Discussion: The Gas Company is attempting to schedule a non-emergency excavation in response to repeated complaints of a gas leak from a resident on Pitahaya Street. The Gas Company applied for an encroachment permit to perform the non-emergency excavation. The application was denied based on the fact that Pitahaya Street was re-paved in November 2007 and the street is under the three-year pavement excavation moratorium. The resident continues to complain of a gas smell, however, The Gas Company has indicated that there is no safety concern requiring immediate attention. Staff is requesting direction from Council on waiving the moratorium, which would allow The Gas Company to excavate in Pitahaya Street. Submitt d y: Approved By: t Mark Gree wood, P.E. n M.
