2. Authorize the Finance Director to set aside the amount of $99,270 as
10 percent contingency (use of contingency requires additional action).
Funds are available in Account No. 233-4602-454-4001 ($359,586), Park Fund; and
Account No. 851-4549-454-4001 ($633,114), Project Area 2 Aquatic Facility Capital
Budget. Contingency funds are also available in Account No. 851-4549-454-4001. No
General Fund money is being used for this expenditure.
Backqround
Staff was directed to revisit the City of Palm Desert's aquatic center project by reviewing
design amenities and site locations in the Civic Center area for an aquatic center-only
facility, and to eliminate the community center portion of the project that was presented
to the City Council in January 2009.

On September 24, 2009, the City Council approved the Civic Center Park site (south of
the Date Grove) as the site for an aquatic center, the conceptual design as presented,
and authorized staff to proceed with a request for proposal (RFP) for architectural
design and construction support services based on the conceptual design.
On October 22, 2009, an RFP was issued for design and construction support services
for the Civic Center Park Aquatic Center Project (see attached). Proposals were
submitted on November 13, 2009. Thirty-five (35) proposals were received.
The selection team comprised of five (5) City staff members reviewed and scored all
proposals. Five (5) consultants were selected for interviews, which were held on
November 19, 2009. Gould Evans Associates was unanimously selected by the review
committee as the desired consultant.
Staff is requesting that the City Council approve a contract (attached) with Gould Evans
Associates in an amount not-to-exceed $992,700 for design and construction support
services for the City's aquatic center project. Staff is also requesting that the Finance
Director set aside the amount of$99,270 as 10 percent contingency.
Fiscal Analysis
Total estimated construction cost of the project is $11,133,581 and includes the
$992,700 for design and construction support services. There will be no additional cost
for construction management services for this project as this service is included as part
of the Gould Evans Associates contract. College of the Desert is planning to contribute
$1,000,000 toward the project. The Estimated Operating Cost i $1,248,907 annually.

DESIGN AND CONSTRUCTION SUPPORT SERVICES
FOR CIVIC CENTER PARK AQUATIC CENTER PROJECT
PUBLIC NOTICE IS HEREBY GIVEN that the City of the Palm Desert, as
AGENCY, invites proposals for the above stated services and will receive such
proposals in the offices of the Public Works Department before 2:00 p.m. on
November 13, 2009. Proposals received after this date will be returned to the
Consultants unopened. Faxed or electronically submitted proposals will not be
accepted.
The City of Palm Desert is seeking an architectural and/or engineering firm to
provide planning, architecture and engineering consultant services, as well as
construction support services for the development of a Municipal Aquatic Center
(see attached sketch) having a budget of $10,000,000.00 (ten million). The
consultant will be required to work closely with City staff and to make
presentations to the City Planning Commission and City Council. This Request
for Proposal (RFP) is intended to provide the general information needed to
provide a response to this request.
The Consultant services consist of professional architectural design, engineering
and technical services required to generate plans, specifications, construction
documents and an estimate for the installation of a community aquatic center in
Civic Center Park, 73-510 Fred Waring Drive, Palm Desert, California. Services
will include, but are not limited to, 1) field surveying and utility locations, 2)
construction drawings, 3) technical specifications, 4) PM10 Plan, 5) Water
Quality Management Plan (WQMP), 5) Storm Water Pollution Prevention Plan
(SWPPP), 6) geotechnical plan, 7) hydrology study, and 8) construction cost
estimate.
By submitting a proposal the Consultant assures that they have the necessary
expertise to provide aquatic center design and construction support services.
It is the City's intent that all firms obtain the full content of this Request for
Proposals (RFP) and any addenda via the City's website located at
www.cityofpalmdesert.orq and from the main menu, under "Quick Links," click on
"Projects Up For Bid". Primary firms that anticipate submitting a proposal are
required to send a letter to the City acknowledging receipt of the RFP to the
address specified below so that the City can add the firm to its notification list.

Proposals submitted to the City must comply with the "Key RFP Dates" listed on
the cover page of the Request for Proposals, and must comply with Section I,
"Instructions to Consultants" and must contain all of the information requested in
Section II, "Proposals ContenY', for the Scope of Services in Section IV.
Proposals will be evaluated and ranked in accordance with Section III,
"Evaluation and Award." The final ranked firms must be willing to sign an
agreement with the terms and conditions shown in the City Proposed Draft
Agreement in Section V.
A pre-proposal conference will be held on October 28, 2009 - 1:00 p.m. at the
City of Palm Desert, 73510 Fred Waring Drive, Palm Desert, CA 92260 in the
Community Services Conference Room. All prospective Consultants are
encouraged to attend the pre-proposal conference. Any answered and
unanswered questions from the pre-proposal conference will be addressed in an
addendum. All changes to the Request for Proposals, if any, will be addressed
through the issuance of an Addendum to the RFP.
All questions must be submitted in writing and must be received by the City
before 5:00 p.m. on November 9, 2009. Please note that the City will not be
responsible for mailing any addenda. All addenda will be published on the City's
website. Consultants are encouraged to check the website regularly since each
Consultant will be responsible for downloading the RFP and all addenda.
Interviews are scheduled for November 19, 2009 at the City of Palm Desert,
73510 Fred Waring Drive, Palm Desert, CA 92260 in the Public Works
Conference Room. Please keep this date open. Failure to appear at the interview
will cause the Consultant to be eliminated from further evaluation. The City
reserves the right to postpone the interview date, or cancel an interview, at its
sole discretion. Consultants shall be notified in advance of any such
postponement or cancellation.

SECTION I - INSTRUCTIONS TO CONSULTANTS

SECTION I — INSTRUCTIONS TO CONSULTANTS
A. PRE-PROPOSAL CONFERENCE
A pre-proposal conference will be held on October 28, 2009 - 1:00 p.m. at the
City of Palm Desert, 73510 Fred Waring Drive, Palm Desert, CA 92260,
Community Services Conference Room. All prospective Consultants are
encouraged to attend the pre-proposal conference.
B. EXAMINATION OF PROPOSAL DOCUMENTS
By submitting a proposal, Consultant represents that they have thoroughly
examined and become familiar with the work required under this RFP and
that they are capable of performing quality work to achieve the City's
objectives.
C. ADDENDA
The City reserves the right to revise the RFP documents. Any City changes to
the requirements will be made by written addenda to this RFP. Any written
addenda issued pertaining to this RFP shall be incorporated into the terms
and conditions of any contract resulting from this RFP. The City will not be
bound to any modifications to or deviations from the requirements set forth in
this RFP as the result of oral instructions. Consultants shall acknowledge
receipt of addenda in their submittal. Failure to acknowledge receipt of all
addenda may cause the consultant to be deemed non-responsive to this RFP
and be rejected without further evaluation.

