation District is planning for their fourth annual "Desert Rock" concert series to be held at the Civic Center Park Amphitheater in October 2009. If approved, "Desert Rock" will be scheduled for October 8 and 15, 2009. The concerts will be held on Thursdays, from 6:00 p.m. to 9:00 p.m. with the following acts scheduled to perForm: • October 8, 2009: Dave Mason - who is a member of the Rock & Roll Hall of Fame. See attached bio for more details. • October 15, 2009: John Waite - was a member of The Baby's and Bad English in addition to his solo career. See bio for additional information. Opening acts have yet to be determined. The District is requesting the City's support for the event. At the July 21, 2009, Parks and Recreation Commission meeting, the Commission voted unanimously to recommend to Staff Report Authorize "Desert Rock" Concert Series August 27, 2009 Page 2 of 2 the City Council to schedule the concerts at the Palm Desert Civic Center Amphitheater. The District received conditional use permits from the City Manager for the concerts in 2007 and 2008. Set up for the event would begin at approximately 7:30 a.m. on the day of the show. As in the past, the District is requesting to have a few vendors on site. They utilize contracts for service with a hot dog vendor and Ben & Jerry's Ice Cream for a variety of District events including Desert Rock. Both vendors will donate a portion of their proceeds back to the Coachella Valley Community Recreation Foundation. The District is also requesting that the City contribute Sheriff's assistance during the shows. Lt. Andrew Shouse has prepared a cost for sheriff assistance for each concert (see attached). The District is also providing uniformed event security and Desert Recreation District team members as well. Staff recommends that the City Council approve the Desert Recreation District's request to hold the fourth annual "Desert Rock" concert series in the Civic Center Park's Amphitheater on October 8 and 15, and allow vendors to provide refreshments at the event. Pursuant to previous correspondence and conversations, the Desert Recreation District Concert Series is permitted for October 8t" and 15th, 2009, from 6:00 p.m. to 9:00 p.m. subject to the following conditions. Set up will begin at approximately 7:30 a.m. and clean up will take place the night of the event with any additional clean up completed the following morning by 9:00 a.m. 2. Since City Ordinance prohibits amplified sound prior to 9:00 a.m. or after 9:00 p.m., any and all broadcasting is prohibited prior to or after these times. CVRPD Staff has received, understands, and will abide by the City of Palm Desert's Noise Ordinance Chapter 9.24. 3. Due to the size and nature of this event, law enforcement personnel will be required as detailed in attached memo from Lieutenant Andrew Shouse, at a cost of $1,059.04, with an understanding that this is a minimum staffing requirement and may be subject to change. 4. No staking for signage is permitted in public right-of-ways. 5. As the event organizer, you or your representative will be onsite the day of the event and available to address any staff concerns which might arise at that time. 6. Vehicles, trucks, or carts participating in or required for this event must not be parked on or blocking sidewalks. Vehicles may drive on sidewalks to load and unload only, and must be parked in the parking lot during the event. Violators will Be cited. The exception to this being police, park patrol and maintenance Staff golf carts, bicycles, and Seg-ways. 7. Sale of any merchandise and concessions will be permitted on a limited basis, provided a plan is presented in advance to the Parks and Recreation Services Manager. 8. No alcoholic beverages will be allowed at this event. Mr. Craig DeWitt— Conditional Use Permit Page 2 of 2 August 27, 2009 9. No barbeques will be allowed at the event site. 10. Security aisles will be required to allow law enforcement and/or fire personnel quick access to the crowd. Parks staff will assist with identifying these aisles on event day. 11. Private security will be hired by the promoter to handle backstage (two minimum) and front of stage (two minimum). 12. One month prior to the event, you must provide the City of Palm Desert a certificate of insurance naming "the City of Palm Desert; its council, employees, agents, and volunteers" as co-insured's in the amount of$1,000,000. 13.Two weeks prior to the event (or more), you must contact Lt. Andrew Shouse of the Palm Desert Police Department (836-1615) and Janis Steele, Parks and Recreation Services Manager (776-6423) to finalize arrangements and details of the event to include event staffing, review parking and traffic plans, and event details. 14. Neighborhoods immediately east and north of the park will be notified of the event at least 30 days prior to the event. 15. Receipt of this document at the City of Palm Desert is required at least 30 days prior to the event. Please indicate your acceptance of these conditions by signing as indicated below and returning one original copy of this document to me. My receipt of it will constitute issuance of your conditional use permit. 16. Opening acts must be submitted to the City for approval 30 days in advance of the evnt.
