Holta DATE: February 26, 2009 CONTENTS: Staff Report, Copy of Email Request and Copy of Building Permit for Project 08-00046270 Recommendation: By Minute Motion, Staff requests that the City Council refund the Plan Check Fee in the amount of $3,379.60 for Building Permit 08-00046270 for a project located at 44-277 Portola Avenue. Executive Summary: On December 31, 2008, Plan Check Fees of $3,379.60 were paid by Mr. Holta. On February 3, 2009, a request from Lauri Aylaian, Community Development Director was received to refund all permit fees paid to the Department of Building and Safety. Mr. Holta will be submitting new plans and the appropriate Plan Check fees will be paid in the future. No staff time was expended on this project. I agree that yaur e-mail message accurately reflects our discussions. Further,we have discussed the fact that in a single family residence, Mr. Holta is allowed to have up to six nursing home patients in residence, provided that he obtains the appropriate State licensure. The znne in which the residence is located will not allow any more than six nursing home patients to live on the premises without a Conditional Use Permit. By capy af this e-mail, I am asking the acting pirector of Building& Safety to refund the plan check fee that Mr. Holta has paid and return the submitted drawings if Mr. Holta so requests. This confirms that Holta will re-submit plans that reduce the building by three bedrooms and eliminate double-sinks in all bathrooms except the Master Bath and one additional bathroom. Holta will await having the plans revised until we receive confirmation from you on this. At that time,the appeal will be considered withdrawn and the new plans will be submitted. Thanks again.