Except for Janis Steele, Parks and Recreation Services Manager, no contacts
of any kind shall be made with any of the City's staff. It is intended that the
Consultant selection shall be made on merit alone within the process
described in this RFP. Violation of this condition shall be cause for immediate
disqualification of a ConsultanYs submittal.

E. CLARIFICATIONS AND QUESTIONS
1. EXAMINATION OF DOCUMENTS
Consultant is responsible for reviewing the RFP documents prior to the
Submittal Due Date and for requesting clarification or interpretation of any
discrepancy, deficiency, ambiguity or error, or omission contained in the
RFP documents. Consultant shall notify the City in writing, in accordance
with Section E.2. below, and should it be found by the City that the point in
question is not clearly and fully set forth; the City will issue a written
addendum clarifying the matter, which will be posted on the City's website.
2. SUBMITTING REQUESTS
a. All questions, including questions posed and responded to at the pre-
proposal conference, must be submitted in writing and must be
received by Janis Steele, Parks and Recreation Services Manager,
before 5:00 p.m. on November 6, 2009 .
b. Requests for clarifications, questions, and comments must be clearly
labeled, "Written Questions: RFP — CIVIC CENTER PARK
AQUATIC CENTER PROJECT. The City is not responsible for failure
to respond to a request that has not been appropriately labeled, and
addressed to City of Palm Desert, Department of Public Works, Janis
Steele, Parks and Recreation Services Manager.
c. Any of the methods of the City Contact set forth above may be utilized
for delivering written questions as long as the questions are directed to
Janis Steele, Parks and Recreation Services Manager, and received
no later than the date and time specified above.

3. CITY'S RESPONSES
Responses from the City will be posted on the City's website no later than
48 hours prior to the submission deadline. Consultants may download
responses from the City's website at www.cityofpalmdesert.orq.

F. SUBMISSION OF PROPOSALS
1. DATE AND TIME
Proposals must be submitted before 2:00 p.m. on November 13,
2009. Submissions received after the specified date and time will be
rejected without consideration or evaluation. Submissions may be
delivered via U.S. Mail, personal delivery or commercial courier service to
the address specified above. The City is not responsible for any proposals
received after the submittal time that are not appropriately labeled and
addressed.
2. IDENTIFICATION OF PROPOSALS
Consultant shall submit one (1) original unbound and ten (10) bound
copies of its proposal in a sealed package. The package shall be
addressed as shown above, bearing the ConsultanYs name and address
and clearly marked as follows:
"RFP: CIVIC CENTER PARK
AQUATIC CENTER PROJECT"
Consultants shall be entirely responsible for any consequences resulting
from any inadvertent opening of unsealed or improperly identified
packages. It is the Consultants' sole responsibility to see that its proposals
submittal is received as required.
3. ACCEPTANCE OF PROPOSALS/CITY'S RIGHTS
a. The City reserves the right to accept or reject any and all submittals, or
any item or part thereof, or to waive any informalities or irregularities in
the submittals.
b. The City reserves the right to withdraw or cancel this RFP, or any part
hereof at any time without prior notice and the City makes no
representations that any contract will be awarded to any Consultant
responding to this RFP.
c. The City reserves the right to issue a new RFP.
d. The City reserves the right to postpone submittal openings for its own
convenience.
e. The City reserves the right to require confirmation of information
furnished by Consultant or for the Consultant to provide additional
evidence of qualifications to perform the work or to obtain information
from any source that has the potential to improve the understanding
and evaluation of the submittals.
f. Submittals received by City are considered public information and will
be made available upon request after award.

g. Submittals are not to be copyrighted.
G. PRE-CONTRACTUAL EXPENSES
The City shall not, in any event, be liable for any pre-contractual expenses
incurred by Consultant in the preparation of its submittal. In the event of
award, Consultant shall not be entitled to charge the City for any pre-
contractual expenses.
Pre-contractual expenses are defined as expenses incurred by Consultant in:
a. Preparing its proposal in response to this RFP;
b. Submitting proposal to the City;
c. Negotiating with the City any matter related to this solicitation; or
d. Any other expenses incurred by Consultant prior to date of award, if
any, of the Agreement.
H. JOINT OFFERS
Where two or more firms desire to submit a single proposal in response to
this RFP, they should do so on a prime-subcontractor basis rather than as a
joint venture. The City intends to contract with one or more firms and not with
multiple firms doing business as a joint venture.
I. CONTRACT TYPE
It is anticipated the agreement resulting from this solicitation, if awarded, will
be a fixed-price or lump sum type contract.
J. INSURANCE REQUIREMENTS
The Consultant will be required to have in effect for the duration of the
contract insurance coverage acceptable to the City. Prior to issuance of the
Notice to Proceed, the consultant will submit to the City insurance certificates
naming the City as an additional insured. At a minimum, the Consultant will
be required to maintain the following coverage within the specified limits:
General Liability $1,000,000 peroccurrence;
$2,000,000 general aggregate
Errors and Omissions $2,000,000 per claim
Automotive Comprehensive $1,000,000 each accident
Worker's Compensation Statutory Limits

K. CONFLICT OF INTEREST
All Consultants responding to this RFP must avoid organizational conflicts of
interest which would restrict full and open competition in this procurement. An
organizational conflict of interest means that due to other activities,
relationships, or contracts, a Consultant is unable, or potentially unable, to
render impartial assistance or advice to the City; a Consultant's objectivity in
performing the work identified in the Scope of Work is or might be otherwise
impaired; or a Consultant has an unfair competitive advantage.
L. COST PROPOSAL
No cost is being requested with this RFP. However, all consultants that are
shortlisted and interviewed will be required to provide sealed cost proposals
at the time of their interview on November 19, 2009. Short-listed Consultants
will be given instructions on the requirements for the cost proposals.

A. PROPOSAL FORMAT AND CONTENT
1. FORMAT
Submittals should be typed, double-spaced and submitted on 8.5-inch x
11-inch paper, using a minimum of 12-point font, with a single method of
fastening. Charts and schedules may be included in 11" x 17" format.
Consultants should not include any unnecessarily elaborate or
promotional material. It will be discarded. Lengthy narratives are
discouraged and presentations should be brief and concise. Please submit
(1) original unbound and ten (10) bound copies. Submittals should not
exceed TWENTY-FIVE (25) pages in length, excluding any appendices,
covers and dividers. All pages shall be sequentially numbered and each
section should be separately and clearly tabbed. Submittals should
include a complete table of contents for the entire document with
respective page numbers opposite each topic that is included. A CD in
PDF format of the proposal is also required.
2. LETTER OF TRANSMITTAL
The Letter of Transmittal shall be addressed to Janis Steele, Parks and
Recreation Services Manager, and must, at a minimum, contain the
following:
a. Identification of Consultant that will have the authorization to commit to
the contractual terms and conditions. Identification shall include legal
company name, corporate address, telephone, fax number and e-mail
address. Include name, title, address, telephone number and e-mail
address of the contact person during the proposal evaluation phase.
b. State, year founded, and founder with individual credentials.
c. Provide tax ID (State & Federal) & copy.
d. List the number of employees from primary or submitting firm. Provide
discipline/responsibility of each employee. Highlight only those
employees that will appear on the "Organization Chart". If the Aquatics
Architect/Engineer is not the same firm as the Building/Bathhouse
Architect/Engineer, firm information on each will need to be provided
(as prescribed above) and the relationship between the two firms
clearly delineated in the organization chart and team members
identified with appropriate firm.
e. As indicated in "d" above, identification of proposed subcontractors,
including legal company name, contact person's name, address,

phone number, and working relationship between Consultant and
subcontractors, if applicable.
f. Acknowledgment of receipt of all RFP addenda, if any.
g. A statement to the effect that the proposal shall remain valid for a
period of not less than 120 days from the date of submittal.
h. Signature of a person authorized to bind Consultant to the terms of the
any contract resulting from the submittal.
i. A statement to the effect that by signing the letter of transmittal,
Consultant is attesting that all information submitted with the submittal
is true and correct.
3. TEAM ORGANIZATIONAL CHART (1 PAGE)
Include a project organization chart, which clearly delineates the work
and communication/reporting relationships among the project team
and staff.
4. TECHNICAL PROPOSAL
a. Qualifications, Related Experience and References of Consultant
This section of the submittal should establish the ability of Consultant
to satisfactorily perform the required work by evidence of: experience
in performing work of a similar nature; demonstrated competence in
the services identified in Exhibit A; experience with other public
entities; strength and stability of the firm; staffing capability; work load;
record of ineeting schedules on similar projects; and supportive client
references.
Consultant shall:
• Provide a brief profile of the firm, including the types of services
offered; the year founded; form of the organization (corporation,
partnership, sole proprietorship); number, size and location of
offices; and number of employees.
• Provide a general description of the firm's financial condition and
identify any conditions (e.g., bankruptcy, pending litigation, planned
office closures, impending merger) that may impede Consultant's
ability to complete the project.
• Describe the firm's experience in performing work of a similar
nature to that solicited in this RFP, and highlight the participation in
such work by the key personnel proposed for assignment to this
project. Describe experience in working with the various
government agencies identified in this RFP.

• Identify subcontractors by company name, address, contact
person, telephone number and project function. Describe
ConsultanYs experience working with each subcontractor.
• At a minimum three (3) references shall be provided. Furnish the
name, title, address and telephone number of the person(s) at the
client organization who is most knowledgeable about the work
performed. Consultant may also supply references from other work
not cited in this section as related experience.
b. Management Approach
This section of the submittal should establish the method, which will be
used by the Consultant to manage the project as well as identify key
personnel assigned.

Identify each of the individuals comprising the proposed team to be
assigned to this project and the specific role of each in completing the
work. These individuals should be available to attend the interview
(upon request of the City) should your firm be selected to continue in
interview and selection process. This list of professionals should include
both in-house and/or consultants and associates to be employed and to.
assist or contribute on this project. Indicate each member and clearly
delineate which firm they are employed by. Only the following
information should be supplied for each proposed member to be
assigned to the project:

Consultant Shall:
Provide a single 8.5-inch x 11-inch page for each project, list at least
three (3) separate municipal aquatic center projects of similar size and
scope, recently completed. Provide client references that can clearly
affirm your proposed team member involvement and have knowledge
of the professionals that provided expertise on the project. A
character picture may be included on each project sheet utilized as
exemplar:

c. Technical Approach/Work Plan
Consultant shall provide a narrative that addresses the Scope of Work
and shows Consultant's understanding of City's needs and
requirements.

Consultant shall:
• Describe the approach and work plan for completing the tasks
specified in the Scope of Work. The work plan shall be of such
detail to demonstrate the Consultant's ability to accomplish the
project objectives and overall schedule.
• Outline sequentially the activities that would be undertaken in
completing the tasks and specify who in the firm would perform
them.
• Furnish a project schedule for each task and subtask in terms of
elapsed weeks from the project commencement date. Include the
construction management phase.
• Identify methods that Consultant will use to ensure quality control,
as well as budget and schedule control for the project.
• Identify any special issues or problems that are likely to be
encountered during the project and how the Consultant would
propose to address them.
• Include a graphic chart indicating the anticipated duration, start and
completion dates for tasks, keys to scope of work and integrating
critical elements, indicating a percentage of completion at each
critical juncture.
• Consultant is encouraged to propose enhancements, procedural, or
technical innovations to the Scope of Work that do not materially
deviate from the objectives or required content of the project that
may result in time and/or cost savings during design or
construction.
d. Conflict of Interest
Consultant is to identify any real or apparent organizational conflict of
interest relating to this project.
e. Exceptions/Deviations
State any exceptions to or deviations from the requirements of this
RFP, segregating "technical" exceptions from "contractual" exceptions.
Where Consultant wishes to propose alternative approaches to
meeting the City's technical or contractual requirements, these should
be thoroughly explained.
5. APPENDICES
Information considered by Consultant to be pertinent to this RFP and
which has not been specifically solicited in any of the aforementioned

sections may be placed in a separate appendix section. Consultants are
cautioned, however, that this does not constitute an invitation to submit
large amounts of extraneous materials. Appendices should be relevant
and brief. If Consultant chooses to provide additional information in a
separate appendix, Consultant is encouraged to identify, in the appendix,
why Consultant believes such information is pertinent to the RFP.
6. DRAFT AGREEMENT— SECTION V
Consultants shall familiarize themselves with the City's Draft Agreement
(Section V) and all the Attachments attached thereto. The City intends to
use the attached Draft Agreement as the contract resulting from this RFP.
At the time of the proposal submission, should the Consultant have
concerns or recommended changes to the Draft Agreement requirements,
then those concerns/recommended changes must be included in writing in
the submittal. The City may consider or negotiate changes to the Draft
Agreement with the successful Consultant only to the extent the changes
are provided to the City in writing within the proposal at the time of
submission. Changes to the City's Draft Agreement shall be made at the
City's sole discretion.

A. PROPOSAL EVALUATION CRITERIA
1. QUALIFICATIONS OF THE FIRM 30%
Technical experience in perForming work of a similar nature, experience
working with other public agencies, specialized experience, and
professional competence in areas directly related to this RFP. Strength
and stability of the firm, strength, experience, and technical competence of
subcontractors, as well as assessment of client references.
2. MANAGEMENT APPROACH 25%
Qualifications as identified in this RFP. Commitment of project staff,
including their past experiences. Key personnel, especially the Project
Manager; and level of involvement in perForming related work cited in
"Qualifications of the Firm" section. References from past projects, logic of
project organization, and concurrence in the restrictions on changes in key
personnel.
3. TECHNICAL APPROACH/WORK PLAN 30%
Depth of Consultant's understanding of City requirements and overall
quality of the technical approach and work plan; logic, and clarity of work
plan; appropriateness of labor distribution among the tasks; ability to meet
or better the City draft project schedule; utility of suggested technical or
procedural innovations and the identification of special issues and
Consultant's response in resolving those issues.
4. COMPLETENESS OF RESPONSE 15%
Overall completeness and thoroughness of response in accordance with
RFP instructions; exceptions to or deviations from the RFP requirements
that the City cannot or will not accommodate; or other relevant factors not
considered elsewhere.
B. EVALUATION PROCEDURE AND AWARD
1. An evaluation committee will be appointed to review all proposals
received. The committee is comprised of City staff and may include
outside personnel. The committee members will read the proposals
separately then convene to discuss and review the written proposals.
Each member of the selection panel will then evaluate each proposal
using the criteria identified herein to arrive at a score for each proposal.
The references given by the proposed short-listed consultants will be
checked and scored. Firms within a competitive range will be short-listed

for interviews based upon the average of the evaluation committee
members' score for each proposal and the reference scores.
2. The City has established November 19, 2009, as the date to conduct
interviews. All prospective Consultants will be asked to keep this date
available. No other interview dates will be provided. Therefore, if a
Consultant is unable to attend the interview on this date, its proposal may
be eliminated from further discussion. The interview will consist of a short
presentation by the Consultant after which the evaluation committee will
ask questions related to the project and the firm's proposal and
qualifications. The committee will use pre-established criteria to score the
interviews.
3. The short-listed Consultants will be requested to bring their cost proposals
in a sealed envelope to the interviews. The City Project Manager will open
and score the cost proposals. The cost proposal scores will be determined
by the relative deviation (plus or minus) from the Project Manager's
estimate.
4. The location of the firm and subconsultants will be scored by the Project
Manager. The scoring for location is summarized as follows:
• 100%-location is in Coachella Valley
• 75%-location is Riverside or San Bernardino Counties
• 50%-location in Southern California
• 25%-location in State of California
The scores for the location will be weighted so that location of the prime
consultant is 75% and the location of subconsultants is 25% of the
location score. The locations of the prime consultant and subconsultants
shall be deemed as to where the majority of the work is performed.
5. The overall scoring and ranking of Consultants will consist of:
• Proposal Score, including adjustment for reference checks (40%)
• Interview Score (40%)
� Cost Score (10%)
• Location Score (10%)
6. The highest ranked firm will then be notified. The final project scope, cost,
and contract will be negotiated with the selected firm. If unable to
negotiate a contract, negotiations will commence with the next highest
ranked firm.

C. NOTIFICATION OF AWARD AND DEBRIEFING
Consultants who submit a proposal in response to this RFP will be notified by
mail regarding the firm who was awarded the contract. Such notification shall
be made within three (3) days after the contract is awarded. Consultants who
were not awarded the contract may request a debriefing in writing or
electronic mail.

A. GENERAL INFORMATION
1. INTRODUCTION
The project is located in the Civic Center Park which is part of the City's
Civic Center Complex at 73-510 Fred Waring Drive. It is a 7.8 acre parcel
located in the park south of Magnesia Falls Drive and east of the ball
fields. The project will occupy an area that includes a significant date
grove which has historical significance, and will be utilized for parking. The
aquatic center will require parking, bathhouse, staff offices, family
changing rooms, concession stand, multi-use room, a 50-meter x 25 yard
competition pool, zero-depth entry recreation pool, diving boards ( two 3-
and two 1- meter boards), water polo, shade structures, bleachers, slides,
play features, and landscaped areas. Support amenities such as fencing,
concrete deck, irrigation and shade will also be part of this project, as they
pertain to the development of an aquatic center. See conceptual design
and preliminary site plan in Section VI.
The Consultant shall provide all plans, specifications and estimates
necessary to comply with all Federal, State, Regional and Local
regulations for the construction and operation of the desired aquatic
center.
The schedule for the project is as follows:
1. October 22. 2009: RFP for Aquatic Center Design Services and
Construction Support Services (posted).
2. October 28. 2009: Pre-proposal Meeting — 1:00 pm — Community
Services Conference Room.
3. November 13. 2009: Proposals due.
4. November 19, 2009: Interviews.
5. December 10, 2009: Recommendation to the City Council.
6. January 4, 2009: Commence Design
7. Julv 1, 2010: Out to bid for aquatic center construction.
8. Auqust 2010: Award bid for construction.
9. September 1, 2010: Construction begins.

The following is a list of items to be addressed throughout design,
development and construction of the aquatic facility. Please provide a
timeline for all expected work.

Preliminary site desipn and development (site outlined above):
1. Development of a site plan showing the location. Conducting a space-
needs study to determine the proper size of the new facility and parking
requirements for the site.
2. Development of a master site plan, building elevation, and basic floor
plan, showing the location of the aquatic center and accommodations for
parking. Building floor plan should include check in area, men's and
women's changing rooms, family changing rooms, concession stand,
mechanical room, chemical storage, storage, staff offices, and multi-use
room. Pool area should include layout of competition and recreation pool,
slides, bleachers and shade structures.
3. Prepare preliminary water quality management plan.
4. Coordinate all utility services.
5. Architectural renderings (elevations) of the proposed aquatic center.
6. Provide cost estimate for preliminary design, site improvements, and
new structures.
While the City will work closely with the consultant toward a site plan and
facility design, the City's goal is to develop a site plan and building design
that creates a "campus environment" that relates closely with the existing
park, ball fields and Civic Center complex. As a result, the City is not
seeking to develop a building that will act as a community "focal poinY', but
rather one that will meet the City's service needs within a campus
environment. There is a berm on the east side of project area that should
be utilized to provide a buffer to the neighbors east of the park. Soil from
the project can be utilized to increase the berm for maximum buffering
effects.
The preliminary proposal should also include the following:
1. Preliminary landscape design and preliminary engineering for the
proposed development;
2. Location and identification of Cooling/Heating systems, alarm system,
video surveillance, and timing system.
3. Geotechnical soil study.
4. Hydrology study and calculations.
5. Description and evaluation of the methods used for preparing and
suggesting new sustainable technologies to be incorporated into the
design and construction of the proposed project. The project will be

designed to exceed current Title 24 standards, and meet a minimum
L.E.E.D certification.
6. An understanding that there will be a public art component to the
aquatic center. An artist or artist team will be selected by the City
Council to work with the consultant. There is a line item in the aquatic
center to support the public art component. If applicable, list the
experience that team members have in working with public artists or
artist teams.
Desiqn Develoqment
1. Identify the approach used for design integration onto site.

3. Respond to RFI's and requests for clarification
4. Review construction progress
5. Prepare as built drawings

B. TASKS AND CONTRACT DELIVERABLES:
In general, project tasks will include, but are not limited to, the following:
1. PROJECT KICKOFF MEETING
Conduct a project kickoff design meeting with City staff to refine and clarify
the project's objectives and schedule. City supplied materials will be
provided at this time.
2. PROJECT SCHEDULE
A complete project schedule will be required as a part of this submittal.
This should include the City's review time (including plan checks). It
is the intent of this request to receive as a part of the proposal, a complete
schedule and work plan indicating how consultant proposes to allow the
City to complete the construction and begin operation of the proposed
facility by June of 2011.
3. DATA COLLECTION, FIELD REVIEW & BASE MAPPING
The Consultant's key staff will visit the site to familiarize themselves with
the project site conditions. Project staff will take ground level photos to
document field conditions and highlight critical areas. Project staff will visit
the site after completion of the base map to verify base map accuracy.
Field review shall include geotechnical analysis to establish design and
construction recommendations, excavation and pipe bedding
requirements. The analysis shall minimally include soil classification
determination, in-situ density and moisture content determination,
maximum density/optimum moisture determination, shear strength
determination, sulfate content determination, and soil percolation rates,
etc.
4. ENVIRONMENTAL REVIEW (TO BE PERFORMED BY CITY STAFF)
The Planning Department will prepare an environmental Initial Study (IS)
as described in Section 15365 of the California Environmental Quality Act
(CEQA) Guidelines and applicable case law. It is assumed that the
appropriate level of CEQA documentation for the proposed project will be
either a Negative Declaration (ND), or Mitigated Negative Declaration
(MND). The Planning Department will prepare a Notice of Availability and
Notice of Intent to Adopt a ND, or MND for review. After public review
period has ended, the Planning Department will respond to any
comments.

Following adoption of the environmental documents by the City of Palm
Desert, a Notice of Determination (NOD) will be filed with the County Clerk
and the Governor's Office of Planning and Research. In compliance with
public Resources Code 21081.6 a mitigation monitoring program for
adoption with the MND, if required.
5. PROJECT DESIGN AND PLAN SET PREPARATION
Project Plans will be prepared base upon the Consultant's pre-design
report and concurrence by the City. The project plans should include, but
are not limited to, a Title Sheet, Site Plan, Precise Grading Plan, Drainage
Plan, Street Improvement Plan, Traffic Control Plan, Building Plans, Pool
Plans, Electrical/Lighting Plans, Structural Plans, Mechanical Plans,
Landscaping Plans, Irrigation Plans and applicable Detail Sheets.
The plans shall be prepared in accordance with the standards set forth by
the City of Palm Desert. All above ground structures, swimming pools and
their components shall be designed in compliance with the most current
California Code of Regulations, Title 24 applicable at the time of plan
review submittal.
The plans and reports shall also be prepared by qualified California
registered civil, mechanical, electrical, structural, geotechnical, architect,
and landscape architect respectively.
Site development, swimming pools and other structures shall be designed
to meet all accessibility requirements per the 2008 amended American
with Disabilities Act, Title II and the latest edition of the California Code of
Regulations Title 24, Part Volume 1 and 2. The project plans will be
prepared using AutoCADO electronic drafting software program.
Additionally, the Consultant shall provide building elevations, renderings,
color palettes, section, all required studies and calculations.
The Consultant shall be responsible for coordinating all utility relocations
as required. The Consultant shall ensure that all the City's design criteria
and applicable codes are addressed.
Some of the detail plans shall include, but are not limited to, a detailed
view of the equipment, pump room, chemical, utility and mechanical
areas, concession area, and other ancillary areas. They shall also include
a piping schematic, identification of timing system placement, alarm
systems, video surveillance, means for disposing backwash/wastewater,
and HVAC plans.
6. SPECIFICATIONS
The City will provide bidding and contractual documents and general
provisions for the project. The Consultant will prepare the technical
specifications and verify that the technical specifications/special provisions

do not conflict with the project drawings, and add any additional special
provisions as required. A boiler plate specification will be provided to the
consultant in electronic file format.
7. ESTIMATES
The Consultant shall prepare construction quantity and cost estimates of
proposed improvements at the preliminary and final plan stages.
8. DELIVERABLES
Plans shall be submitted for plan check by e-mail in PDF electronic file
format, plotted at the appropriate sheet size and scale. A red line hard
copy of the City's plan check review comments will be returned to the
Consultant. We anticipate at least two plan check submittals will be
needed prior the submittal of the final plans. The final submittal shall
include: one (1) set of the plans on "D" size mylar sheets; two (2) hard
copies of the project specifications; two (2) hard copies of the quantity and
cost estimates; and one (1) CD disk containing electronic files of approved
plans (AutoCAD and PDF files), project specifications (Word format) and
quantity and cost estimate (Excel format).
C. OPTIONAL SERVICES
Upon written approval from the City, the Consultant will provide
engineering services beyond the work identified above. Services may
include the addition of new tasks or increasing the work effort of the
engineering services as requested by the City. Such work will be specified
by written authorization utilizing agreed upon rates.
D. DOCUMENTS FURNISHED
To assist the Consultant in fulfilling the terms of this Agreement when
possible, the City agrees to furnish the following:
1. Record drawings
2. GIS Data
Please note, the City will provide whatever documents are available, but
we do not guarantee their accuracy.
E. SCHEDULE
Upon notice to proceed, the Consultant must be able to complete the work
within the time frame identified in this Scope of Work.

AGREEMENT
THIS AGREEMENT, made and entered into this day of

corporation, hereinafter referred to as "CITY" and , hereinafter
referred to as "CONSULTANT".
WITNESSETH:
WHEREAS, CONSULTANT is a corporation, the principal members of which are
Professional CONSULTANTS duly registered under the laws of the State of California;
and
WHEREAS, CITY desires to engage CONSULTANT to render certain technical
and professional CONSULTING services as set forth in Exhibit "A" (CONSULTANT'S
Proposal of Services) in connection with the AQUATIC CENTER DESIGN AND
CONSTRUCTION SUPPORT SERVICES.
NOW, THEREFORE, the parties hereto agree as follows:
(1) CITY hereby agrees to engage CONSULTANT to perform the
technical and/or professional services as hereinafter set forth.
(2) CONSULTANT shall perform all work necessary within the
schedules provided herein to complete the services set forth in Exhibit "A" attached
hereto and by reference incorporated herein and made a part hereof.

(3) All information, data, reports and records and maps as are existing
and available from the CITY and necessary for the work outlined in Exhibit "A" hereof
shall be furnished to CONSULTANT without charge by CITY and CITY shall cooperate
in every way reasonable in the carrying out of the work without delay.
(4) CONSULTANT represents that, it employs or will employ at its own
expense, all personnel required in performing the services under this Agreement.
(5) All of the services required hereunder will be performed by
CONSULTANT or under its direct supervision, and all personnel engaged in the work
shall be qualified and shall be authorized or permitted under state and local law to
perform such services.
(6) The execution of this Agreement by the parties hereto does not
constitute an authorization to proceed. CITY's Director of Public Works has not
authorized CONSULTANT to proceed.
(7) The CONSULTANT shall work closely with the CITY's Director of
Public Works, or his designated representative, who shall be the principal officer of the
CITY. The CONSULTANT shall review and receive the Director of Public Works
approval of the details of work as it progresses. The Registered Architect of Engineer
hereby designated by the CONSULTANT as its representative for supervision of the
work required by this Agreement is {CONSULTANT NAME} R.C.E. or Architect License
No.
(8) The CONSULTANT warrants that he has not employed or retained
any company or person, other than a bona fide employee working solely for the

consultant, to solicit or secure this Agreement, and that he has not paid or agreed to
pay any company or person, other than a bona fide employee working solely for the
consultant, any fee, commission, percentage, brokerage fee, gifts, or any other
consideration, contingent upon or resulting from the award or making of this Agreement.
For breach or violation of this warranty, CITY shall have the right to annul this
Agreement without liability or in its discretion to deduct from the contract price or
consideration, or otherwise recover, the full amount of such fee, commission,
percentage, brokerage fee, gift or contingent fee.
(9) The right is reserved by the CITY to terminate the Agreement at
any time upon seven (7) days written notice, in the event the project is to be abandoned
or indefinitely postponed, or in the event the CONSULTANT'S services, in the sole
judgment of CITY, are unsatisfactory or because of the CONSULTANT'S failure to
prosecute the work with diligence or within the time limits specified or because of his
disability or death. In any such case, the CONSULTANT shall be paid the reasonable
value of the services rendered, based upon CONSULTANT'S standard hourly rates, up
to the time of the termination. The CONSULTANT shall keep adequate records to
substantiate costs and provide copies of original timecards in the event of termination or
suspension.
(10) All documents including tracings, drawings, estimates, reports,
investigations and computations shall be delivered to and become the property of the
CITY. CITY acknowledges and agrees that all plans, specifications, reports and other
design documents prepared by CONSULTANT pursuant to this agreement shall be
used exclusively on this project and shall not be used for any other work without the

written consent of CONSULTANT. In the event CITY and CONSULTANT permit the re-
use or other use of the plans, specifications, reports or other design documents, CITY
shall require the party using them to indemnify and hold harmless CITY and
CONSULTANT regarding such re-use or other use, and CITY shall require the party
using them to eliminate any and all references to CONSULTANT from the plans,
specifications, reports and other design documents.
(11) The CONSULTANT shall comply with all federal, state and local
laws, ordinances and regulations applicable to work.
(12) No change in the character or extent of the work to be performed
by the CONSULTANT shall be made except by supplemental authority in writing
between CITY and the CONSULTANT. The supplemental authority shall set forth the
changes of work, extension of time and adjustment of the fee to be paid by CITY to the
CONSULTANT, if any.
(13) In connection with the execution of this Agreement, the
CONSULTANT shall not discriminate against any employee or applicant for
employment because of race, religion, color, sex or national origin. The CONSULTANT
shall take affirmative actions to insure equal employment opportunity and that
employees are treated during their employment without regard to their race, religion,
color, sex or national origin. Such actions shall include, but not limited to, the following:
employment, upgrading, demotion or transfer; recruitment or recruitment advertising;
layoff or termination; rates of pay, or other forms of compensation and selection for

training, including apprenticeship. This clause shall be included in each related
subcontract, if any, awarded by the CONSULTANT.
(14) The CITY agrees to pay the CONSULTANT for the work required
by this Agreement on the following basis:
CONSULTANT shall submit invoices monthly for services performed in
the previous month not to exceed the total contract amount of: �
(Dollars: 00/100 ONLY1. CITY agrees to pay all undisputed invoices within thirty (30)
days of receipt of invoice. CITY agrees to notify CONSULTANT of disputed invoices
within fifteen (15) days of receipt of said invoice.
(15) The CONSULTANT agrees to complete the work and submit the
Final Design CONSULTING phase as displayed in Exhibit "A".
(16) In the event that any judgment is entered in any action upon this
Agreement, the party hereto against whom such judgment is rendered agrees to pay the
other party an amount equal to the reasonable value of the legal services performed in
his or its behalf in such action and that such amount may be added to and made a part
of such judgment.
(17) This Agreement shall be binding on the successors and assigns of
the parties, but it shall not be assigned by the CONSULTANT without written consent of
the CITY.
(18) The CONSULTANT shall be an independent contractor, not an
employee of the CITY.

(19) Prohibited interests are as follows:
No officer, member or employee of the CITY during his tenure or one year
thereafter shall have any interest, direct or indirect, in this Agreement or the proceeds
thereof. The parties hereto covenant and agree that to their knowledge no member of
the City Council, officer or employee of the CITY has any interest, whether contractual,
non-contractual, financial or otherwise, in this transaction, or in business of the
contracting party other than the CITY, and that if any such interest comes to the
knowledge of either party at any time a full and complete disclosure of all such
information will be made in writing to the other party or parties, even if such interest
would not be considered a conflict of interest under applicable laws.
The CONSULTANT hereby covenants that he has, at the time of this
Agreement, no interest, and that he shall not acquire any interest in the future, direct or
indirect, which would conflict in any manner or degree with the perFormance of services
required to be performed pursuant to this Agreement. The CONSULTANT further
covenants that in the performance of this work no person having any such interest shall
be employed by the CONSULTANT.
(20) The CONSULTANT shall indemnify and save harmless the CITY,
its officers and employees from and against any liability, loss, cost or expense resulting
from any injury or damage to persons or property arising out of, pertaining to, or relating
to the negligence, recklessness, or willful misconduct of the CONSULTANT, its agents
or employees, while engaged in the perFormance of this Agreement. The
CONSULTANT shall submit to CITY, prior to the Notice to Proceed is issued,

certification of adequate coverage for "errors and omission" insurance in amounts as
specified. Any such insurance shall not be canceled prior to written notice to and
approval from the CITY.
(21) The City shall not be responsible for payment for services by the
Consultant that are directly related to addressing discrepancies, errors, omissions,
ambiguities, etc in the plans, specifications, and estimates prepared by the consultant.
(22) In case of conflicts within the contract documents, the document
precedence shall be as follows:
(a) This Agreement;
(b) Exhibit "A" (CONSULTANT'S Proposal of Services, and any
written modifications thereto).

5. Two slides of 28 feet of less.
6. Shade structures for picnics, and shaded areas adjacent to the bathhouse,
and at the zero-depth entry pool.
7. Concession stand with window opening to the pool and to the park, and
storage.
8. Men's, women's and family changing rooms.
9. Storage area.

and available from the CITY and necessary for the work outlined in Exhibit "A" hereof
shall be furnished to CONSULTANT without charge by CITY and CITY shall cooperate
in every way reasonable in the carrying out of the work without delay.
(4) CONSULTANT represents that, it employs or will employ at its own
expense, all personnel required in performing the services under this Agreement.
(5) All of the services required hereunder will be perFormed by
CONSULTANT or under its direct supervision, and all personnel engaged in the work
shall be qualified and shall be authorized or permitted under state and local law to
perform such services.
(6) The execution of this Agreement by the parties hereto does not
constitute an authorization to proceed. CITY's Director of Public Works has not
authorized CONSULTANT to proceed.
(7) The CONSULTANT shall work closely with the CITY's Director of
Public Works, or his designated representative, who shall be the principal officer of the
CITY. The CONSULTANT shall review and receive the Director of Public Works
approval of the details of work as it progresses. The Registered Architect of Engineer
hereby designated by the CONSULTANT as its representative for supervision of the
work required by this Agreement is Dave Evans, Architect License No. C28594.
(8) The CONSULTANT warrants that he has not employed or retained
any company or person, other than a bona fide employee working solely for the
consultant, to solicit or secure this Agreement, and that he has not paid or agreed to
pay any company or person, other than a bona fide employee working solely for the
consultant, any fee, commission, percentage, brokerage fee, gifts, or any other
consideration, contingent upon or resulting from the award or making of this Agreement.
For breach or violation of this warranty, CITY shall have the right to annul this
Agreement without liability or in its discretion to deduct from the contract price or
consideration, or otherwise recover, the full amount of such fee, commission,
percentage, brokerage fee, gift or contingent fee.
(9) The right is reserved by the CITY to terminate the Agreement at
any time upon seven (7) days written notice, in the event the project is to be abandoned
or indefinitely postponed, or in the event the CONSULTANT'S services, in the sole
judgment of CITY, are unsatisfactory or because of the CONSULTANT'S failure to
prosecute the work with diligence or within the time limits specified or because of his
disability or death. In any such case, the CONSULTANT shall be paid the reasonable
value of the services rendered, based upon CONSULTANT'S standard hourly rates, up
to the time of the termination. The CONSULTANT shall keep adequate records to
substantiate costs and provide copies of original timecards in the event of termination or
suspension.
(10) All documents including tracings, drawings, estimates, reports,
investigations and computations shall be delivered to and become the property of the
CITY. CITY acknowledges and agrees that all plans, specifications, reports and other
design documents prepared by CONSULTANT pursuant to this agreement shall be
used exclusively on this project and shall not be used for any other work without the
written consent of CONSULTANT. In the event CITY and CONSULTANT permit the re-
use or other use of the plans, specifications, reports or other design documents, CITY
shall require the party using them to indemnify and hold harmless CITY and
CONSULTANT regarding such re-use or other use, and CITY shall require the party
using them to eliminate any and all references to CONSULTANT from the plans,
specifications, reports and other design documents.
(11) The CONSULTANT shall comply with all federal, state and local
laws, ordinances and regulations applicable to work.
(12) No change in the character or extent of the work to be performed
by the CONSULTANT shall be made except by supplemental authority in writing
between CITY and the CONSULTANT. The supplemental authority shall set forth the
changes of work, extension of time and adjustment of the fee to be paid by CITY to the
CONSULTANT, if any.
(13) In connection with the execution of this Agreement, the
CONSULTANT shall not discriminate against any employee or applicant for
employment because of race, religion, color, sex or national origin. The CONSULTANT
shall take affirmative actions to insure equal employment opportunity and that
employees are treated during their employment without regard to their race, religion,
color, sex or national origin. Such actions shall include, but not limited to, the following:
employment, upgrading, demotion or transfer; recruitment or recruitment advertising;
layoff or termination; rates of pay, or other forms of compensation and selection for
training, including apprenticeship. This clause shall be included in each related
subcontract, if any, awarded by the CONSULTANT.
(14) The CITY agrees to pay the CONSULTANT for the work required
by this Agreement on the following basis:
CONSULTANT shall submit invoices monthly for services performed in
the previous month not to exceed the total contract amount of nine hundred ninety
two thousand, seven hundred dollars ($992,700.00). CITY agrees to pay all
undisputed invoices within thirty (30) days of receipt of invoice. CITY agrees to notify
CONSULTANT of disputed invoices within fifteen (15) days of receipt of said invoice.
(15) The CONSULTANT agrees to complete the work and submit the
Final Design CONSULTING phase as displayed in Exhibit "A".
(16) In the event that any judgment is entered in any action upon this
Agreement, the party hereto against whom such judgment is rendered agrees to pay the
other party an amount equal to the reasonable value of the legal services performed in
his or its behalf in such action and that such amount may be added to and made a part
of such judgment.
(17) This Agreement shall be binding on the successors and assigns of
the parties, but it shall not be assigned by the CONSULTANT without written consent of
the CITY.
(18) The CONSULTANT shall be an independent contractor, not an
employee of the CITY.
(19) Prohibited interests are as follows:
No officer, member or employee of the CITY during his tenure or one year
thereafter shall have any interest, direct or indirect, in this Agreement or the proceeds
thereof. The parties hereto covenant and agree that to their knowledge no member of
the City Council, officer or employee of the CITY has any interest, whether contractual,
non-contractual, financial or otherwise, in this transaction, or in business of the
contracting party other than the CITY, and that if any such interest comes to the
knowledge of either party at any time a full and complete disclosure of all such
information will be made in writing to the other party or parties, even if such interest
would not be considered a conflict of interest under applicable laws.
The CONSULTANT hereby covenants that he has, at the time of this
Agreement, no interest, and that he shall not acquire any interest in the future, direct or
indirect, which would conflict in any manner or degree with the performance of services
required to be perFormed pursuant to this Agreement. The CONSULTANT further
covenants that in the performance of this work no person having any such interest shall
be employed by the CONSULTANT.
(20) The CONSULTANT shall indemnify and save harmless the CITY,
its officers and employees from and against any liability, loss, cost or expense resulting
from any injury or damage to persons or property arising out of, pertaining to, or relating
to the negligence, recklessness, or willful misconduct of the CONSULTANT, its agents
or employees, while engaged in the performance of this Agreement. The
CONSULTANT shall submit to CITY, prior to the Notice to Proceed is issued,
certification of adequate coverage for "errors and omission" insurance in amounts as
specified. Any such insurance shall not be canceled prior to written notice to and
approval from the CITY.
(21) The City shall not be responsible for payment for services by the
Consultant that are directly related to addressing discrepancies, errors, omissions,
ambiguities, etc in the plans, specifications, and estimates prepared by the consultant.
(22) In case of conflicts within the contract documents, the document
precedence shall be as follows:
(a) This Agreement;
(b) Exhibit "A" (CONSULTANT'S Proposal of Services, and any
written modifications thereto).
IN WITNESS WHEREOF, said parties have executed this Agreement the
date first hereinabove written.

Our Scope understanding includes all aspects defined in our Proposal dated November 13, 2009,
Section IV-Scope of Work RFP Desiqn and Construction Support Services for Civic Center Park
Aquatic Center Project, City of Palm Desert DPW, Oct. 22, 2009.
Preliminary Site Desian and Develoqment Phase (includinq Proqramminq):
1. Conduct a project kickoff design meeting with City staff and site visit
• Refine and clarify the project's objectives. City supplied materials will be
provided at this time.
• Confirm the overall schedule, LEED Goals, and construction budget
• Visit the site, take ground level photographs to document field conditions and
highlight critical areas
• Produce Base map drawing including Topo, Boundary and Easement platting
• Conduct follow up site visit to confirm the base map for preliminary design
• Obtain all format requirements and City Standards
2. Development of a site plan showing the location
• Determine the proper size of the new facility and parking requirements
3. Development of a master site plan and basic floor plan
• Building to include check in area, men's and women's changing rooms, family
changing rooms, concession stand, mechanical room, chemical storage,
storage, staff offices, and multi-use room.
• Pool area should include layout of competition and recreation pool, slides,
bleachers and shade structures, and fencing.
• Develop site plan that extends the "campus environment" and not act as a
community "focal point"
• Develop parking lot including a striping plan and ADA and LEED parking
signage
• Utilize berm on the east side of site as a buffer to the neighbors east of the park
and consider utilizing soil from the site to increase the berm for maximum
buffering effects
4. Prepare preliminary water quality management plan (WQMP) and Storm Water
Pollution Prevention Plan (SWPPP).
5. Coordinate all utility services.
6. Develop Elevations including renderings of the proposed aquatic center.

7. Provide cost estimate for preliminary design, site improvements, and new
structures.
8. Provide preliminary landscape design and preliminary engineering for the proposed
development.
9. Locate and identify Cooling/Heating systems, alarm system, video surveillance, and
timing system.
10. Provide Geotechnical soil study.
11. Describe and evaluate methods for new sustainable technologies to be
incorporated into the design and construction of the project.
• Design the project to exceed current Title 24 standards
• Suggest LEED goals for approval of the City
• Design systems to meet goals for LEED Certified application. LEED
Certification is granted by a third party agency and cannot be guaranteed by
the Design Team
12. Coordination with City artist (under separate contract) for a public art component to
the aquatic center.
13. Hydrology Study-Provide the following items:
• Storm drain plans for the onsite mainlines, roof drains, site area drains, planter
drains for 100% on-site retention.
• Designate the horizontal and vertical location of mainlines, laterals and point of
connections.
• Provide hydrology/hydraulic calculations for review by the local agencies. The
design team will design on-site facilities and coordinate the City approvals for
storm drain improvements if applicable.
Desian Development Phase: Upon approval to move forward from the above phase, Gould Evans
will:
1. Identify the approach used for design integration onto site. Gould Evans will:
• Work with the City develop a design that meets goals of the campus
• Address adjacent site activities (concessions for baseball)to develop the project
as part of the campus.
2. Develop design concepts to reflect the LEED goals outlined on the LEED Score
Sheet for 'Certified level'
3. Complete Schematic Design
4. Include all system components at a Design Development Level
5. Prepare Water Quality Management Plan (WQMP) and Storm Water Pollution
Prevention Plan (SWPPP). Dust Control Plan (PM-10) provided by the contractor

6. Include final design and cost estimate
Construction Documents Sqecifications Phase: Upon approval to move forward from the above
phase, Gould Evans will:
1. Coordinate all review and plan checking procedures with the Engineering, Planning,
Building, Landscape, Utilities, Health and Fire Departments
2. Complete Construction Documents consistent with City of Palm Desert Standards
• Current CCR, Title 24 Part I and II
• 2008 amended American with Disabilities Act, Title II
• Other City Standards defined for the project
• Current adopted versions of the above codes at the time of the submittal are
applicable to the project.
3. Prepare a complete bid ready set of plans and specifications in accordance with the
City's standard format for drawings and specifications.
• Include: Title Sheet, Site Plan, Horizontal Control Plan, Precise Grading Plan,
Drainage Plan, Street Improvement Plan (Right Turn Lane), Building Plans, Pool
Plans, Electrical/Lighting Plans, Structural Plans, Mechanical Plans, Water and
Sewer Plans, Landscaping Plans, Irrigation Plans and applicable Detail Sheets
• The scope of the Civil Engineer includes all service laterals including potable,
irrigation, fire, and sewer from the right of way lines to the mains in Magnesia
Falls.
• Design of kitchen facility, such design shall be all residential appliances
• Complete design of the Fire Sprinkler System and Fire Alarm System
• Acoustical Engineering for the building
• Include detail plans such as, but are not limited to, a detailed view of the
equipment, pump room, chemical, utility and mechanical areas, concession
area, and other ancillary areas.
• Include a piping schematic, identification of timing system placement, alarm
systems, video surveillance, means for disposing backwash/wastewater, and
HVAC plans.
• Provide technical specification with standard front end specifications from the
City
4. Assist with questions, addenda and evaluating bids. If bids are inconsistent with
estimates and value engineering or redesign is requested, we reserve the right to
discuss additional services.
5. The final submittal shall include:
• One (1) set of the plans on "D" size mylar sheets
• Two (2) hard copies of the project specifications
• Two (2) hard copies of the quantity and cost estimates
• One (1) CD disk containing electronic files of approved plans (AutoCAD and
PDF files)
• Project specifications (Word format) and quantity and cost estimate (Excel
format)

1. Attend weekly meetings: The Construction administration and management team
will be available for any and all critical inspections throughout the construction
phase for an average of 16 hours per week on-site representation by Gould Evans

Center. Our team will be led by the national community and athletic center
expertise of Founding Principal David Evans, and the award-winning design
leadership of John Dimmel. Our aquatics center planning team will be
led by Dan Zeller (of Gould Evans) and Ken Moeller (oF Arch-Pac). Ken
brings an unparalleled knowledge of this project from his ongoing planning

Cost Control, Quality Control and Schedule Control are dynamically
linked; they must be managed as a whole to achieve balanced solutions.
This process inherently involves uncertainty and risks; mst instability of
commodities, reconciliation of project budget with programmatic needs,
fast track schedules, among others.
We believe that quality control must be an inherent pazt of every aspect of
doing business, during every phase of a project. We realize the importance

of design in our work but also recognize that transitioning the project from
drawings to reality requires high expectations for quality control along the
way. Our 9uality control procedures are structured to create an environment
of open and honest communication that clearly defines expectations, goals,
and desires, while reducing opportunities for budget overages.
We will have regular meetings with our consultants on this project [o insure
all services and regulatory items are coordinated and on-schedule. These
meeting will be scheduled in a manner where consultants will overlap with
each other to ensure the highest amount of first-hand knowledge is transferred
and discussed in a group setting. Our consultants will also be reviewing
the cost estimates we will provide on this project to ensure all engineering
practices are estimated at the level of the scheduled estimate.
POTENTIAL PROfECT CHALLENGES
Aquatics projects focus largely on site elements and how they can furcher
enhance the experience one feels when visiting the park. The experience
should transition as you move between features in the park. The new parking
lot set within the existing Date grove will create a strong sense of arrival to
this corner o{the pazk. This feeling should progress as you approach the
